<img width="1584" height="1108" src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221108101148/636a26569c7e80680e043a0djpeg.jpg" alt=""/>At <a href="https://www.international-alert.org/" target="_blank" rel="noopener">International Alert</a>, as a global peacebuilding organisation, we often point to Nepal alongside <a href="https://www.google.com/url?q=http://archive.nepalitimes.com/article/Nepali-Times-Buzz/%2520identical-political-trajectories-in-Nepal-and-South-Africa,4057&amp;sa=U&amp;ved=0ahUKEwj1r8WljLjgAhVBP48KHQScCPYQFggFMAA&amp;client=internal-uds-cse&amp;cx=011870630917993763279:opm7uqsat-4&amp;usg=AOvVaw2RTo4ewDKjXsEgz2vOJ76F" target="_blank" rel="noopener">South Africa</a> or Northern Ireland as a country working through a peace process successfully, proving that peace can be writ large.  Of course, all three countries are still beset by troubles and the peace is far from perfect. In Northern Ireland, for example, today <a href="http://archive.nepalitimes.com/blogs/thebrief/2016/06/24/implications-of-brexit-for-nepal/" target="_blank" rel="noopener">Brexit</a> threatens the peace agreement, while in South Africa entrenched economic apartheid persists. But the guns have fallen silent, and stayed silent. Given that globally, half of all peace deals fall apart within 5 years, that is quite an achievement.Recently, International Alert and our partner <a href="http://fwld.org/" target="_blank" rel="noopener">Forum for Women, Law and Development</a> (FWLD) held a meeting in Nepalganj for victims to meet with the local service providers – local government, district administration, the hospitals, businesses and social services. The aim was to get practical help at the local level, while still pushing for a national solution.And <a href="https://www.nepalitimes.com/here-now/the-struggle-for-transitional-justice/" target="_blank" rel="noopener">the scars of war</a>, still unresolved, were still fresh: One man told us how on 8 July 2001, the Maoists cut off his leg, suspecting him of being an informer. Six times he has approached the government offices seeking medical support, but no-one listened to him. <img width="1949" height="777" src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221108101148/636a265a9c7e80680e043a0ejpeg.jpg" alt="">The man sitting next to him told us that his leg was cut off the very next day on 9 July 2001: “My house was destroyed and I was tortured by the Maoists. I get interim relief but not adequate compensation. I registered my case with the <a href="https://www.nepalitimes.com/banner/12-years-later-justice-is-a-mirage/" target="_blank" rel="noopener">Truth and Reconciliation Commission</a> and so want to know what is going to happen next.” He wears an artificial leg, but has to treat himself.  Read also: <a href="https://www.nepalitimes.com/banner/12-years-later-justice-is-a-mirage/" target="_blank" rel="noopener">12 years later, justice is a mirage</a>, Sewa Bhattarai<a style="background-color: #ffffff; font-size: 15px; letter-spacing: 0.01em;" href="https://www.nepalitimes.com/opinion/justice-in-transition/" target="_blank" rel="noopener">Justice in transition</a>, David SeddonCalmly, patiently, a woman spoke up for all those waiting for men who have disappeared, calling simply for the truth, another for a lost son, another for a missing father. A woman said she was blindfolded and raped by security forces in the barracks. Severely traumatised and suffering from serious uterus problems to this day, she needs medical support and psychosocial counselling. But like too many others, she is left without support and justice.These victims and their families are struggling to be heard by the Truth and Reconciliation Commission, and the Commission of Investigation on Enforced Disappeared Persons (CIEDP), the two bodies in charge of pushing forward transitional justice in Nepal. Both have so far failed to deliver, despite having registered 63,000 complaints. This week, the four-year tenure of both <a href="https://www.nepalitimes.com/opinion/justice-in-transition/" target="_blank" rel="noopener">transitional justice commissions</a> were extended, and new Commissioners will be appointed.The <a href="https://www.nepalitimes.com/here-now/no-country-for-women/" target="_blank" rel="noopener">victims of sexual assault, rape</a> and torture, for example, have not received any support – no recognition that they are victims, no interim relief, no compensation. That is deeply demoralising for the victims and International Alert has been calling on the Nepal government to support a gender responsive <a href="https://www.nepalitimes.com/here-now/just-not-justice/" target="_blank" rel="noopener">transitional justice process</a>.  Read also: <a href="https://www.nepalitimes.com/here-now/no-country-for-women/" target="_blank" rel="noopener">No country for women</a>, Shreejana Shrestha <img width="1280" height="720" src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221108101148/636a265d9c7e80680e043a0fjpeg.jpg" alt="">These initiatives desperately need substantial funds with matching political will to ensure progress. The wounds of war cannot be left to fester and must be proactively addressed. If the Nepal government seems <a href="https://archive.nepalitimes.com/article/editorial/state-of-impunity,2976" target="_blank" rel="noopener">lacklustre to prioritise</a> these issues, the victims’ groups are full of gritty determination. People are more than ready to mobilise to find the truth, support victims to receive compensation and find new work or to mourn their loved, lost ones. To be more effective, the civil societies and victim groups must come under one common platform to take the <a href="http://archive.nepalitimes.com/article/editorial/justice-delayed-justice-denied-transitional-justice,3556" target="_blank" rel="noopener">transitional justice advocacy</a> ahead.Read also: <a href="https://www.nepalitimes.com/here-now/just-not-justice/" target="_blank" rel="noopener">Just not justice</a>, Om Astha Rai<a style="background-color: #ffffff; font-size: 15px; letter-spacing: 0.01em;" href="https://www.nepalitimes.com/editorial/rocky-transition-to-justice/" target="_blank" rel="noopener">Rocky transition to justice</a>, EditorialNepal still has an opportunity to move forward the transitional justice process constructively in the coming months and to address truth, justice and reparation for victims. But this work needs the Government of Nepal to step up, and it needs donors to commit. If we want peace to last (and who does not?) then it needs long term, patient investment.Which is why the long time frame of the US Global Fragility and Violence Reduction Act is so vital. The bi-partisan Act was passed overwhelmingly through the House of Representatives on 28 November. If it passes the Senate, it commits the US Government to invest in 10 countries (five  already at war, five fragile) over 10 years, with coordination across all government departments from USAID to the military.Too often, governments lose interest in countries once the crises are past. NGOs are left with one or two-year projects sputtering to an end and no donors in sight to continue investing in building everyday peace. Every $1 spent on peacebuilding saves $16 in the costs of war, according to the Institute for Economics and Peace. A 2018 global poll undertaken by International Alert with the British Council found the public strongly favour ‘dealing with the reasons why people fight in the first place’ and ‘supporting societies to deal with conflict peacefully’, as effective means of creating long-term peace.So in 2019, the community of peacebuilding organisations will be pushing for the US Act to be passed into law, for other governments to adopt the approach, and for concrete progress for victims in Nepal as another building block of lasting peace.Harriet Lamb, CEO of International Alert and Rabina Shrestha, Manager of International Alert Nepal

Nepal’s transition to peace needs justice

One feature of the CPA was its explicit recognition of the need for a comprehensive ‘peace process’ that included the establishment of specific institutions dedicated to uncovering the truth about war crimes and human rights abuses during the conflict, to discovering what happened to those who had ‘disappeared’, and to bringing those responsible to justice.There were already at that time well-known and well-documented examples of atrocities committed during the conflict by the Royal Nepal Army and Nepal Police, the Armed Police Force (APF), the Maoist PLA and the Communist Party of Nepal (Maoist). It was anticipated that other crimes would be discovered and pursued, and instances of disappearance, ill-treatment, torture and extra-judicial killings would be revealed and dealt with, sensitively but with due process.Read also:<a style="background-color: #ffffff; font-size: 15px; letter-spacing: 0.01em;" href="https://www.nepalitimes.com/editorial/rocky-transition-to-justice/" target="_blank" rel="noopener">Rocky transition to justice</a>, Editorial<a style="background-color: #ffffff; font-size: 15px; letter-spacing: 0.01em;" href="https://www.nepalitimes.com/here-now/just-not-justice/" target="_blank" rel="noopener">Just not justice</a>, Om Astha Rai<a style="background-color: #ffffff; font-size: 15px; letter-spacing: 0.01em;" href="https://archive.nepalitimes.com/article/nation/truth-about-truth-commission,3565" target="_blank" rel="noopener">Two Commissions</a> were to be established, but it took two years for them even to be formally constituted. Supposedly ‘independent’ they were in fact ‘multi-party’ bodies (not the same thing) and were wracked by party, political and personal divisions. They have proved to be almost totally ineffective as vehicles for establishing ‘the truth’, promoting ‘reconciliation’, or bringing the perpetrators of war crimes and human rights abuses to justice.The victims of conflict have been poorly served by these Commissions, and it is not surprising that there is pressure to dismantle and not to extend their terms of office. But the proposal to establish a new ‘independent’ entity raises further questions.‘Independent’ cannot again mean a cross-party entity because it would then include members whose independence cannot be taken for granted. To be truly independent it should have a membership entirely unrelated to the political parties: respected figures from the academic community and/or the judiciary perhaps, and certainly representatives of the victims.Of course, those who fear that ‘<a href="https://www.nepalitimes.com/editorial/rocky-transition-to-justice/" target="_blank" rel="noopener">transitional justice</a>’ would lay them open to shame and dishonour, and more crucially to judicial proceedings not only in Nepal but also in other jurisdictions (given that war crimes can be tried outside the country in which they were committed) have been and remain fearful of the work any effective independent commission might do. They and those who protect them have done everything possible so far to block effective progress on all fronts. They have been successful.The officers and men of the Nepal Army and Police, on the one hand, and the Maoist leadership and cadres of the PLA and the Party, on the other, have the most to fear from a serious enquiry into each of the many thousands of alleged incidents and instances of human rights abuses and war crimes. It is they, and those who speak for them and protect them, who bear the greatest responsibility for the blockage of the peace process, the perpetuation of the suffering experienced by the victims and their families, and the injustice done to them. And for the fact that the country still bleeds from this running wound.Successive governments have failed to provide necessary support to the two Commissions to enable them to act effectively as legitimate independent bodies, immune from the pressure of vested interests and particularly of those individuals who were liable to investigation and prosecution. Indeed, they have been responsible for initiatives to undermine due process within Nepal and abroad.No effort was spared, for example, by the government of Nepal, first to prevent and then to subvert the trial in London of Colonel Lama who was accused by two Nepalis of torture,  when the British police and Crown Prosecution Service (CPS) had charged him with war crimes. Eventually, that trial was brought to an inconclusive halt when the CPS withdrew its proceedings against Colonel Lama.Also, the so-called ‘international community’, while calling for the completion of the peace process started by the CPA in November 2006 and taken forward over the next two years –and even supervising aspects of it (like integration via UNMIN) -- has tended all too often to regard transitional justice as a barrier to the peace process rather than a necessary part of it. The political parties appear to wish to model the new proposed entity on the integration process, but UN involvement has been ruled out on the advice of one foreign delegation in December 2017.More recent secret initiatives by the Swiss and German representatives in particular (and possibly others as well) which seem to propose resolving the issue by effectively sweeping the whole thing under the carpet certainly run counter to the thrust of the CPA and to the rights of the victims and their families to be heard, to be heeded and to secure justice. Pic: Om Astha Rai</figcaption></figure>Basanta Mahatara was just 22 and pregnant with her second child when her husband, a policeman, was executed by the Maoists after being captured during a raid in Pyuthan in 1999.After that, police began hunting down Maoists in reprisal attacks among Pyuthan’s mountains. Nirmala Thapa’s husband was a Maoist, and was dragged out of his house and later shot in 2002. Like Mahatara, Thapa was also pregnant with her second child when her husband was killed. <img width="640" height="605" src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221107171136/636934459c7e80680e03dfe7jpeg.jpg" alt="">The two war widows, both from Dharmawati village of Pyuthan, struggled to raise their children. They met after the signing of <a href="http://archive.nepalitimes.com/news.php?id=12806#.W_aXRjgzbIU" target="_blank" rel="noopener">the Comprehensive Peace Accord</a> in November 2006, and were united for a cause: truth and justice. They say their husbands were both summarily killed in detention, and not during battles.Mahatara and Thapa were among 200 conflict victims who came to Kathmandu this week on the 12th anniversary of the peace accord seeking truth, justice, reparations, and a guarantee of non-recurrence. They have issued a charter, pressing the government to reboot the lingering transitional justice process. Bhagi Ram Chaudhary of Conflict Victims’ Common Platform says: “We want the government to give the process a fresh start, involving us and respecting international norms.” Transitional justice has been the most neglected component of the peace process. After the peace accord of 2006, political leaders were preoccupied with <a href="http://archive.nepalitimes.com/news.php?id=12499#.W_aXqTgzbIU" target="_blank" rel="noopener">demobilising and disarming the guerrillas</a>, reintegrating them into the Nepal Army, and <a href="http://archive.nepalitimes.com/blogs/thebrief/2015/09/20/peoples-constitution/" target="_blank" rel="noopener">writing the new Constitution</a>. They <a href="http://archive.nepalitimes.com/article/editorial/justice-delayed-justice-denied-transitional-justice,3556" target="_blank" rel="noopener">delayed investigating war crimes</a>, waiting for victims to tire out and give up. It took the government a decade to even form the Truth and Reconciliation Commission (TRC) and Commission on Investigation of Enforced Disappeared Persons (CIEDP). Conflict victims questioned the legitimacy and intention of these bodies from the beginning, arguing that a mechanism led by political appointees would serve the perpetrators, and not victims. Chaudhary told us: “As we predicted, the TRC and the CIEDP have failed. We now need to dismantle them, and form a new mechanism that involves conflict victims and civil society.”He adds: “So far, we have looked at transitional justice just as a technical issue. It should be dealt with as a political problem. We need to forge a political consensus to resolve it.” Civil society leaders, human rights activists and conflict victims began discussing the need for a new mechanism, also owned by political leaders allegedly involved in war-time atrocities, after <a href="https://www.nepalitimes.com/here-now/just-not-justice/" target="_blank" rel="noopener">the controversial draft of the new TRC law</a> was out. The draft bill, if passed, will allow perpetrators to wash their hands of blood by doing time in open jails or community service.Conflict victims say it is not just the content of the TRC bill that is problematic but also the process of drafting it. Peace on a war footing

Photo: OM ASTHA RAI</figcaption></figure>A few months ago a group of <a href="http://archive.nepalitimes.com/article/editorial/state-of-impunity,2976" target="_blank" rel="noopener">transitional justice</a> experts from Colombia came to Kathmandu, sharing their country’s experience in post-conflict reconciliation with Nepal’s government attorneys and human rights lawyers. Colombia’s ability to resolve its long-running FARC insurgency, and how it has grappled with transitional justice, has lessons for Nepal even though our conflict ended long before Colombia’s.  Soon after the visit, the government proposed <a href="https://www.nepalitimes.com/here-now/just-not-justice/" target="_blank" rel="noopener">amendments to the Transitional Justice Act</a>, which was previously condemned by conflict victims and the international community for not adhering to accepted human rights values, of which Nepal is signatory. It had provisions for blanket pardon of war crimes, but families of conflict victims have doubts that, even with the new changes, they will ever get justice.  The draft amendment is heavily influenced by Colombia's 'restorative justice' practice, which focuses on reconciliation and reparation rather than punitive measures. Even so, the amendments are much better than the existing law (The Enforced Disappearances Enquiry, <a href="http://archive.nepalitimes.com/article/nation/truth-about-truth-commission,3565" target="_blank" rel="noopener">Truth and Reconciliation Commission</a> Act 2014), which is full of loopholes allowing former guerrilla commanders and state security personnel to go scot-free. Read also: <a href="https://www.nepalitimes.com/here-now/just-not-justice/" target="_blank" rel="noopener">Just not justice</a>, Om Astha RaiThe proposed law is an improvement because it is broadly in tune with a 2015 Supreme Court verdict on a case filed by <a href="http://archive.nepalitimes.com/article/nation/Commissions-of-convenience,1530" target="_blank" rel="noopener">Suman Adhikari</a>, whose father was dragged from a class he was teaching and <a href="http://archive.nepalitimes.com/news.php?id=16781#.WzHctVUza70" target="_blank" rel="noopener">executed by the Maoists in Lamjung in 2002</a>. The Apex Court had denied amnesty for perpetrators of four types of crimes: extra-judicial killings, enforced disappearances, rapes and torture.This means Maoist cadres who tied Adhikari to a tree and shot him in the head can be taken to the court. The army officers who detained, raped and killed 14-year-old Maina Sunar in Kavre will also have to face prosecution. Ex-rebels or security personnel charged with similar atrocities cannot be pardoned. However, just like the existing Act, the draft amendment is so loophole-laden that it can be abused by powerful politicians to get themselves off the hook. For example, if passed by Parliament into law, it will allow transitional justice bodies to reduce the severity of sentencing if perpetrators help with the investigation, or apologise and express a commitment to not repeat their crimes. Read also: <a href="https://www.nepalitimes.com/banner/when-our-son-was-killed/" target="_blank" rel="noopener">When our son was killed</a>To put it more precisely, if ex-rebels are convicted of abducting and murdering a civilian and slapped with a 10-year jail term, they will have to spend only four years in jail. And the draft amendment also has provisions for 'open jail' or 'community service'. War criminals could easily walk free even if found guilty, and there isn’t much clarity on what constitutes 'community service'. Will joining a political party and contesting polls be defined as 'community service'? The Act leaves a lot of elbow room. That is exactly why conflict victims are reluctant to accept the draft amendment: they suspect that culpable politicians will cunningly manipulate the law and get themselves off the hook. They are seeking some foundational laws based on which justice can be delivered. For example, they want to know beforehand whether all will get 75% discounts in sentencing, or if there will be criteria determining who deserves reduced punishment. They are lonely and helpless. Some do not expect the government to do anything, so they have given up even demanding justice. The <a href="https://www.nepalitimes.com/banner/yesterdays-enemies-todays-comrades/" target="_blank" rel="noopener">former enemies are now the state</a>, and they do not want to revisit wartime atrocities. The main opposition NC is led by someone who let the army detain and murder innocent people by imposing a state of emergency in 2002.  They feel neglected, and passing the new TRC law without addressing their concerns will be a blunder.Conflict victims had always pinned their hopes on the UML, which was not directly involved in the war and played a strong role in advocating for transitional justice after the 2006 ceasefire. But <a href="https://www.nepalitimes.com/banner/doors-closed/" target="_blank" rel="noopener">the UML no longer exists, and the Maoists have subsumed themselves and their conflict-era atrocities into the merged Nepal Communist Party</a>. Prime Minister K P Oli, who also co-chairs the new party along with ex-Maoist supremo Pushpa Kamal Dahal, has already gone back on his justice commitment for conflict victims. He recently endorsed the <a href="https://www.nepalitimes.com/editorial/united-we-stand/" target="_blank" rel="noopener">presidential pardon to Balkrishna Dhungel</a>, a convicted murderer. Oli has not been pressing Dahal to arrest one of the accused in the <a href="http://archive.nepalitimes.com/article/nation/dead-and-dying,3955" target="_blank" rel="noopener">murder of Krishna Ahdikari, whose mother Gangamaya is in frail health on her hunger strike</a>. Replicating Colombia's restorative justice formula in good faith could work in Nepal if conflict victims were backed by leaders with political will, and a strong civil society. Dispensing advice from this pulpit is a pretty futile exercise. In the end, it looks like whatever anyone says, the political parties will always be obsessed with their game of musical chairs.There is apprehension that Nepal's regime change also represents an ideological shift, and there will be a temptation to flirt with utopian undertakings and showcase populism. No matter who comes to power, out of enlightened self-interest if nothing else, please keep your dirty politics out of the economy.Actually, the country's economy is in such a precarious state because of past abuse. In the office of the Defence Attache, he put a neat envelope on the table. The contents made the officer nearly jump off his chair.I was that nervous young man, and I had done what seemed to be the most normal thing a citizen of Nepal could do. I was serving as a Major in the Indian Army, and had decided to resign my commission because I felt it was principally wrong to<a href="http://archive.nepalitimes.com/article/editorial/Nepalis-waited-200-years-for-country-to-be-proud-of,2939"> serve in a foreign military</a>. In a letter to the President of India, I wrote: ‘My conscience does not allow me to serve in the Indian Army anymore. Hence, I would request you to release me from the service.’The Defence Attache was furious: “I don’t know what you are up to, but let me tell you: if you do not take this back, the moment you are out of my office the system will get after you. There will be severe consequences. It’s not a threat. It is a concern and a personal advice.”Eight months of legal limbo, two years of isolation within the military, months of illegal military custody, and a Court Martial led to my conviction on the charge of ‘desertion’ and dismissal from service. I returned to Nepal in 2016.A week before the deadline for the promulgation of the Constitution in September 2015, Indian Foreign Secretary S Jaishankar flew to Kathmandu as a special messenger of Prime Minister Narendra Modi. India wanted to delay the promulgation of the constitution to accommodate Madhesi demands.Sushil Koirala of the Nepali Congress, Pushpa Kamal Dahal of the Maoists and K P Oli of the UML, used each other as scapegoats. When he got a sense that Nepal was not listening, Jaishankar warned: “Modiji is not Manmohan Singh. Strict measures will be taken. There will be consequences.”The rest is now history, and a black page in the relationship between the two countries. The <a href="https://www.nepalitimes.com/opinion/aftershocks-of-the-blockade/">Blockade</a> that immediately followed the 2015 earthquake<a href="http://archive.nepalitimes.com/blogs/kundadixit/2015/05/27/a-month-that-felt-like-a-year/"> was a foreign</a> policy blunder at par with, if not worse than, the LTTE war in Sri Lanka in 1988-89.From the time when the <a href="http://archive.nepalitimes.com/article/Nepali-Times-Buzz/the-rana-reign-a-recap-of-history,3751">Ranas</a> leaned on British India with a clear ‘strategy for survival’, right to the present day, Nepal’s relations with the south has seen many transformations. Nepal’s dependence on India has helped preserve a colonial strategic and security mindset in the Indian establishment long after the British left.This security framework in New Delhi treats Nepal as a country that has to be saved from Chinese influence. Therefore the concept of <a href="http://archive.nepalitimes.com/article/editorial/Equidistance-or-asymmetry-nepal-geopolitics,3850">equidistant foreign policy</a>, which has been the elusive goal of many Nepali strategists, is not taken very seriously in New Delhi. Every time Nepal wants to move towards equidistance, India has warned of the consequences.When Prime Minister K P Oli lands in New Delhi on Friday, he will be received as one of the most powerful leaders in Nepal’s history. Oli has support of nearly three-fourths of parliament, a majority rarely enjoyed by any other leader in recent times.Despite this, it will be virtually impossible for Oli to ask the difficult questions. The visit will be limited to tokenism, where the Modi government’s focus will be on reducing the political damage of the Blockade and the consequences to his party in next year’s elections. And Oli too, will be happy to play along.One of the main agendas of the Maoists, laid out in their 40-point demand to the royal government in 1996 before launching the armed struggle, was scrapping the 1950 treaty and the issue of <a href="http://archive.nepalitimes.com/article/nation/More-warlike,1023">Gorkha recruitment</a>. Now, the Maoists are in power with the UML, but none of the comrades wants to be reminded of those demands anymore.The reason why I took that step five years ago, and why I felt so strongly that it was time to stop Gorkha recruitment was that it is a scar on our national self-esteem. Asking the difficult questions

Earlier this month, Nepal received Rs1.6 billion from the World Bank as part of its <a href="https://nepalitimes.com/news/will-nepal-ever-be-paid-for-saving-trees">Forest Carbon Partnership Facility (FCPF)</a>, rewarding the country for increasing its carbon sink capacity. Nepal is the first in South Asia to benefit from this facility, and it is specifically to recompense the country for increasing forest cover in 13 Tarai districts between 2018-2024. “We are also trying to get another Rs13 billion from the facility while also preparing for free market-based carbon trading in the international market,” says Nabaraj Pudasaini of the REDD (Reducing Emissions from Deforestation and Forest Degradation in Developing Countries) Implementation Centre. Big emitters of greenhouse gases are under pressure to reduce their carbon emissions, and many have signed agreements to do so by investing in decarbonisation projects in developing countries. Countries that emit more than a specified amount of carbon would be able to buy emission rights from countries that emit less. Nepal is internationally known for its community forestry program which has been largely credited for <a href="https://nepalitimes.com/banner/tree-mendous">increasing tree cover to over 45%</a> in less than three decades. But this achievement had not been adequately recognised or rewarded internationally before. Forests, especially in the tropics, absorb and store large amounts of carbon while releasing oxygen in a process known as photosynthesis. <a href="https://www.fao.org/forest-resources-assessment/en/">Preventing deforestation</a> and increasing canopy cover is considered a much more achievable goal than reducing emission in the scale necessary to limit global average temperature to 1.5°C above pre-industrial levels. COP11 in Montreal in 2005 first proposed reducing carbon emissions by improving forest quality by halting degradation. By 2015, a new mechanism of financial assistance was created to help less developed countries with sustainable management of forests <a href="https://www.un-redd.org/">(called REDD+)</a>. Under this new mechanism, countries receive aid based on their efforts to prevent forest degradation and increase carbon sink, and in 2021 the World Bank was entrusted with implementing it. Nepal’s FCPF receipt this month was calculated on the basis of 2.4 million tons of carbon stored at a rate of $5 per ton. In the second phase, Nepal will receive more than Rs4 billion within the next year for storing an additional 7 million tons of carbon. Eighty per cent of this amount obtained from carbon trading needs to be spent on local beneficiaries and indigenous communities.&nbsp; But carbon trading is not easy, Nepal needs to prove that protected forests will not be destroyed in future.  <figure> <img src="https://publisher-publish.s3.eu-central-1.amazonaws.com/pb-nepalitimes/swp/asv65r/media/20241121091132_c8a381c9a95aa86fec558951650d97bb87914741f01766982ba2b086af001f16.jpg" data-media-id="editor_4" data-image-id="20241121091132_c8a381c9a95aa86fec558951650d97bb87914741f01766982ba2b086af001f16" data-rendition-name="original" width="1500" height="999" loading="lazy" alt="Greenbacks for greenery NT "> <figcaption>Photo: KUNDA DIXIT</figcaption> </figure>  Explains carbon trading expert Yugan Manandhar. “Forests should be handed over to the community and shown that they are managed sustainably. Proving this will be particularly challenging; forest encroachment and degradation is rife in the Tarai.” <a href="https://nepalitimes.com/multimedia/nepal-is-going-up-in-smoke">Deliberate forest fires</a> have also added to the challenge because they increase carbon emissions and reduce the sink capacity of forests. The basis for the amount that Nepal received was set five years ago by calculating the carbon reserves of forests in the 13 Tarai districts. In the meantime, sustainable forest management, tree plantation, forest destruction and erosion control were prioritised to increase carbon reserves in those forests. Nepal is signing another carbon trading agreement during the ongoing Baku climate conference. The <a href="https://www.leafcoalition.org/">Lowering Emissions by Accelerating Forest finance (LEAF Coalition) </a>proposes to sell the carbon stored in the forests of Bagmati, Gandaki and Lumbini provinces. For this, Nepal signed the letter of intent three years ago at COP26 in Glasgow. The target is to store 70 million tons of carbon in 32 million hectares of forest in the three provinces per which Nepal will receive Rs13 billion in four years at $10 per ton with provisions to increase the rate if various conditions are met. However, the agreement in itself doesn’t guarantee the amount. According to the targets set by Nepal, forest degradation should be stopped and carbon reserves increased by protecting tree cover. Preparations are also underway for clean air carbon trade because it has offset fossil fuel use by introducing 30,000 electric vehicles. Nepal has been selected for the first round to receive $40 million within one and a half years through the Clean Air System of the World Bank. Given that most of Nepal’s energy mix is from biomass, replacing them with electric stoves can significantly improve health by reducing indoor pollution as well as strengthen the country’s capacity for carbon trade. “Nepal's goal now is to sell carbon in the free market where carbon credits are bought and sold based on supply and demand in an open and transparent manner,” adds Pudasaini of the REDD Implementation Centre. “Nepal can now set its own price and bargain with interested buyer countries and organisations.” Lately, India has been discussing setting up a carbon market. Nepal has exported Rs12.72 billion worth of electricity to India so far this fiscal year, which can be traded under Nepal’s carbon market. “Carbon trading can create significant economic benefits for Nepal, which will help reinvest in development and environmental protection projects,” says Manandhar. “But we must prioritise sustainable management of forests, cutting older trees and allowing regrowth as well as promoting electric stoves and electric vehicles.”

Greenbacks for greenery

Khukri Rum is <a href="http://archive.nepalitimes.com/news.php?id=3719#.WurBk6SFPIU">one of Nepal’s most iconic brands</a>, and is now launching a new Cask Series premium product to sell in Nepal and abroad. The Cask Series Smoked Finish Khukri Rum is a limited edition with only about 7,000 bottles, most of it for export and rest to be sold to rum connoisseurs in Nepal itself. Each bottle is numbered and will mention the cask from which it is derived. “We are working on taking a classic Nepali rum to a new luxury premium brand category, the Cask Series will only be produced this year with new product ranges in future,” explains Subash Lamichhane, managing director of Nepal Distilleries that first started making Khukri rum in 1959 in Balaju and has never stopped. Fermented from molasses in Bara district in the Tarai after the annual sugarcane harvest, the rum is matured for at least eight months during distillation. The distillery bottles the classic Khukri XXX, Coronation Khukri XXX, Khukri White Rum and Khukri Spiced Rum.&nbsp; The distillery is now adding this limited edition of its ‘Cask Series’. While the original rum is stored in huge wooden vats, the rum used for this more exclusive line is in smaller casks made either from oak or sal, with charred insides to give the rum a smoky flavour. The Cask Series rum is indeed smokier than the classic, while the spiced rum tastes toasty and mostly of cardamom. A sturdy patterned box that opens up to a black glass bottle with gold lettering, and an indication of which cask the rum is from. These are then shipped to premium customers around the world One of the reasons this is the more expensive premium line is because the casks are smaller than the vats and the blenders reject more than half of the rum in the casks when the aging period is complete. The trick for the blender is also to decide when to take the run out of the cask.&nbsp; Says Lamichhane: “If we have 25 casks, we expect to throw away about fifteen.”Over the decades, Nepal Distilleries have created and maintained a brand that feels quintessentially Nepali, and has served as Nepal’s ‘ambassador’ with exports to Germany, Korea, Belgium, Finland, the Czech Republic, besides the existing markets among Nepalis in the US, UK, Hong Kong and Australia. &nbsp;Its unique <a href="https://nepalitimes.com/here-now/khukri-rum-sharpens-its-act">khukri shaped bottle</a> first introduced for King Birendra’s coronation in 1975 has been a collector’s item. The bottle and rum have been a staple for Nepalis and visitors to take as gifts when they leave the country, and is used as decoration on bar tables around the world. Now, nearly 40 years later, even that bottle will soon be getting a makeover with a sharper design and sleeker handle. “Our bottle design has always been instantly recognisable, and it is,” says Lamichhane. The Himalayan restaurant at The Hague, for example, has a Khukri Coronation bottle adorning its bar (page 6-7). In Washington DC Himalayan Heritage Restaurant &amp; Bar offers ‘Nepalese Khukri Rum’ mojito in its drinks menu with fresh mint, soda water, lime juice and sugar syrup, for $12.&nbsp;  <figure> <img src="https://publisher-publish.s3.eu-central-1.amazonaws.com/pb-nepalitimes/swp/asv65r/media/20241122131124_b9474db3fc83c85845348dddc30c49652ee1f17229531867fa241de50849cedc.jpg" data-media-id="editor_3" data-image-id="20241122131124_b9474db3fc83c85845348dddc30c49652ee1f17229531867fa241de50849cedc" data-rendition-name="original" width="1500" height="1000" loading="lazy" alt="Khukri Rum NT"> <figcaption>Christopher Armes, master blender of the Cask Series.</figcaption> </figure>  A distinct element of the award-winning <a href="https://nepalitimes.com/business/khukri-rum-gets-award">classic Khukri rum</a> is its burgundy colour from caramel sourced from cooking sugar and blended with the raw rum. The spirits are then stored in a warehouse with floor-to-ceiling vats. The vats are not just for storage, the wood in the vats imparts flavour into the rum, and removes a lot of the harshness. &nbsp; On a visit this week, the bottling room was just about to begin for the day and the production line was churning out different shapes and sizes of Khukri Rum bottles. Most of the process is automated, including screwing bottle caps, sticking labels, placing the government seal, and packaging. The only manual intervention is the quality control where bottles are held against the light to check for sediment and colour. A mural on the wall of the distillery in Balaju depicts the rum-making process. A lady slings sugarcane on her shoulder, the molasses is churned in a pot, water is channelled into the distillation process, cinnamon, cloves and cardamom are added to a container, and finally there is a bottle of the classic Khukri Rum against a Kathmandu backdrop.

Khukri goes premium with new rum

Turkish Airlines has introduced a new amenity kit collection designed in collaboration with French fashion house Lanvin for international business class passengers on flights more than five hours. It consists of five pieces designed for sustainability and elegance. Bags are reusable and will consist of Lanvin cosmetic products like hand and body lotions and lip balm. Eye masks and socks are made from recycled materials, earplugs are packaged in paper and the toothbrush is bamboo.

Nepal now generates a surplus of electricity and it is all from renewable hydropower. Nearly half the country is under forest cover. Despite meeting these decarbonisation goals, Nepal’s hydropower plants are threatened by increased risk due to climate impact.&nbsp; Till <a href="https://nepalitimes.com/editorial/when-it-rains-it-pours-ksqprbu3">28 September</a>, Nepal was <a href="https://nepalitimes.com/news/india-nepal-sign-power-exchange-deal">exporting just over 1,000MW</a> of electricity to power-hungry India, when flash floods and landslides unleashed by historically heavy rains damaged over 30 hydropower plants across the country, temporarily <a href="https://nepalitimes.com/news/power-to-the-people">slashing nearly half the power generation.</a> The 456MW Upper Tamakosi in Dolakha was the hardest hit and it will take six months and Rs2 billion to repair. This has significantly reduced exports as well as domestic generation. Two months later, Nepal has still not been unable to fully keep its export commitment, and is actually paying Rs100 million in fines to India. Thirty-seven existing and under construction projects under the Independent Power Producers' Association Nepal (IPPAN) suffered Rs2.5 billion in damage. One of them is the 22MW Bagmati project in Makwanpur which was almost completely buried in flood debris. Even before <a href="https://nepalitimes.com/news/60-dead-64-missing-in-nepal-floods">record-breaking rain in September</a>, 15 other hydropower projects had been damaged by floods. Last year, floods caused by heavy localised rain damaged 28 hydropower plants. World governments met in Baku for COP29 to discuss the Loss &amp; Damage Fund and the Adaptation Fund, but for countries like Nepal the commas and brackets are meaningless until they are turned into $ and €. And likelihood of adequate compensation for climate-related damage is a long way off, if ever. Nepal’s national strategy is to use its vast hydropower resource as clean energy to spur economic growth, job creation, and boost export revenue. But the plants are located in narrow Himalayan valleys prone to landslides and floods even at the best of times. Now, those <a href="https://nepalitimes.com/opinion/comment/changing-climate-for-investment-in-nepal">risks have been heightened by weather extremes</a> due to climate breakdown. At present, Nepal generates over 3,300MW of clean hydropower, and the target is to reach 12,700MW in the next five years. Projects equivalent to 6,000MW are under construction or ready to start. The Ministry of Energy, Water Resources and Irrigation has an Energy Development Roadmap and Action Plan with the target of producing 28,500MW by 2035 by when more than half of it will be exported.&nbsp; “The climate crisis will further change the rainfall patterns making hydropower generation a big question mark in the future,” Manjeet Dhakal in Baku, who is also the Nepali adviser to the LDC Chair at the United Nations Framework Convention on Climate Change (UNFCCC). “We are building hydropower projects on rivers without evaluating risk. This whole process needs to be reviewed and reconsidered.” The report of the National Adaptation Plan published by the Ministry of Forest and Environment last year mentions that hydropower production, transmission and distribution will be at risk from flash floods, debris flows, glacial lake outbursts and rising temperatures.&nbsp; This risk is not confined to Nepal. Average global temperatures have increased by 1.3°C compared to the pre-industrial era. Worse, the Himalayan mountains are warming faster than the global average by 0.7°C because of elevation-dependent warming. A study conducted by our own Department of Hydrology and Meteorology in 2017 showed that the average temperature in Nepal has increased in the last four decades. Scientists say this is leading to extreme weather unleashing floods and landslides on slopes already destabilized by seismicity.&nbsp;  <figure> <img src="https://publisher-publish.s3.eu-central-1.amazonaws.com/pb-nepalitimes/swp/asv65r/media/20241124071128_d22901a360e8958f606d80ffa21defba05a671f65afec65539dc21a6885d8345.jpg" data-media-id="editor_5" data-image-id="20241124071128_d22901a360e8958f606d80ffa21defba05a671f65afec65539dc21a6885d8345" data-rendition-name="original" width="1333" height="1000" loading="lazy" alt="Right climate for Nepal’s energy transition NT"> <figcaption>BIBLICAL RAIN: Photo taken during catastrophic rain on 27-28 September at the Upper Tamakosi project site that destroyed the control room, killing four staff and burying the sedimentation tanks. Photo: RSS</figcaption> </figure>  Increased atmospheric temperatures has made the monsoon rains more erratic. It does not rain when it is supposed to, and it comes down in torrents when it is not supposed to. The September floods happened two weeks after the monsoon was supposed to retreat from central Nepal. Kathmandu Valley received half its annual precipitation in just over a day. &nbsp; Winter precipitation has also failed, especially in the high mountains and trans-Himalayan valleys. Thirteen of the past 19 years experienced winter drought. This impacts on dry season flows of the rivers, reducing hydropower generation. Nepal’s power capacity normally goes down by one-fourth during winter, but the gap is widening. The Kabeli corridor could only generate 20MW November-March even though plants there have an installed capacity of 200MW. Similarly, Upper Tamakosi only produced 65MW at most against its 456MW capacity last winter. The Nepal Electricity Authority (NEA) pays producers double the price for winter electricity, Rs8.40 per unit. Even though winter operation is highly profitable the rivers run low and NEA has to import from India to meet the winter demand. “This is not just a weather problem but a serious challenge also for the country's energy future, good climate-friendly design should be combined with policy and effective implementation,” says Subarna Das Shrestha, a hydropower investor and CEO of Sanima Mai Hydropower. “Insurance premiums have gone up as well, and settlement for damage is not timely.” <a href="https://nepalitimes.com/opinion/climate-risk-to-hydropower-investment">Hydropower investment</a> at one time was regarded as having a high rate of return. Now, some investors have become <a href="https://nepalitimes.com/banner/climate-smarter-himalayan-infrastructure">wary of the risks involved</a>. Says IPPAN’s Uttam Blon Lama: “Hydropower projects expected to give stable returns are now looking risky. Not only is climate adaptation design and planning expensive, but future repair and maintenance costs will also skyrocket.” Nepal has only one storage type dam <a href="https://nepalitimes.com/multimedia/rivers-be-dammed">in Kulekhani</a> and another one is being built in <a href="https://nepalitimes.com/multimedia/missing-pieces-of-the-hydropower-jigsaw">Tanahu</a>, but they are also at risk. In September, the sluice gates of Kulekhani Dam had to be opened causing loss of life and destruction downstream. Nepal has to learn lessons from the deadly collapse of the $1 billion <a href="https://nepalitimes.com/news/sikkim-flood-is-warning-to-nepal">Chungthang Dam in Sikkim</a> in October 2023 cause by a glacial lake burst. Glacial Lake Outburst Floods (GLOFs) in Nepal pose potentially catastrophic risk to infrastructure. The <a href="https://nepalitimes.com/here-now/lives-on-the-line-in-the-himalaya">Thame flood in August</a> was a relatively minor debris flow that damaged half of this village in the Everest region when <a href="https://nepalitimes.com/news/climate-breakdown-linked-to-thame-flood">two glacial lakes at 4,760m burst</a>. Luckily there was no loss of life. Of the <a href="https://nepalitimes.com/here-now/lives-on-the-line-in-the-himalaya">47 high-risk glacial lakes</a> in the eastern Nepal Himalaya, 21 are in Nepal and the rest are in rivers in China that are tributaries of the Arun and Bhote Kosi where Nepal has major hydropower plants under construction, or planned.  <figure> <img src="https://publisher-publish.s3.eu-central-1.amazonaws.com/pb-nepalitimes/swp/asv65r/media/20241123021128_b596cd8520c57a6c5476031e7a3ea6510f26b464c4d5351d2bc10f6f7d6b70d8.jpg" data-media-id="editor_14" data-image-id="20241123021128_b596cd8520c57a6c5476031e7a3ea6510f26b464c4d5351d2bc10f6f7d6b70d8" data-rendition-name="original" width="871" height="648" loading="lazy" alt="Page 10-11 map #1236 NT"> </figure>  Global temperature rise is accelerating the melting of Himalayan snow and ice, increasing the <a href="https://nepalitimes.com/here-now/living-below-nepal-s-melting-mountains">number and size of glacial lakes</a> so that we do not even have names for them. Investors, on the other hand, say that planning hydropower projects with climate components would make them even more expensive.&nbsp; “It’s not that we aren’t preparing for climate risk, we design keeping in mind the once-in-100-year flood,” says Blon of IPPAN. “But if we start designing based on once in 1,000 years flood, the cost would be so high that we won’t be able to build them at all.” Nonetheless, Subarna Das Shrestha of Sanima Mai Hydropower says that there is no option but to go for climate smart infrastructure despite the higher cost. Sanima Mai's powerhouse, for example, is completely underground. The strategy could also be to spread the risk by building less expensive plants located on rivers all over the country. Nepal is also diversifying away from its sole reliance on hydroelectricity, which at present supplies 92% of the power in the grid.
