<figure><img src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221110141144/636d00c69c7e80680e0a35f6jpeg.jpg" alt="" width="1530" height="1018"/><figcaption>Illustration: DIWAKAR CHETTRI</figcaption></figure>Nepal’s political headlines these days are mainly about the <a href="https://www.nepalitimes.com/latest/old-wine-in-old-bottle-in-nepal-politics/" target="_blank" rel="noopener noreferrer">rift between K P Oli and Madhav Kumar Nepal </a>that split Nepal’s largest party, the UML. Somewhat sidelined is the role of Maoist chair Pushpa Kamal Dahal, who has been the behind-the-scenes operator.Dahal went under the nom de guerre Prachanda (‘Fierce One’) during the insurgency, was elected prime minister in 2008, and resigned after trying to replace the Nepal Army Chief. He himself is the first to admit that peacetime politics is not easy.Last month, he confessed to <a href="https://www.nepalitimes.com/latest/who-gets-what/" target="_blank" rel="noopener noreferrer">being under “tremendous stress”</a> because most of the 49 MPs of his Maoist Centre party wanted to be ministers in the coalition government. He added that politics in Nepal does not move in a linear fashion, but has a tendency to go off on an unpredictable tangent.“I have learnt a lesson that you cannot win if you try to manipulate others too much,” he told a party meeting in April in Chitwan.As he warms up to a theme, Dahal is prone to making such self-deprecating comments that are embarrassing or even damaging to himself. After the ceasefire in 2006, he was caught on video boasting to Maoist cadre that he had tricked the United Nations into believing his highly inflated figure for militia strength to bloat the budget for cantonments.His remarks in Chitwan in April were about how he infiltrated the UML by uniting his Maoist party with it, and the goal was to ultimately take over the Communist Party of Nepal (CPN). This was the first time he publicly admitted the real reason he agreed with Oli to unite their parties.In fact, divide-and-rule has long been Dahal’s way to gain and maintain power both during the conflict, after the ceasefire in democratic politics, and right up to backing <a href="https://www.nepalitimes.com/latest/deuba-5/" target="_blank" rel="noopener noreferrer">Sher Bahadur Deuba of the Nepali Congress (NC) for prime ministership</a> earlier this year.Dahal and Oli took a bold decision with the Maoist-UML electoral alliance and unity in 2018 to form a strong two-thirds majority government. At first, the two were best buddies. But things started turning sour when Dahal suspected that Oli had no intention to hand over prime ministership half-way through the government’s term as per their “gentlemen’s agreement”.Since Oli was <a href="https://www.nepalitimes.com/here-now/making-up-is-hard-to-do/" target="_blank" rel="noopener noreferrer">not on good terms with Madhav Kumar Nepal</a> and Bamdev Gautam, Dahal found an opening. Oli knew what Dahal was up to, and was also trying to outwit Dahal by using all kinds of tricks to stay on in power — including dissolving the Lower House in December 2020.After the Supreme Court reinstated the House, and Oli was on the back foot, Dahal formed an alliance with dissident UML members, the NC and the JSP to gather the numbers to unseat Oli.The end result was not just the disintegration of the CPN, but also the split in the UML with Madhav Nepal ultimately forming his own party, CPN (United Socialist) last month.The five party alliance is having <a href="https://www.nepalitimes.com/latest/what-is-delaying-nepal-cabinet-expansion/" target="_blank" rel="noopener noreferrer">difficulty expanding the Cabinet</a>, but Dahal is at the meetings negotiating portfolios to divide up the spoils.All these machiavellian moves have resulted in a peculiar political outcome —  the largest party in Parliament is now in the opposition and a weak opposition NC is leading the government.Dahal steered his former underground party to electoral victory in the first Constituent Assembly election in 2008, but lost in 2013. But even then, Dahal was trying to drive a wedge in the NC-UML coalition by supporting Oli’s candidature for prime ministership against the NC.He fell out with Oli and helped bring him down to form a coalition with the NC with an agreement to rotate government leadership with Deuba, and became prime minister for the second time. However, he soon ditched Deuba and formed the electoral alliance with Oli and the UML for the 2017 polls.All this behind the scenes skulduggery was not new to Dahal. What is new is that he now publicly admits that it does not work.This is the same Dahal who as a powerful post-conflict prime minister in 2009 sacked Nepal Army chief Gen Rukmangud Katuwal and replaced him with Gen Kul Bahadur Khadka. Dahal’s intention then was to divide and capture the Nepal Army which he had fought against as a guerrilla commander. But the move backfired, Dahal had to resign after only nine months as prime minister, and he and his party had to wait long years to stage a political comeback.He was succeeded by Madhav Kumar Nepal as prime minister, but Dahal was up to his old tricks and deposed Nepal by lending his party’s support to Jhalnath Khanal that brought an open rift in the UML. Distrust was growing within the Maoists about Dahal’s ways, and after facing a mutiny from Baburam Bhattarai, Mohan Baidya and Narayankaji Shrestha in 2011, he dumped Khanal and replaced him with Bhattarai.It is the story of Nepal that the same politicians play musical chairs, <a href="https://www.nepalitimes.com/editorial/deubas-denouement/" target="_blank" rel="noopener noreferrer">becoming prime minister multiple times</a>, and remaining in party leadership for life. For the past 30 years: the same names are in the headlines: Deuba, Nepal, Oli, Dahal, Bhattarai, Gautam, Khanal.“Dahal’s character is to aspire to be a singular and powerful Communist leader, that is why he sacrificed so many lives during the conflict, for him the end justifies the means,” explains political scientist Mahadev Sah. “He does not have any affinity for democracy. It is all about power, and how to attain and retain it.”Pushpa Kamal Dahal is still Prachanda. In 2007, he had told his former guerrillas in Chitwan’s Shaktikhor camp: “During the war we machine gunned our enemies, now we sit around a table and sip tea with them. The method may be different, but the goal is the same.”Today, Dahal’s role has been to handle the same personalities he once waged an armed struggle against, and after the war manipulated from behind the scenes. While undermining Oli for the past two years, he let Nepal do most of the talking. Now, he allows Deuba to be out front.  But his own party is now so weakened that it needs alliances to win elections.The leader of the Marxist-Leninist wing of the Nepal Communist Party C P Mainali knows Dahal well, and says he has let so many people down along the way that it has become a habit, and the only way he knows how to do politics.“He is used to working in the shadows, orchestrating things from behind, he cannot operate in the open, with transparency,” Mainali says. “What he says and what he does have always been completely different."This is true not just in <a href="https://www.nepalitimes.com/latest/nepals-post-breakup-politics/" target="_blank" rel="noopener noreferrer">domestic politics</a>, but in Dahal’s dealings with leaders of neighbouring India and China, while in or out of power. He commented openly about his domestic political travails while abroad in controversial interviews. Or, he often boasted about support from leaders in Beijing or Delhi to bolster his domestic standing. In June, he said Delhi would be “comfortable” with him becoming prime minister again.After failing in his objective to capture the CPN, Dahal is now intent on being the foremost Communist leader in Nepal. He used Madhav Nepal and Khanal to depose Oli, and weaken the UML. So far, it is to Dahal’s credit and political instincts that his strategy has met with success.Dahal’s charm offensive seems to have worked on Nepal, who finds the Maoist leader a lot more trustworthy than Oli. It would not be surprising if the United Socialists and the Maoists combine forces in the 2023 elections.What Dahal is doing now is no different than what he was doing as Prachanda during the insurgency. Sometimes he cosied up to Mohan Baidya against Baburam Bhattarai, and at other times he won over Bhattarai to sideline Baidya.C P Mainali says: “That is always how he operated, to use one comrade against another, and keep himself as a key player.”Dahal has his eyes fixed on 2023, and is willing to revive the electoral cooperation that won his party 54 seats in local elections in 2017. But Mahadev Sah does not see that as likely. He says: “The Maoists could not remain united with the UML, so it is difficult to believe that an alliance with the Congress will stick. It may help Dahal exact revenge on Oli, but in fact, it may even be counterproductive to both parties and a loss of face for the Maoists.”

As these companies become more powerful, governments, especially in Europe, are under pressure to protect the privacy of citizens. Nepal, on the other hand, seems to want to practice surveillance communism.What alerts us to this looming danger is the recent convergence of the Criminal Code penalising social media content, the <a href="https://www.nepalitimes.com/banner/long-shadows/" target="_blank" rel="noopener">Media Council Bill</a>,  and the <a href="https://www.nepalitimes.com/editorial/rule-by-law/" target="_blank" rel="noopener">Information Technology Bill</a> with the Special Services Bill and the acquisition of sophisticated eavesdropping technology by the state.Read also: <a href="https://www.nepalitimes.com/banner/no-freedom-after-expression/" target="_blank" rel="noopener">No Freedom After Expression </a> , Kiran NepalNo doubt, all governments need surveillance technology to control crime and terrorism by giving the intelligence community the proper wherewithal. But in all democracies, there are legal safeguards in place to protect unwarranted spying on citizens that would infringe on their fundamental right to privacy.What is worrisome in Nepal is that the state security apparatus and investigation agencies are not just being allowed to import surveillance technology: the government is simultaneously pushing legislation that would remove current restrictions on their use.This is made even more dangerous by the fact that it is happening at a time of <a href="https://www.nepalitimes.com/latest/14-years-after-conflict-no-closure-in-nepal/" target="_blank" rel="noopener">unprecedented impunity, the collapse of accountability of public officials</a>, an epidemic of extortion and corruption, and an open <a href="https://www.nepalitimes.com/editorial/crushers-of-justice/" target="_blank" rel="noopener">politico-criminal nexus</a>. The past record of the hacking of Nepal government agency websites and the rise in cybercrime does not inspire confidence in confidentiality safeguards.Read Also: <a href="https://www.nepalitimes.com/banner/gagging-the-press-in-installments/" target="_blank" rel="noopener">Gagging the press in installments</a>, Sewa BhattaraiNepal’s spy agencies have been on a shopping spree to import Russian, Chinese and Malaysian speech forensics technology, CCTV cameras, SIM locators, Digital Information Systems, Mobile Device Management Systems, and International Mobile Subscriber Catchers.The Central Investigation Bureau has acquired SIM locators that will allow it to pinpoint where the user is without having to go through a telecommunication provider and obtain a court warrant.The National Investigation Bureau which has been brought directly under the Prime Minister’s Office this month called for bids to establish a Digital Information System to integrate the data flow of various security and intelligence agencies. The Nepal Telecommunication Authority is soon getting a Rs1 billion Mobile Device Management System to keep track of phone users from the Malaysian company Nuemera (M) Sdn Bhd, which was linked in 2017 to a data leak involving 46.2 million Malaysian mobile phone accounts.Read Also:  <a href="https://www.nepalitimes.com/latest/nepal-undermining-free-expression-hrw/" target="_blank" rel="noopener">Nepal undermining free expression</a>The government has also loosened regulations governing the use of CCTV cameras, and the import of these devices doubled in 2019 to Rs970 million from the previous year. The Special Services Bill in Parliament would also allow International Mobile Subscriber Identity (IMSI) ‘Catcher’ that can intercept and tap phones. The use of these surveillance devices is so sensitive that the European Court of Justice has actually outlawed them.<a href="https://www.nepalitimes.com/here-now/spooking-nepalis-by-snooping-on-them/" target="_blank" rel="noopener">The Special Services Bill</a> gives the chief of the National Investigation Bureau the sole authority to tap phones, without a court permission. Given the prevalence of blackmail and extortion against political and business rivals, the risk of abuse of this spyware is unacceptably high in Nepal. For example, police last week leaked CCTV footage of an altercation at Kathmandu domestic airport between a female police officer at the security check and singer Astha Raut. A state agency that has no qualms about flouting rules about proper use of footage has no right to be tapping phones.Putting together these recent decisions, new laws and pending bills in Parliament, the ruling NCP seems intent on extending control, spying on citizens to intimidate them, and silencing dissent. In most democracies, governments make laws to protect the privacy of citizens. Not much different than ten years ago when it was the Pushpa Kamal Dahal-led Maoists who were doing it. Looks like the ex-democratic UML is no fan of a free media. Excerpt from an editorial in <a href="http://archive.nepalitimes.com/issue/486" target="_blank" rel="noopener">#487</a> of 29 Jan-4 Feb 2010.Pushpa Kamal Dahal has done it again. He is once more blaming the messenger, the ‘big media houses’ for undermining his party. Usually when a politician repeats his accusation, it reinforces its significance. But with Dahal, the ranting now seems to have the opposite effect. He has cried wolf so often that the remark made during a speech in Sindhuli on Monday went either unreported, or was relegated to the inside pages.<img src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221109101124/636b71f79c7e80680e0600fdjpeg.jpg" alt="" width="515" height="800">Yet there is a sinister undercurrent here. The Maoists have made no attempt to hide their contempt for the notion of a free press, just as they have for nonviolent pluralistic politics. Dahal went on to accuse the media of being ‘anti-nationalist.’ This has always been the Maoist method.

In a surveillance state

Despite its <a href="https://www.nepalitimes.com/editorial/two-thirds-empty/" target="_blank" rel="noopener">strong majority</a>, the party’s performance has been underwhelming.It may look like the NCP is just lurching from one embarrassing cockup to another. But there are signs the party may have A Plan. That all along, it has been aiming not for ‘stability and prosperity’, but for the <a href="https://www.nepalitimes.com/here-now/spooking-nepalis-by-snooping-on-them/" target="_blank" rel="noopener">extension of control</a>, the <a href="https://www.nepalitimes.com/editorial/rule-by-law/" target="_blank" rel="noopener">stiffling of dissent</a>, the intimidation of critics, the <a href="https://www.nepalitimes.com/banner/gagging-the-press-in-installments/" target="_blank" rel="noopener">muzzling of the media</a> and the constriction of civil society. There may be a <a href="https://www.nepalitimes.com/here-now/which-way-nepali-politics-in-2020/" target="_blank" rel="noopener">power struggle at the top</a> between Prime Minister Oli and his comrade Pushpa Kamal Dahal, but on matters of control and domination the party has <a href="https://www.nepalitimes.com/here-now/one-body-two-heads/" target="_blank" rel="noopener">one body with two heads</a>.The Cabinet has zero accountability and no performance evaluation. Instead, ministers regularly threaten critics with crude scare tactics. They take their cues from Prime Minister Oli, who last week accused editors in the Nepali media of being “without hearts”. It is true that the criticism of Oli across a broad-spectrum of the national media over <a href="https://www.nepalitimes.com/here-now/the-business-of-politics-undermines-nepals-democracy/" target="_blank" rel="noopener">his dealings with the Yeti Group</a> has been relentless, but we have received no satisfactory explanation of why the consortium gets preferential treatment in leases of former royal property by the Nepal Trust.The government’s actions over the past two years may seem ad hoc and haphazard, but taken together there appears to be a method to the madness. Let’s take the <a href="https://www.nepalitimes.com/banner/no-speaker-no-parliament-in-nepal/" target="_blank" rel="noopener">sidelining the NCP’s own Shivamaya Tumbahangphe</a> and the bullheaded approach to replace a <a href="https://www.nepalitimes.com/banner/the-rise-and-fall-of-comrade-mahara/" target="_blank" rel="noopener">rape-accused Speaker</a> with a murder-accused Speaker. If we had to cite just one example of why there is <a href="https://www.nepalitimes.com/latest/getting-away-with-murder/" target="_blank" rel="noopener">impunity and blatant flouting of the rule of law</a> in this country, the appointment of <a href="http://archive.nepalitimes.com/blogs/thebrief/2011/05/31/hearing-set-for-case-against-minister-agni-sapkota/" target="_blank" rel="noopener">Agni Sapkota</a> to the post of Parliament Speaker is it.Read also: <a href="https://www.nepalitimes.com/banner/no-speaker-no-parliament-in-nepal/" target="_blank" rel="noopener">No Speaker, no Parliament in Nepal</a>, Sewa BhattaraiEver since the end of the conflict 14 years ago, the Maoists, the UML, NC and the security forces have been <a href="https://www.nepalitimes.com/banner/yesterdays-enemies-todays-comrades/" target="_blank" rel="noopener">partners in crime</a> in sweeping their combined <a href="https://archive.nepalitimes.com/article/editorial/state-of-impunity,2976" target="_blank" rel="noopener">wartime atrocities</a> under the carpet. Families of the victims and survivors of the war demand justice and truth, but every government since 2006 has tried to rig the <a href="https://www.nepalitimes.com/banner/12-years-later-justice-is-a-mirage/" target="_blank" rel="noopener">transitional justice</a> mechanism, and not a single perpetrator has been brought to trial. In fact, perpetrators get to lead Parliament.Agni Sapkota is accused of murdering <a href="https://www.himalkhabar.com/news/111027" target="_blank" rel="noopener">Arjun Lama, an activist of the UML</a>, in Kavre in 2005. The irony of it all is that the UML and the former Maoists are now unified in the Nepal Communist Party. After years of struggling for justice for her husband, Purnimaya Tamang finally told this paper this week: “I have lost all hope for justice now.”Pushpa Kamal Dahal may have been technically right in stating last week in Chitwan that he was responsible for the deaths of “only” 5,000 of the 17,000 people killed during <a href="https://www.nepalitimes.com/latest/nepals-transition-to-peace-needs-justice/" target="_blank" rel="noopener">the conflict</a>. But who is keeping count? If this vulgar non-repentance rattled many Nepalis, imagine what it did to the families of the disappeared and the survivors of that terror-filled decade.One of the provisions of the Comprehensive Peace Accord signed in 2006 was the establishment of a <a href="http://archive.nepalitimes.com/regular-columns/One-To-Many/victims-waiting-for-justice,698" target="_blank" rel="noopener">Truth and Reconciliation Commission (TRC) and a Commission for Investigation on Enforced Disappeared Persons (CIEDP)</a>. But all governments since have conspired to make these commissions ineffectual by appointing party loyalists to their senior positions so that no one ever has to answer for war crimes. This week, the NCP and NC appointed new handpicked commissioners to the TRC and CIEDP.Aside from transitional justice, the NCP has been trying to dismantle just about every sector in which Nepal has done well. There are <a href="https://www.nepalitimes.com/from-the-nepali-press/taking-away-forests-from-communities/" target="_blank" rel="noopener">attempts to dilute the laws</a> governing <a href="https://www.nepalitimes.com/banner/who-now-owns-nepals-forests/" target="_blank" rel="noopener">community forestry</a>. Pushpa Kamal Dahal hinted in Madi last week that he intended to change the by-laws governing Chitwan National Park. Under pressure from the fossil fuel lobby, the Finance Ministry is said to be thinking of scrapping <a href="https://www.nepalitimes.com/banner/nepals-electric-transport-future-is-here/" target="_blank" rel="noopener">the tax rebate on electric vehicles</a>. And this week, the Home Ministry was reported to be drafting a new Social Organisations Act which will allow it to close down non-government organisations it does not like.Taken together, it is not hard to see what the NCP has been working hard to do in the past years. In an Orwellian sense, when the party said ‘stability’, it always meant ‘control’.<h2>10 years ago this week</h2>...The <a href="http://archive.nepalitimes.com/news.php?id=16728" target="_blank" rel="noopener">analysis by Ashutosh Tiwari</a> in <a href="http://archive.nepalitimes.com/issue/486" target="_blank" rel="noopener">issue #486 of 22-28 January 2010</a> shows us how the power centre may have shifted in the last ten years, but the lust for power among our political leaders remains the same. As two Communist alpha males continue to battle it out in the ruling NCP, the latest casualty is the post of Speaker, with the sidelining of Shivamaya Tumbahangphe in favour of a murder-accused candidate: Even accounting for politicians’ lust for power, what’s wrong with our particular democratic structure that keeps on returning the same old politicians to power no matter how many Roman numeral andolans we have?On the outside, our system has the requisite avatar of a democracy (multiple parties, elections, political horse-trading, etc). Dig deeper, and you will find that it’s not the voters who call the shots but the party leaders, who have designed their parties’ internal structures in such a way as to keep them in power for as long as they live. With allegations that the bill restricts the fundamental rights of citizens, there is concern that provisions of SSB will violate citizens’ fundamental right to privacy.NC parliamentarian Radheshyam Adhikari says this is a direct threat to  citizens' fundamental rights like privacy and freedom. "This bill shows that the government is against democracy and an open society, and does not believe in transparency and accountability. It will allow the government to snoop on anyone it does not like, and use the information to threaten or blackmail them.”Read also: <a href="https://www.nepalitimes.com/editorial/censuring-censorship/" target="_blank" rel="noopener">Censuring Censorship</a>, Editorial The SSB will allow the National Investigation Bureau (NIB) to collect any information on anyone without a warrant. The Act's Section 10, subsection 6 states: ‘In the course of information collection or counterintelligence, the Bureau can monitor, intercept, or record the conversations of people or organisations under suspicion or monitoring, made in public, or through any other audio visual or electronic medium.’The Bill also defines interception as the act of monitoring communication channels and gathering data. Though the Bureau has in the past spied on individuals, it is not authorised by law to do so. It could also lead to leakage of information and violate fundamental freedom in direct contravention of the constitution.Article 8 of the Constitution states that information regarding a person’s residence, property, documents, statistics, correspondence, or character, cannot be violated unless otherwise required by law.Former Chief Justice Kalyan Shrestha says the bill increases the chance of misuse of power. "There should be clear provisions about where the right to privacy can be breached with monitoring and where it cannot. And there should also be provisions for legal redress if someone's privacy is breached when the government uses this right," he says.Read also: <a href="https://www.nepalitimes.com/banner/gagging-the-press-in-installments/" target="_blank" rel="noopener">Gagging the press in installments</a>, Sewa Bhattarai Constitution expert Bipin Adhikari goes further, stressing that the law will endanger the country’s democratic polity itself. "A person at the highest level of government may use these provisions to undermine the system itself," he says, referring to how the former king Gyanendra Shah used Article 123 to take power.There is also precedent set by the former head of the Centre for the Investigation of the Abuse of Authority Lokman Singh Karki, who in 2013 operated a state within a state and regularly tapped the phone calls of 293  critical politicians, security officers, civil society leaders, judges and journalists. When Parliament decided to impeach him in 2016, the phone tapping was prominent in the list of reasons.However, there are some who say the danger to democracy has been blown out of proportion. The former head of the National Investigation Bureau Deviram Sharma says, "This law is not meant to snoop on ordinary citizens' phone conversations. It intends to monitor terrorism, antinational activities,  and the activity of dubious foreigners. A draft of the bill was actually prepared 17 years ago, and it has been tabled with timely amendments."Read also:<a style="background-color: #ffffff; font-size: 15px; letter-spacing: 0.01em;" href="https://www.nepalitimes.com/latest/nepal-undermining-free-expression-hrw/" target="_blank" rel="noopener"> Nepal undermining free expression: HRW</a>In fact, the draft bill does state that the law is needed to control ‘spying, armed insurgency, coup, inciting others to violence, aiding foreign countries or organisations, breaching the harmony between people of different classes, races, ethnic groups, religions and communities, secessionism, spreading hate and violence, armed and underground groups, illegal activities on border areas, etc.’But that is precisely what worries rights activists, who say that the definition of whom the state is allowed to spy on is so vague and broad that anyone in authority can use it to snoop on political or business rivals, the media or critics of the government.Government across the world have intelligence agencies that are given powers to spy on their own citizens, but these powers are strictly limited by law. Even so, some democratic states like India, the US and UK have made it  easier for intelligence agencies to spy on their citizens, especially when it comes to terrorism. But the Panchayat system collapsed, and with it the first attempt to allow the government to spy on its citizens.The law was discussed again during the Maoist war, and a draft was even drawn up in 2001, but it was not tabled. Even today, snooping on private citizens is barred by law, but that has not stopped the National Investigations Bureau and others to snoop on calls and messages.Security agencies in Nepal regularly use call/sms data in their investigations, which is actually illegal. Some have even made private information public. After Advocate Baburam Aryal and four others filed a case against the practice in February 2016, then Chief Justice Kalyan Shrestha and judge Devendra Gopal Shrestha had ruled that a person's right to privacy was "entirely private and fundamental" and limited the practice.Read also:<a style="background-color: #ffffff; font-size: 15px; letter-spacing: 0.01em;" href="https://www.nepalitimes.com/latest/ifj-asks-nepal-to-revoke-media-gag/" target="_blank" rel="noopener"> IFJ asks Nepal to revoke media gag</a>The verdict stated that since there was no law which allowed security officers to tap phone calls or look at sms, the officers would have to take permission from the District Court before doing so."That is a temporary provision. In the long term, there needs to be balance between individual's right to privacy and the state's need to investigate. A full-fledged law is the permanent solution," says ex-Chief Justice Shrestha.The NIB was previously under the Home Ministry, but in February 2018 it was brought under the purview of the Prime Minister’s Office and Cabinet Secretariat. Although the Bureau’s main duty is to safeguard national security,  the proposed bill expands its area of work to include human trafficking, drug trafficking, illegal wildlife trade. Read also:<a href="https://www.nepalitimes.com/editorial/a-creeping-coup/" target="_blank" rel="noopener"> A creeping coup,</a> Editorial"The objective of the Bureau is to protect the national interest. Giving it unlimited powers increases chances of misuse, especially since departments under the PMO are not accountable to any other government department," says Hemanta Malla, former DIG of Nepal Police.There is still time for parliamentarians to debate the Bill and change its provisions if required, but the government appears to be intent on using its majority in Parliament to ram it through. Experts say the bill should have provisions for legal redress, and provisions against transfer or sale of information collected. NC MP Radheshyam Adhikari concludes: "The way it is reads now, it lets the government pry into people's lives, intimidate them and threaten to disclose their private details if they don't obey." "The government is pushing through a law that is above the constitution. The law will grant extraordinary powers to the Bureau any time, which are to be used only in emergencies. But there is not enough awareness in civil society about this. Yes, security forces should have powers, but there should also be check and balance. For example, then chief secretary of the government Lilamani Pudel made a 9-point code of conduct about officers meeting foreigners. That angered them. Baburam Bhattarai had promised to not transfer any secretaries, but transferred one of them within 18 days of becoming PM. We need to stop this kind of meddling. The current protests against the Bill is instigated by such foreigners."

Spooking Nepalis by snooping on them

Lest we forget, in late September we saw a series of crackdowns on freedom of expression that had a dampening effect, especially on Internet content.Elected demagogues worldwide learn fast: they have discovered that there is no need to kill journalists anymore — it is much more effective to kill journalism.By destroying the credibility of the media, citizens are no longer able to tell the difference between truths and lies, allowing rulers to get on (and get away) with wrongdoing. In this post-truth, fake news universe, the social web allows instantaneous spread of falsehood, rumours and manipulated information. This creates an environment for self-censorship, and the silencing of independent voices.One would have thought that with its landslide victory in the 2017 elections, the ruling Nepal Communist Party would be able to perform, deliver services and upgrade infrastructure. The media would have automatically heaped praises. There has not been any sudden, swift crackdown — the pressure has <a href="https://www.nepalitimes.com/banner/gagging-the-press-in-installments/" target="_blank" rel="noopener">mounted in instalments</a>. The intention seems to be to take our freedoms away bit by bit so that we won’t even notice when they are all gone — rather like the traditional Chinese practice of torture and execution known as lingchi, death by a thousand cuts.The story so far:<ul><li>Nepal’s new penal code last year criminalised the use of images deemed derogatory (section 295), slapped hefty fines and jail terms for recording conversations (section 293) and announced strict punishment for sending, receiving or using online data (section 298). It even banned Photoshopped images for the purpose of satire.</li> <li>Parliament introduced a bill to prohibit journalists from publishing personal information of public officials, ostensibly to protect officials’ privacy.</li> <li>Editors of mainstream newspapers were unceremoniously summoned to the Press Council for intimidating interrogations.</li> <li>Journalists at the RSS news agency were questioned for filing a story on the Dalai Lama being discharged from hospital in New Delhi while President Bidya Devi Bhandari was on a visit to Beijing.</li> <li>The Ministry of Communication and Information Technology is backing a draconian Media Council Bill through Parliament, which would criminalise speech on vague grounds.</li> <li>In June, vlogger Pranesh Gautam was jailed by police for five days for an irreverent review of a new Nepali movie.</li> <li>Satire singer Pashupati Sharma was threatened by ruling party toughies to take down a music video ridiculing the culture of corruption in high places.</li> <li>A person was tracked down and arrested earlier this year for poking fun at the Prime Minister on Facebook.</li> <li>The Information Technology Act can sentence people for 5 years in jail and levy a fine of up to Rs150,000 for ‘improper’ social media posts. What constitutes ‘improper’ is so broad that anyone can be hauled in on any pretext.</li> <li>Gyanendra Shahi, who posted a video on Facebook of Tourism Minister Yogesh Bhattarai being berated by passengers for delaying a flight in Nepalganj, was so badly beaten up he had to be hospitalised.</li> <li>Last month, rapper VTen was arrested for a music video deemed obscene.</li></ul>After each of these arrests social media exploded with virulent criticism of the government. The high profile arrests for posting on social media are meant to warn the public, and any infraction is so loosely defined that just about anyone can be hauled in for anything.The government’s intolerance for criticism seems to be a reflection of worries about Prime Minister Oli’s health, which has led to jostling for succession within the NCP. The former UML component of the NCP, which at least paid lip service to liberal democracy, is being subsumed by more authoritarian comrades in the party with erstwhile Maoist credentials.The emperor does not like it when it is pointed out that he is naked. Power does not like it when you speak truth to it. So, the knee-jerk reaction is to harm the messenger. The threat to freedom of expression today is not from despots, but elected leaders who have co-opted the legislature, judiciary and the security apparatus.The crackdowns in Nepal are not as bad as in the rest of the region. But that is not saying much, and it is hardly a consolation. After an incident on a border lake in Ladakh in mid-September, TV news channels aired alarmist coverage titled ‘Enter the Dragon’.Another channel labelled Nepal the ‘Number Three Enemy’ of India after China and Pakistan. The main reason for the suspicion is the belief that Nepal’s Maoist government is getting too cosy with China.“Silently but speedily China is spreading its wings in the erstwhile Hindu kingdom, mainly to unleash anti-India propaganda,” wrote the Times of India last week.<img src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221108181144/636a959e9c7e80680e05dc19jpeg.jpg" alt="" width="500" height="781">Several factors have contributed to a new cold war across the Himalaya: the recent geopolitical alignment between India and the US, Beijing’s insecurity about Tibetan nationalism and competition between the two countries over water from Himalayan rivers.'

CENSURING CENSORSHIP

<figure><img width="1500" height="1000" src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221108141156/636a60599c7e80680e056e76jpeg.jpg" alt=""/><figcaption>Photo: RAMESH GIRI/RSS</figcaption></figure>Throughout the state visit to Nepal by <a href="https://www.nepalitimes.com/banner/president-xi-in-kathmandu/" target="_blank" rel="noopener">Chinese President Xi Jinping last weekend</a>, Marxism-Leninism-Maoism ideology was scarcely mentioned — even though both countries are governed by monolithic Communist parties.The irony could have been lost on supporters of the Nepal Workers Peasants Party (above) that has traditionally governed Bhaktapur, who carried portraits of Marx, Engels, Lenin, Stalin and Mao during a rally to mark the party’s convention just before Dasain.While Nepal’s politics still takes its inspiration from philosophers and leaders from the last century, the optics of the Xi visit was all geopolitical symbolism. Proposals about connectivity, the Belt and Road Initiative, trade and infrastructure — just about everything was mooted except the ideological underpinnings of the proposals.President Xi timed his state visit to Nepal after an informal summit with Indian PM Narendra Modi in southern India. His message was that India is too important a trading partner for China to jeopardise those ties over Nepal. Chinese leaders since Mao have advised Nepal’s past kings, prime ministers and party leaders not to antagonise New Delhi.The visit underscored China’s national interest to see a stable and independent Himalayan buffer state. For Prime Minister Oli, it was a photo-op to counter rising public disillusionment about his government’s non-performance. Oli is sensitive about this, and pointedly told critics at a NCP tea party Wednesday to “open their eyes” to accomplishments.With all the attention on tunnels, trains and toll roads, Xi’s admonishment in his banquet speech that Nepalis do not complete projects, and advising his comrades to not be greedy, seemed to get lost in translation.The most important message from President Xi’s visit for Nepalis, as <a href="https://www.nepalitimes.com/opinion/self-reliance-in-nepals-peace-corridor/" target="_blank" rel="noopener">Bhaskar Koirala reports from Beijing</a> , is whether China’s promise of help will help us stand on our own two feet. He was whisked away to the district government attorney's office at Babarmahal.Mahara <a href="https://www.nepalitimes.com/latest/mahara-arrested/">is accused of attempted rape</a> of a female colleague in Parliament, Roshani Shahi, on 29 September. When the news hit headlines, and the ruling Nepal Communist Party (NCP) reacted with uncharacteristic decisiveness, advising Mahara to resign. For watchdogs who have been criticising the government for impunity, including in war crimes and last year's highly publicised case of <a href="https://www.nepalitimes.com/opinion/justice-delayed-and-denied/">Nirmala Panta,</a> this came as a complete surprise.Was the government finally buckling under national and international pressure to clean up its track record on impunity? Was Mahara the last straw? This week it was the turn of MP Mohammad Aftab Alam from Rautahat, accused of burning a dozen people alive in a brick kiln after they were injured while making explosives to be used in the first Constituent Assembly elections in 2012. With unprecedented swiftness, police on Tuesday arrested another MP, Pramod Sah from Sarlahi, after he was accused of vandalising an airline counter and roughing up airline staff in Janakpur. There is also an arrest warrant out for Parbat Gurung, MP from Dolakha accused of attempted murder.Initially, Mahara's response fit the pattern of powerful men who know they can get away with any crime. His press adviser said he had never gone to Shahi's apartment, but after CCTV footage emerged of him arriving on the street outside, Mahara agreed to cooperate with the investigation. When his health reportedly worsened in custody, he was taken to an expensive private hospital.Mahara’s first resignation letter was conditional: he said he was stepping down only for the duration of the investigation, hoping to get right back to his speaker job. In fact, that is still a possibility since he has not resigned as member of parliament.“An MP is suspended if accused of grave crimes, so Mahara is not receiving any government facilities or salary at the moment,” explains Rojnath Pande, spokesperson of the Parliament secretariat. "However, he is not dismissed from his position. NCP Spokesperson Narayan Kaji Shrestha told Nepali Times: “His resignation automatically includes resigning from the party. We had advised him to resign as MP as well, but since he is suspended at the moment the point is moot. We cannot say anything now about his eventual return to politics.”Shrestha claims Mahara’s resignation was meant to aid the investigation and not necessarily because of his guilt, and that he is innocent until proven guilty. However, top NCP leaders have been briefed by police that there is enough evidence against Mahara to make the rape claim credible. The party is therefore in damage-control mode.Even a year ago, the NCP might have tried to hush up the case, especially because the evidence is murky. Shahi has changed her statement many times, calling police to say she was raped, withdrawing the complaint, then filing a first information report (FIR) for attempted rape, and again accusing the police of pressurising her. There are screenshots of Shahi’s SMS conversation with a mysterious ‘M Sir’, which hint at long-standing intimacy.Journalists have dug up Facebook posts showing Shahi has known Mahara for decades, and implying that he has been abusing her, and that she may even have carried his child once. However, the account has now been deactivated.Shahi has been subjected to the same kind of backlash that #metoo accusers have faced: a section of the public thinks she had a consensual relationship with Mahara and outed him when he ceased to serve her purposes. Use of force is rare but manipulation, including threats, bribes, shame and humiliation, are common. If Shahi faced threats and shame during a supposedly consensual relationship, it is difficult to see where the consent ends and abuse begins.Shahi herself has complicated her case by her on-off accusation, but more people in Nepal now seem aware that even if the relationship is consensual, violence or non-consensual intimacy makes it abusive. Many believe Shahi was intimidated into changing her statements. Yet for a government famous for impunity, the very fact that a powerful politician is being investigated is a step forward for gender justice.But there are also many losers. Mental health was made an easy scapegoat after Shahi blamed depression and medication for her inconsistent statements. The reputation of women leaders, including MPs, has taken a hit since most of them have remained conspicuously silent. Chitra Jung Shahi later posted a handwritten statement of separation on Facebook.While the case is tangled, it has certainly shaken Nepal’s powerful men, many of whom have, until now, behaved as if they are above the law. The pressure for justice in this case is increasing. On 3 October, 15 human rights organisations issued a joint statement, urging the government to treat Mahara as an ordinary citizen and investigate the case. The rise and fall of Comrade Mahara

After facing problems in his transplanted kidney, the PM has been under treatment in Singapore since 22 Aug. But even as the country's chief executive battles a serious health condition, official government and party channels have released very little information about the state of his health.On 26 August, Nepal Communist Party (NCP) co-chair Pushpa Kamal Dahal informed a meeting of the party's central secretariat about the state of the Prime Minister's health. According to Dahal, PM Oli would be undergoing a medical procedure called plasmapheresis seven times. Quoting Dahal, a top leader told Himal Media "If the results of plasmapheresis are good, the PM will stay in Singapore for another week. If the results are not so good, then further decisions will be taken based on doctors' suggestions."On 22 August, PM Oli had departed for the National University Hospital in Singapore with his wife Radhika Shakya, Chief Political Advisor Bishnu Rimal, Personal Physician Dr Divya Singh Shah and Personal Assistant Rajesh Bajracharya. He had confidently declared that he would be back to celebrate Constitution Day on 20 September, and lashed out his detractors, saying he would be in politics for 15 more years.After both of his kidneys failed, PM Oli had had one kidney transplanted in India’s Apollo Hospital in 2007. Kidneys have been known to work for 8-20 years after transplant, but antibodies can reject a transplanted kidney at any time, causing it to fail. After criticism on that front, the PM's physician Dr Shah issued a statement before his departure on 22 August, stating that the amount of antibodies had increased in the PM's body, and that he would be undergoing procedures to remove those antibodies and increase the capacity of his kidneys. The PM has had plasmapheresis procedure six times since, and is undergoing the seventh one on Wednesday, 3 September.As there is public concern over the Prime Minister’s health, his private secretariat and physician should be giving regular updates. However, the concerned offices have been keeping quiet, as if the chief executive's health is not of public concern. Neither political advisor Rimal nor Dr Shah have responded to queries on Viber. Physician Dr Dilip Sharma noted the PM flew to Singapore because there is no plasmapheresis  machine in Nepal.The PM stayed only nine days in hospital on his last trip to Singapore, though doctors had advised him to stay for a week or more. The haste cost him dearly, as his hectic lifestyle back home led to a steep decline in his health. Though the PM repeatedly assured everyone that his health was OK, preparations were being made for a second trip to Singapore, which fuelled further speculations.Despite growing questions, the PM said nothing about his health when he addressed Parliament  on 18 August. After participating in several high-profile meetings on the following days, including with Indian Minister for External Affairs S. Jaishankar, he flew to Singapore on 22 August. He had previously been hospitalised for pneumonia in 2017.The haphazard life that PM Oli has led throughout his political career explains his health issues. Beginning with jail time, he has led a life of struggle and uncertainty and lacked regularity in eating and sleeping habits. A hagiography is therefore an admiring book about people who are praised for being much better than they are in real life. Abiram Baburam (Non-stop Baburam) by journalist Anil Thapa fits the definition of a hagiography perfectly. It follows the tradition of heroic Panchayat-era portrayals of the Sri 5, praising them to high heaven.Thapa begins with this <a href="http://archive.nepalitimes.com/news.php?id=2690#.XTlxLfIzbIU" target="_blank" rel="noopener">brilliant PhD graduate</a> who chose the ‘hard’ life of politics while he led a Nepali students’ union in India. Baburam Bhattarai says he was inspired to enter politics after he saw Nepalis washing dishes in India, and wanted to start an armed class struggle back home for their salvation. When he returned to Nepal he adopted a mixture of Marxism and BP Koirala socialism as a means towards that end, joining various communist parties, even contesting elections, and ending up with the Maoists. Read Also: <a href="https://www.nepalitimes.com/?p=30527&amp;preview=true" target="_blank" rel="noopener">Need to remember</a>, Sewa BhattaraiAs chief ideologue he was the architect of the revolution with Pushpa Kamal Dahal and Mohan Baidya that was to rage for 10 years. He still does not think he has done anything wrong, and has nothing to repent. But Bhattarai does concede that he is ‘not a god’ and may have some weaknesses. It does not look like Thapa talked to any victims of Maoist violence or their families. It is also clear that neither he nor his relatives suffered from violence during the conflict. When Pushpa Kamal Dahal was elected prime minister, he was naturally not going to listen to the Adhikari couple, nor other victims of the conflict. The author recounts how Yami did not leave the Adhikaris alone even there.  Bhattarai could not have not known of the cruelty, and when he became prime minister in 2013 he had police arrest the couple from the gates of Baluwatar. On hunger strike, they were taken to Bir Hospital, where they <a href="https://www.nepalitimes.com/latest/gangamaya-breaks-fast/" target="_blank" rel="noopener">broke their fast upon government assurances</a> — promises that were repeatedly broken. War crimes went unpunished, and the culture of violence and impunity continues to plague Nepali society to this day.Thapa’s book does not address that side of the story, and is likelyto have little historical value. Dreams and nightmares of the Nepal conflict

<img width="1935" height="1756" src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221108131144/636a4fe19c7e80680e04fd2fjpeg.jpg" alt=""/>After a prolonged tug-o-war that polarised the ruling Nepal Communist Party (NCP) to the point where it looked like it was headed for a split, a three-way truce this week has defused the crisis for now.Prime Minister KP Oli is co-chair of the NCP with Pushpa Kamal Dahal, and relations between the two had soured over Dahal’s suspicion that Oli was not going to stick to their 2017 ‘gentlemen’s agreement’ in which they decided  to take turns being prime minister for 2½ years each. While Oli was in Delhi for Narendra Modi’s swearing-in last month, Dahal even leaked a memo that proved the pact was in writing.The third leader in the Communist Troika is former Prime Minister Madhav Kumar Nepal, who has also been critical of Oli’s desire to go it alone, both within the party and in government. He even sang a line from a popular Nepali folk song while Oli was in New York earlier this year, which likened the PM to playing the fiddle while the country burned. It appears that the combined strength of Dahal and Nepal convinced Oli that he had to compromise on appointments to the central committee, politburo and party department heads, as well as chiefs of fraternal organisations.The first indication of this was a breakthrough this week on dividing up the functions of the 441 members for district in-charge and party structure at the local level. Inability to do so had kept the party’s decision-making centralised in Kathmandu, thus undermining true devolution.What complicates matters is that many of the 441 central committee and 147 politburo members are also elected representatives in all three levels of government. Also, the 60:40 formula between former UML and former Maoist members would not reflect loyalties to the Troika. Still, it looks like good sense has prevailed, and Oli has assured former UML dissidents that he will do more listening henceforth. Oli’s detractors are also putting pressure on him to relinquish either the prime ministership or party chairmanship under the one-post-one-person rule that they have demanded.There are still some much-delayed formalities to conclude before the NCP can be considered truly united. The Troika

The daily 10-hour curfew at Tribhuvan International Airport from 8 November that will last five months has affected tourism during Nepal’s peak season, with some hotels and trekking agencies here reporting cancellations into spring next year. The reduced hours at Nepal’s main aviation gateway till 31 March means that a third of all flights have been cut. This has also caused ticket prices to surge by up to eight times of normal fares. For example a Kathmandu-Delhi ticket that used to cost Rs12,000 is now listed at Rs50,000, and even then seats are not available.&nbsp; “Especially if they are here to trek, change in flight dates can cause tourists to miss their connections,” says Jagan Timilsina, who runs a trail running and outdoor education business. &nbsp; Pokhara is feeling the brunt as hotels report last-minute cancellations for November because of flight disorders. Some hoteliers also say although there have been some cancelled trips, most itineraries have been rescheduled.&nbsp; Hari Prasad Sharma Gaire of the local chapter of the Hotel Association of Nepal says the Kathmandu airport closure should have been timed for the off-season. He told us: “Starting construction during the peak tourist season was a mistake and will cause the tourism industry to lose a lot of business. The upgrade could have been spread out over a longer time but closed for fewer hours at night so that disruption was minimal.”&nbsp; Nearly a third of the 1.2 million tourists who visit Nepal annually come to Pokhara, which is also the gateway to Mustang, the Annapurna treks and pilgrimage tourism to Muktinath. Located by scenic lakes with a range of adventure sports like hot air ballooning, paragliding, canyoning, bungee and ziplines, Pokhara is also popular among diaspora Nepalis. “Besides its own attractions, Pokhara is really the hub for central Nepal, and we have been trying to get visitors to extend their stay here,” says Timilsina, who started out as a trekking porter and rose up the ranks to be an expedition guide and entrepreneur. &nbsp;  <figure> <img src="https://publisher-publish.s3.eu-central-1.amazonaws.com/pb-nepalitimes/swp/asv65r/media/2024111603114_0e071ce63ea9b0a9a7ee76f8c3cea0ff08c6767c41dd09f6bc4413d2db067a60.jpg" data-media-id="editor_0" data-image-id="2024111603114_0e071ce63ea9b0a9a7ee76f8c3cea0ff08c6767c41dd09f6bc4413d2db067a60" data-rendition-name="original" width="3500" height="2333" loading="lazy" alt="Pokhara's tourism woes NT"> <figcaption>Tourist arrivals in Pokhara have slumped since the disruptions at Kathmandu airport due to upgrading work. Photo: KRISHNA MANI BARAL/NEPALI TIMES ARCHIVE</figcaption> </figure>  Even without the Kathmandu airport closure affecting tourist arrivals, Pokhara was already suffering from a decline due to many factors like the poor state of the Prithvi Highway, the shortage of luxury accommodation for high-end tourists, and the reluctance of international airlines to start direct flights to Pokhara despite an expensive new airport that was inaugurated two years ago.&nbsp; “There was a lot of initial excitement on the construction of the international airport,” says Timilsina, “but it hasn’t delivered as expected due to politics. People have invested in nearby businesses, and have faced losses.” India has blocked direct flights from its cities to Pokhara because the facility was built by a Chinese company. Although tourists and pilgrims from India hit record levels this year, the poor state of the highways and the Indian bus accident on the highway to Kathmandu in July that killed 27 pilgrims from Maharashtra state dampened arrival figures. Gaire says, “While tourist arrivals to Pokhara are now approaching pre-Covid levels, we haven’t seen the improvement we were expecting. We need a better marketing strategy. What are our embassies abroad doing?”&nbsp; Indeed, Pokhara used to be a favourite destination for Chinese tourists. There was a boom in arrivals from China before Covid, especially after a popular Chinese tv serial was shot on location here. But arrivals from China have not really recovered since the pandemic because of the economic slowdown there. Promoting Pokhara airport to handle direct flights from Chengdu or Kunming could revive Chinese arrivals.&nbsp; Nepal’s Civil Aviation Authority (CAAN) has used the Kathmandu airport closure as an excuse to arm-twist international airlines to start flying to Bhairawa, which has barely been in operation for two years since it was inaugurated. So far, Fly Dubai, Thai AirAsia, Jazeera and Qatar are flying to Bhairawa, but most use it as a hop before flying on to Kathmandu, which does not reduce congestion at Kathmandu.&nbsp; An ideal situation could have been to get Pokhara to run to full capacity while Kathmandu is partially out of action. Pokhara entrepreneurs are puzzled why the CAAN and the national government have not taken more interest in promoting Pokhara as an alternative to reduce the congestion in Kathmandu. Nepal’s football team that was flying to Dushanbe this week couldn’t get tickets via Delhi, and took a domestic flight to Bhadrapur, crossed over to Bagdogra and flew on to Delhi to catch their flight to Tajikistan.

Pokhara’s tourism woes

An excerpt of a conversation between an anthropologist and linguist Mark Turin, PhD and Lava Deo Awasthi, PhD, the first Chairperson of the Language Commission of Nepal. Nepali Times: What is the role of Nepal’s Language Commission and when was it formed? Lava Deo Awasthi: The Constitution of Nepal (2015) created a Language Commission (LC) with the following four core mandates: (a) to develop eligibility criteria for gaining status as an official language and offer recommendations to the Government of Nepal about the official language(s) in each province; (b) to offer recommendations to the Government about measures to be taken for the conservation, promotion, and development of languages; (c) to suggest possible ways of using mother tongues in education by assessing their stage of development; and, (d) to conduct studies, carry out research and perform monitoring functions about the response to the constitutional provisions for the federalisation of languages in Nepal. The Commission was founded in 2016 and I was appointed as the Chairperson of the Commission in September of the same year by the Cabinet of Ministers. What in your own professional and educational background helped to prepare you for the role? I have worked with the Government of Nepal for about 30 years, alongside holding teaching appointments at universities in Nepal. Prior to assuming the role of the Chairperson of the Commission, I served as permanent Secretary to the Government of Nepal and worked as the Chief Administrator of the Central Development Region. I was appointed as Director General of the Department of Education and completed my assignments as Joint Secretary at the Planning, Monitoring and Educational Administration Divisions of the Ministry of Education.&nbsp; In addition, I have taught courses as a visiting professor at Tribhuvan University and Kathmandu University for more than three decades. Later, I also started supervising MPhil and PhD students at the Far Western University in Mahendranagar, Kanchanpur. My PhD project from the Danish University of Education was dedicated to making sense of Nepal’s social construct and commitment to multilingualism, exploring the persistence of monolingual school practices in the face of constitutional promises and state commitments to multilingualism. I conducted a survey of Nepal’s languages and carried out a qualitative study of the Tharu language in the district of Bardia. I analysed language policy statements and explored classroom pedagogies in schools. I documented how teachers showed a tendency to resist change and maintain the status quo because they were not consulted when new educational language policies were introduced. Teachers also exhibited a deeply-held adherence to the Gurukul education system which appears to have been harnessed as a way to resist newer pedagogical ideologies imported from the West. Recognising how engrained these rich traditions of knowledge transmission are, I wanted to know how students’ engagement in the learning process appeared to have dwindled, creating a gap between children’s home languages and the language(s) of the school. Whilst statutory provisions for education in the mother tongue were oriented towards promotion, classroom pedagogies remained resolutely monolingual and exclusionary. The result was that multilingual education policies that had been introduced in Nepal did not result in meaningful changes in classroom practices. My research was also a reflection of childhood traumas I had experienced at the earliest stage of formal education. My home language, Baitadeli, has a strong oral tradition and no written literature. English is my fifth language in terms of exposure and competence, and my home district of Baitadi is well-known for its loyalty to the local language. I had to drop out of school after completing my sixth grade. Staying at home, I received much attention from my family and had much greater exposure to my native language, culture and environment. My overall impression is that dropping out of school had a surprisingly positive impact on my life. The opportunity offered a surprising dividend for me as I gained mastery in my mother tongue and received extensive exposure to folk literature and Indigenous knowledge and survival skills, cultivating my interest in language, culture, literature and local cosmologies.&nbsp; Now that I reflect on it, I appreciate how language has always played a key role in my life. I grew up in a multilingual environment: brought up with Baitadeli, Hindi, Sanskrit, Nepali and English. Language played a major part in my decision to leave school and my later success is closely linked to my competence in several languages. It was rewarding to be at home with my family as I deepened my understanding of native language and culture, which in turn helped me to harness and refine my art of living. Languages matter so much to me because they are both software and hardware. Later, when I was in secondary school, I realised that my command of my home language contributed significantly to enhancing my Nepali and English. I used my mother tongue as a form of linguistic capital to strengthen my competence in both English and Nepali.&nbsp;  <figure> <img src="https://publisher-publish.s3.eu-central-1.amazonaws.com/pb-nepalitimes/swp/asv65r/media/2024111811110_5400ba54792bf9e4854e1c1effde8bf09804e99647f23513700b450cc49adc4a.jpg" data-media-id="editor_0" data-image-id="2024111811110_5400ba54792bf9e4854e1c1effde8bf09804e99647f23513700b450cc49adc4a" data-rendition-name="original" width="1000" height="1500" loading="lazy" alt="Dr Lava Deo Awasthi"> </figure>  In your term as the Commission’s first Chairperson, what were your strategic goals and objectives? My first strategic goal was to create an environment conducive to implementing the provisions of the Constitution of Nepal in relation to language. My priority was to prepare a detailed action plan for my six-year tenure in consultation with language stakeholders, including language experts, professionals, activists, Indigenous community members and representatives of relevant national and local-level institutions. The Commission formed a body of high-level advisors to ensure that the Chairperson’s work was well-informed and credible. The advisors to the committee had highly visible professional and social reputations in Nepal and had much experience in the field of language conservation, promotion, research and development. Another strategy we adopted was to establish close institutional linkages with federal, provincial, and local level governments for collecting opinions and disseminating information widely.&nbsp; What critical issues did you have to consider while discharging your duty? When Nepal’s new Constitution was drafted, a number of concerns could not be adequately addressed. These related to the conservation of languages, the recognition of official languages at the provincial level, and the use of mother tongues at federal, provincial, and local levels. These unresolved issues and matters pertaining to the federalizsation of Nepal’s languages were passed on to the Language Commission to address and resolve.&nbsp; Regarding the recommendations for official languages, a five-year timeline had been set by the Constitution. With great effort, we succeeded in having all provinces agree to recognise their official languages as per the recommendations of the Commission.&nbsp; What were your greatest achievements during your term? One of the greatest achievements was that we succeeded in setting a language agenda at all levels. Nepal’s language communities and other stakeholders expressed the view that this was the first time their languages were recognised and their voices heard by the state. People participated in debates and discussed issues relating to language that in all likelihood had never before happened in their lifetimes, at least not in ways that were supported by the state. We encouraged people to speak in their own language(s) and provided translators during plenary sessions and group discussions. Another major achievement was developing criteria for the status planning of languages at federal, provincial, and local levels, and to recommend 11 province-level official languages, in addition to the Nepali language. Similarly, a notable achievement was recognising Indigenous languages spoken by smaller communities, all of whom faced ongoing marginalisation and high levels of endangerment. The Commission identified 9 new languages that had not been reported in the 2011 census, and provided a framework for recognising official languages within a municipality. The commission emphasised the need for documentation and digitisation of languages for developing corpora and archives at national and sub-national levels.&nbsp; Languages of historical importance as well as classical languages were given recognition for their protection, growth, and development. Recommendations were made for the conservation, promotion and development of Nepal’s marginalised languages that are threatened by majority languages and for those languages that hold particular power at local and global levels. Recommendations were also made for how best to safeguard Nepal’s languages from the ever-growing spread of English and other powerful, globalising languages.&nbsp; A further important aspect of the Commission’s work was to emphasise mother tongue medium instruction in schools across the nation. Recognising the role of language in children’s cognitive, socio-emotional and academic development, the Commission suggested strategies for linking schools with ward-level language clusters for use in the classroom. The importance of nurturing and respecting a child’s first language was reiterated in the Commission’s recommendations for children’s learning and all-round development. By the end of my term, a remarkable change could be observed in terms of building trust within and across Nepal’s diverse language communities. A network of language groups and stakeholders across the country proved to be a powerful way of bringing all language communities under one roof for a collective review of and response to the process of federalising language policy. The many language stakeholders across Nepal appreciated the opportunity to work within a coordinated framework, and—feeling empowered by this—seemed genuinely enthusiastic about the initiatives taken by the Commission.&nbsp;  <figure> <img src="https://publisher-publish.s3.eu-central-1.amazonaws.com/pb-nepalitimes/swp/asv65r/media/2024111811114_b45297fdd2fedf17bdb6313e495a1062c0d87f1a19fa5349f871f220b75f93ab.jpg" data-media-id="editor_1" data-image-id="2024111811114_b45297fdd2fedf17bdb6313e495a1062c0d87f1a19fa5349f871f220b75f93ab" data-rendition-name="original" width="1500" height="1000" loading="lazy" alt="Dr Lava Deo Awasthi NT"> </figure>  What were the most significant challenges for you as Chairperson? One of the major challenges was winning people’s trust in advocating for the mission of the Language Commission. I faced considerable resistance as I sought to emphasise the use of native languages in families and communities. While the Commission advocated for multilingualism and promoted linguistic diversity, the prevailing policy circles and central level institutions had been deeply influenced by a one-language discourse and ideology of Nepali only. The spread of English also poses a huge threat to Nepal’s languages. However, people in power do not seem to see this as a problem. They tend to abandon their own languages in preference for English. The way that Nepal’s municipalities are increasingly introducing English as a medium of instruction at the earliest stage of a child’s school-based education has proven to be detrimental to their cognitive development, socio-emotional wellbeing and academic success. Most of Nepal’s elites have been heavily influenced by the spread of English and remain unaware about its impact on their home languages as well as on the inter-generational transmission of Indigenous languages in the country. I wish that we could have produced more compelling evidence to show the consequences of making poor policy choices for our children’s education. Demystification calls for a collective response. To make change happen across this entire, complex and federalising country was daunting work and left like a race against time. I feel that I could have done more to offer concrete examples in favour of using the mother tongue as a medium of children’s education at the earliest stages of a child’s education. What do you see the Language Commission achieving in the next 5-10 years? The Language Commission will have to ensure that all of its key recommendations are implemented at all levels of government. In 10 years’ time, all seven of Nepal’s provinces will have their official languages in place. These languages will also be recognised as languages of federal business, alongside Nepali. I anticipate that all official languages in the federal and provincial systems will have a national portal for inter-language corpora using machine translation to fulfil their federal, provincial and local level language functions, and that all languages spoken in Nepal will be represented through a digital database in the national archive. The Office of Statistics will monitor the status of Nepal’s languages over time. By the end of the next decade, each municipality in the country will have recognised one or two official languages at the local level, based on speech populations. Other local languages will have received community-level legal recognition and official status to fulfil their functional roles. Languages that are highly endangered or at risk will be entitled to receive state grants for enhancing local level capabilities to encourage families and young learners to speak the language. Incentive schemes will be introduced in municipalities that promote language within the family and at home. Inter-generational transmission of languages will have received welcome and timely attention across Nepal. It is my hope that all schools—public and private—will have introduced mother tongue medium instruction at the earliest stage of school education, at least up to class five. Nepali, English and other national as well as classical and foreign languages will be taught as subjects. The existing policy of English medium education at the early stage of education will be abolished. The Government of Nepal will be held accountable if the number of speakers of any language decreases or if local communities face language loss and greater endangerment. Under the aegis of the Language Commission, a Centre for Language Research and Innovation will be created with world-class facilities for language documentation and archiving in collaboration with Tribhuvan University’s Central Department of Linguistics and other relevant institutions. Harnessing the vastness of Nepal’s linguistic diversity, the Language Commission will morph into a centre of excellence for national and international communities to engage in collaborative language research, to share experiences and document best practices at in service of global linguistic diversity and Nepal’s many Indigenous languages.

Languages are both software and hardware

Nearly 750,000 Nepalis went abroad for employment in the past year, and more than 100,000 left on student visas. Most of them were young Nepali men and women, and the number has been increasing every year. As with other sections of society, Nepal’s security agencies also face a recruitment crisis. Nepal Police opened recruitment for 64 inspectors in September, and received 2,239 applications, compared to 2,718 candidates last year. Police also invited candidates for 256 assistant sub-inspectors this year for which it received 17,756 applications – down from 19,932 last year. It is the same story in the Nepal Army, the number of applicants for the post of Officer Cadet (Second Lieutenant) went down from 6,144 for 400 open seats in 2019 to 4,390 in 2020. Meanwhile, applicants in the paramilitary Armed Police Force went down from 857 applications for 75 posts in 2021 to 536 applicants for 99 posts last year. While the number of applicants appears higher than the demand, the data shows a significant decrease in applications for vacancies in Nepal’s law enforcement agencies. Security personnel are recruited on the basis of rank and age in Nepal, and the age cutoff for entry into Nepal’s security agencies is typically 25 years. Sociologist and migration expert Ganesh Gurung says that the demographic of young, physically fit Nepalis emigrating abroad in search of better opportunities has impacted recruitment into law enforcement and the military here at home. “The returns from working in Nepal’s police and army are minimal, whereas overseas job opportunities are more attractive,” Gurung says. “The work may be physically demanding abroad, but the pay is a lot higher.”  <figure><img src="https://publisher-publish.s3.eu-central-1.amazonaws.com/pb-nepalitimes/swp/asv65r/media/20241116041148_a7e477e0ee2f56acf16c2559fdb24d8f0377f7bc1f9e56138bc40108fc4fa33f.jpg" data-media-id="editor_0" data-image-id="20241116041148_a7e477e0ee2f56acf16c2559fdb24d8f0377f7bc1f9e56138bc40108fc4fa33f" data-rendition-name="original" width="800" height="534" loading="lazy" alt="Nepal Police"><figcaption>Nepal Police</figcaption></figure>  Nepal Police spokesperson DIG Dan Bahadur Karki agrees that the physical and mental demands of a law enforcement job is incomparable to the income that security personnel earn. “A young Nepali who works in Dubai earns enough to build a home in the village within four years, while a Nepali with the same qualifications and physical ability in a security agency here barely makes enough to survive,” says Karki. “Obviously the youth prefer foreign employment.” Security agencies are now worried about the quality of inducted manpower. “There is a difference in work ethic between an applicant chosen from a competitive pool of 50 candidates versus one chosen from a pool of three candidates,” explains Gurung. “Unmotivated employees hamper the overall performance of the state apparatus.” Nepal Army spokesperson Brigadier General Gaurab Kumar KC says recruitment has not been hampered by outmigration: “We have still been getting more than three times the applicants than there are open posts, so we are not yet worried.” Even so, the passing rates of aspirants have gone down for security forces after the Public Service Commission began examinations for military recruitment in 2015. In fact, the Nepal Army complained about the Commission’s involvement in recruitment. Still, the number of vacant military posts tends to exceed the number of passing candidates. Nepal Army’s KC says that the military will not compromise on intake criteria even if there are fewer passing applicants. “Unqualified persons will not be admitted even if there are less-than-required passing candidates. We will re-advertise if that is the case.” But Nepal’s security forces now also have to worry about retention of existing personnel. About 900 Nepal Army, 600 Nepal Police, and 300 Armed police personnel resign every year before the completion of their tenure.  <figure><img src="https://publisher-publish.s3.eu-central-1.amazonaws.com/pb-nepalitimes/swp/asv65r/media/20241116041148_b8cd62f70eea3aac7d3d3778615a5b70b1e20550c9bd76321f051f9c766fd2a9.jpg" data-media-id="editor_1" data-image-id="20241116041148_b8cd62f70eea3aac7d3d3778615a5b70b1e20550c9bd76321f051f9c766fd2a9" data-rendition-name="original" width="750" height="378" loading="lazy" alt="Armed police forces"><figcaption>Armed Police Force</figcaption></figure>  In 2020, Home Minister Ram Bahadur Thapa recalled almost 1,000 police personnel who had been deployed for the security of VIPs after long-standing criticism that security forces were being misused to cater to political and bureaucratic leadership. However, security personnel have continued to be assigned to high-ranking officials as glorified housekeepers. In December 2022, Rabi Lamichhane’s Home Ministry had instructed its offices to recall unauthorised security personnel assigned to high-ranking officials, following which 500 officers from Nepal Police and Armed Police Force were withdrawn from their details. But the Nepal Army does not have to follow such rules, and the practice of army personnel serving high-ranking active-duty and retired military personnel remains. Conditions here are dire enough that many active duty officers in Nepal’s military and police forces have chosen to leave their jobs to serve in the Russian Army to fight in the Ukraine war. The hierarchical culture and chain of command of politics, bureaucracy, law enforcement and military has also meant that abuse and mistreatment of subordinates is rife in Nepal’s security forces. “Feudalism is alive and well within our security institutions,” says Gurung. “When soldiers and security forces who swore to protect and serve the nation are made to be at the beck and call of politicians and bureaucrats, it is easy to understand why they are disillusioned with their jobs and why they choose to quit and find jobs abroad.”

Job insecurity in security forces

Earlier this month, Nepal received Rs1.6 billion from the World Bank as part of its <a href="https://nepalitimes.com/news/will-nepal-ever-be-paid-for-saving-trees">Forest Carbon Partnership Facility (FCPF)</a>, rewarding the country for increasing its carbon sink capacity. Nepal is the first in South Asia to benefit from this facility, and it is specifically to recompense the country for increasing forest cover in 13 Tarai districts between 2018-2024. “We are also trying to get another Rs13 billion from the facility while also preparing for free market-based carbon trading in the international market,” says Nabaraj Pudasaini of the REDD (Reducing Emissions from Deforestation and Forest Degradation in Developing Countries) Implementation Centre. Big emitters of greenhouse gases are under pressure to reduce their carbon emissions, and many have signed agreements to do so by investing in decarbonisation projects in developing countries. Countries that emit more than a specified amount of carbon would be able to buy emission rights from countries that emit less. Nepal is internationally known for its community forestry program which has been largely credited for <a href="https://nepalitimes.com/banner/tree-mendous">increasing tree cover to over 45%</a> in less than three decades. But this achievement had not been adequately recognised or rewarded internationally before. Forests, especially in the tropics, absorb and store large amounts of carbon while releasing oxygen in a process known as photosynthesis. <a href="https://www.fao.org/forest-resources-assessment/en/">Preventing deforestation</a> and increasing canopy cover is considered a much more achievable goal than reducing emission in the scale necessary to limit global average temperature to 1.5°C above pre-industrial levels. COP11 in Montreal in 2005 first proposed reducing carbon emissions by improving forest quality by halting degradation. By 2015, a new mechanism of financial assistance was created to help less developed countries with sustainable management of forests <a href="https://www.un-redd.org/">(called REDD+)</a>. Under this new mechanism, countries receive aid based on their efforts to prevent forest degradation and increase carbon sink, and in 2021 the World Bank was entrusted with implementing it. Nepal’s FCPF receipt this month was calculated on the basis of 2.4 million tons of carbon stored at a rate of $5 per ton. In the second phase, Nepal will receive more than Rs4 billion within the next year for storing an additional 7 million tons of carbon. Eighty per cent of this amount obtained from carbon trading needs to be spent on local beneficiaries and indigenous communities.&nbsp; But carbon trading is not easy, Nepal needs to prove that protected forests will not be destroyed in future.  <figure> <img src="https://publisher-publish.s3.eu-central-1.amazonaws.com/pb-nepalitimes/swp/asv65r/media/20241121091132_c8a381c9a95aa86fec558951650d97bb87914741f01766982ba2b086af001f16.jpg" data-media-id="editor_4" data-image-id="20241121091132_c8a381c9a95aa86fec558951650d97bb87914741f01766982ba2b086af001f16" data-rendition-name="original" width="1500" height="999" loading="lazy" alt="Greenbacks for greenery NT "> <figcaption>Photo: KUNDA DIXIT</figcaption> </figure>  Explains carbon trading expert Yugan Manandhar. “Forests should be handed over to the community and shown that they are managed sustainably. Proving this will be particularly challenging; forest encroachment and degradation is rife in the Tarai.” <a href="https://nepalitimes.com/multimedia/nepal-is-going-up-in-smoke">Deliberate forest fires</a> have also added to the challenge because they increase carbon emissions and reduce the sink capacity of forests. The basis for the amount that Nepal received was set five years ago by calculating the carbon reserves of forests in the 13 Tarai districts. In the meantime, sustainable forest management, tree plantation, forest destruction and erosion control were prioritised to increase carbon reserves in those forests. Nepal is signing another carbon trading agreement during the ongoing Baku climate conference. The <a href="https://www.leafcoalition.org/">Lowering Emissions by Accelerating Forest finance (LEAF Coalition) </a>proposes to sell the carbon stored in the forests of Bagmati, Gandaki and Lumbini provinces. For this, Nepal signed the letter of intent three years ago at COP26 in Glasgow. The target is to store 70 million tons of carbon in 32 million hectares of forest in the three provinces per which Nepal will receive Rs13 billion in four years at $10 per ton with provisions to increase the rate if various conditions are met. However, the agreement in itself doesn’t guarantee the amount. According to the targets set by Nepal, forest degradation should be stopped and carbon reserves increased by protecting tree cover. Preparations are also underway for clean air carbon trade because it has offset fossil fuel use by introducing 30,000 electric vehicles. Nepal has been selected for the first round to receive $40 million within one and a half years through the Clean Air System of the World Bank. Given that most of Nepal’s energy mix is from biomass, replacing them with electric stoves can significantly improve health by reducing indoor pollution as well as strengthen the country’s capacity for carbon trade. “Nepal's goal now is to sell carbon in the free market where carbon credits are bought and sold based on supply and demand in an open and transparent manner,” adds Pudasaini of the REDD Implementation Centre. “Nepal can now set its own price and bargain with interested buyer countries and organisations.” Lately, India has been discussing setting up a carbon market. Nepal has exported Rs12.72 billion worth of electricity to India so far this fiscal year, which can be traded under Nepal’s carbon market. “Carbon trading can create significant economic benefits for Nepal, which will help reinvest in development and environmental protection projects,” says Manandhar. “But we must prioritise sustainable management of forests, cutting older trees and allowing regrowth as well as promoting electric stoves and electric vehicles.”
