<figure><img src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20230112100132/63bfd47a9c7e80680e0d30aajpeg.jpg" alt="" width="960" height="640"/><figcaption>Photo: GOPEN RAI</figcaption></figure>Just as outmigration of Nepali youth is a safety valve that lets the government off the hook to find jobs for them at home and the money they send home is the country’s economic lifeline, this year’s elections served as a political safety valve.Economic frustration can easily turn into political unrest, and the election of various independent, excluded and previously outlawed individuals has helped release some socio-political tension.There were many ups and downs with implementation of the 2015 Constitution, but it did channel accumulated grievances through political representation for those left out in the past.To be sure, the established parties still hold sway. Proof of this was the election of Sher Bahadur Deuba as leader of the Nepali Congress (NC) parliamentary party, which paves the way for his sixth term as prime minister.But the elections in 2022 also allowed Nepali voters to vent their fury, and bring in the likes of Balen Shah in Kathmandu and Rabi Lamichhane in Chitwan.Read also: <a href="https://www.nepalitimes.com/banner/government-of-the-leaders-for-the-leaders-by-the-leaders/">Government of the leaders, for the leaders, by the leaders</a>, Shristi KarkiThe polls have even provided new political space for former Madhes separatist C K Raut, and for the indigenous Tharu community of the Tarai to carve a separate political identity for their Janamat Party.Just the presence of these personalities and parties will not be enough to bring meaningful change, but their representation is the first step in righting past wrongs.The Constitution may be flawed and incomplete, but it has recognised Nepal’s ethno-cultural diversity to a limited extent. There is a difference between diversity and division. Nepal’s ethnic, linguistic, and religious mosaic is in fact our nation’s social capital, our cultural wealth.The role of elected representatives now is not to try to meld, but manage this medley. Nepalis are now politically astute, and cannot be pushed around. The goal of the new Parliament must be to broaden this awareness so it translates into inclusive and equitable progress.Read also: <a href="https://www.nepalitimes.com/opinion/caste-vote/">Caste vote</a>, Chandra KishoreDeuba defeated Gagan Thapa to lead the NC party by the vote count, but he lost at the moral level. Gagan has rightly gauged the national mood for generational change not just within the NC but in the other old parties. He has shown that internal party democracy is necessary to safeguard Nepal’s democracy.Unlike Deuba, there were no rivals for Pushpa Kamal Dahal and K P Oli from within their parties because they sidelined all potential adversaries long ago. But the Maoist and UML parties are already feeling the aftershocks of Gagan Thapa’s challenge to Deuba. Many young turks are thinking: if he can do it, so can we.The rise of the RSP and RPP in November elections also show that there is a socio-political churning afoot in Nepal. There is disenchantment in a section of the electorate with federalism, republicanism, and secularism — the three pillars of the 2015 Constitution.  The rout of Madhes-based parties which were at the forefront of the federalism struggle was a rude awakening.Nepal now needs a stable government that can deliver. But the NC needs support from smaller parties, which means more backroom deals. A NC-UML coalition, on the other hand, would make them too dominant and drown out new voices.The Nepali people in their wisdom have sent a strong message to the established parties: you may continue to be in power, but your days are numbered. Nowhere is this truer than in Nepal where none of the main parties got a majority in November elections, and are wooing fringe parties by freeing their cadre serving time in jail for crimes.Since Parliament has not convened yet, the main parties have taken this decision by ordinance so they get the total 138 seats in the House to form a government.A cabinet meeting of the caretaker government on Sunday sent a letter to President Bidya Devi Bhandari informing her about the ordinance to amend the National Criminal Procedure (Code) Act 2017, which would allow the government to grant amnesty to political prisoners.Subsection 8 of Section 116 of the Criminal Procedure Code stipulates that no case which is under consideration at the stage of appeal, reference, review or revision shall be subject to withdrawal.The ordinance seeks to add a provision which will allow dismissal of pending court cases against parties or groups engaged in violent politics.Read also: <a href="https://www.nepalitimes.com/banner/arnico-panday-the-political-scientist/">Arnico Panday, the political scientist</a>, Nepali TimesIf passed, the ordinance will facilitate the release of Nagarik Unmukti Party leader Resham Chaudhary to join the government and give the governing alliance the number it requires in Parliament. Chaudhary’s wife Ranjita Shrestha is the chair of the party and one of three newly-elected MPs from the new party. Resham Chaudhary is serving a life sentence for his involvement in the 2015 Tikapur massacre of policemen.The ordinance will also benefit Janamat Party leader C K Raut, some of whose party cadres are in prison. Janamat Party has six elected MPs.But more importantly, it sets a precedent for amnesty for Maoists, security forces and politicians who are accused to war crimes during the 1996-2006 conflict.Government spokesperson Gyanendra Bahadur Karki tries to put a gloss on the decision by saying that the ordinance was designed to bring parties that have had “violent disagreements to the country’s political system to the mainstream … and foster political unity”.But the real intention behind the ordinance is not lost on most Nepalis, and the opposition UML as well as other parties that won seats in the November elections expressed outrage.Read also: <a href="https://www.nepalitimes.com/latest/seats-of-power/">Seats of power</a>, Shristi KarkiInterestingly, the most vocal criticism of the ordinance came from within the Nepali Congress (NC) which leads the coalition. In a scathing rebuke, NC leader Gagan Thapa wrote on social media: ‘The ordinance is legally, politically and morally unsound. It is unconstitutional and against the spirit of democracy and the parliamentary system.’Thapa is challenging Prime Minister Sher Bahadur Deuba for leadership of the party. But Deuba appears to be more intent on striking deals with Maoist leader Pushpa Kamal Dahal over the next prime minister, president, house speaker, and other constitutional appointees.Resounding criticism also came from other NC leaders like Bishwa Prakash Sharma and Shekhar Koirala, as well as newly-elected young MP Pradip Paudel. Party leaders have said that the party was not consulted before the ordinance was introduced.This is not the first time Deuba has used an ordinance to form a government during his fifth term as Prime Minister. In August 2021, he amended the Political Parties Act just so that his ally Madhav Kumar Nepal could form a new party and join his coalition.He repealed that amendment when it had served its purpose, and had come under widespread criticism from constitutional experts for blatant political expediency.Read also: <a href="https://www.nepalitimes.com/banner/back-to-the-future/">Back to the future</a>, Santa Gaha MagarThe reaction to this executive decision has been even more  negative, with the main opposition UML, the legal fraternity, security chiefs and civil society demanding that the government withdraw the ordinance forthwith.On Tuesday, the Supreme Court Bar Association added its voice to the condemnation of the move: ‘An ordinance to amend the law proposed by a caretaker government before the first session of the newly-elected parliament disregards the people’s mandate and makes a mockery out of the constitution, rule of law and the Supreme Court’s established recognition of criminal law.”Deuba’s decades-long grip over NC party leadership gives him a significant advantage over any other leader aspirant within the party, and he has tried to railroad the ordinance despite NC dissidents and the new independent RSP doing well in elections.The RSP’s newly-elected MP from Lalitpur-3, Toshima Karki said: “That the caretaker government can stoop so low to free criminals from jail just to stay in power shows their greed for power. This is against the rile of law and will spell disaster for the country.”Despite some support from within the NC and sympathy from the public, Gagan Thapa’s chances of winning parliamentary party leadership and becoming Prime Minister remain slim.Read also: <a href="https://www.nepalitimes.com/banner/in-with-the-new-out-with-some-of-the-old/">In with the new, out with (some of) the old</a>, Anita Bhetwal“I don’t see the old leaders trusting the newer generation with the leadership and handing over the reins at this point in time,” notes political analyst Indra Adhikari.She adds: “Our socio-political structure has historically favoured the elite which means that political access is limited, and power rarely changes hands.”However, the Proportional Representation (PR) candidates chosen by seven nationally-recognised parties are set to be certified as elected before preparations for parliamentary party elections. Parties have sent the finalised list to the Election Commission, which will forward them to the President.As much as the FPTP candidates reflected the political leadership’s disregard to field women and minority communities in direct elections, the PR list finalised by parties reflects the status-quo and nepotism of the established parties.The ordinance is proof that the caretaker government is determined to bend Constitution any which way to keep the coalition intact despite some of its members suffering huge losses in elections. Nepal’s traditional politicians, it seems, want to carry on doing what they have always done.Indeed, the PR list has almost entirely filled the 33% constitutional quota for female representation in parliament. It is getting more difficult to agree on a power sharing deal with coalition members who fared badly in the polls.Up for grabs is not just who gets to be minister in the next government, but also the positions of president, chief justice and other constitutional bodies.Nepalis who cast their votes for change are already dismayed that this is reeking like politics as usual, with familiar backroom wheeling dealing and horse-trading.  With 10,560,082 valid Proportional Representation (PR) votes counted, the UML came first  with over 2.8 million popular votes, while the NC got 2.7 million votes. The Maoists and the new Rastriya Swatantra Party (RSP) came third and fourth respectively with over 1.1 million votes each. The royal-right RPP, and the Tarai-based JSP and Janamat have also received enough votes to get PR seats. Only seven political parties will be recognised as national parties in the House, with coalition members CPN-Unified Socialists and LSP failing to cross the 3% vote threshold.  Since neither the coalition nor the opposition have a clear majority of 138 in Parliament, hectic negotiations on government formation and appointing constitutional heads have been going on.For now, the 4-party coalition that carried into both the local and general election seems to have held, but everything is up in the air, and no permutation or combination is being ruled out.On Monday, coalition leaders decided to keep the alliance, although there were grumblings from Maoist leader Pushpa Kamal Dahal that alliance partners did not ‘transfer’ votes to his party as they were supposed to. Smaller Tarai-based parties like the LSP, Nagarik Unmukti and Janamat are also negotiating with the coalition. This would give the coalition a total of 136 seats which is two seats short. There is still the possibility that the JSP, which was allied with the UML, will defect to the coalition.Although the alternative RSP has kept its options open, joining the reviled big parties would be against everything it has stood for. It is more likely that the JSP and the Janamat will be courted by the coalition.“CK Raut may take his Janamat into government because it would help him break into the mainstream which is something he has always wanted,” says political analyst Indra Adhikari. But amid discourse about party alliances and government formation, there are questions as to why it is difficult for parties to achieve a simple majority during elections. Most recently, in 2013, the NC and UML, which were the two largest parties in Parliament, formed an alliance after either party failed to obtain a majority in the polls. In 2017, UML and Maoist Centre merged after the election to become a large leftist alliance. “Our constitutional arrangement doesn’t allow for any one party to come into a majority,” adds Adhikari. “Since our socio-political structure has historically favoured the elite and the influence and political access is limited, power rarely changes hands.”Furthermore, she adds, the PR system which was supposed to reserve 40% of parliamentary seats for excluded groups lessens the possibility of any one party obtaining a majority.What the alternative RSP decides will be important, even as the rightwing RPP says it wants to stay in the opposition. The two parties may look different, but both have an anti-federalist stance. RSP leader Rabi Lamichhane refused to cast his ballot for the provincial assembly on 20 November.Arnico Panday told Nepali Times : “We got a lot of votes because people had high hopes that we would do something. Next time, we will get votes because we will have shown that we get things done.”Only nine out of 225 women who stood for direct elections won seats this time, slightly up from seven women during the last election. Bidya Bhattarai of UML was re-elected in Kaski -2, and young RSP candidates Sobita Gautam and Toshima Karki defeated popular mainstream candidates in Kathmandu-2 and Lalitpur-3. Remaining female MPs will be chosen through the PR closed list to fulfil the 33% parliamentary participation quota.Out of the 225 women, only 25 candidates were fielded by Nepal’s mainstream parties, lending credence to the fact that the political leadership tends to overlook women while fielding candidates for competitive positions. “Women are seen to be less capable in winning elections because they cannot raise campaign funding, do not have connections to big businesses or political contractors,” explains Adhikari.She adds: “Moreover, some of Nepal’s notable female politicians— who could win if they contested direct elections— would rather be elected through the PR system because that guarantees them a seat in parliament as opposed to the possibility of spending money and losing in direct elections.”For now, the coalition partners appear to have been spooked by the strong showing of the RSP and the poor performance of the Maoist and Unified Socialists. But it does not look like they have got the message of voters, or mended their ways. Prime Minister Deuba and Maoist leader Pushpa Kamal Dahal are already haggling over which of the two gets to be PM first under their secret pre-election seat-sharing deal.

Seats of power

The Chief Election Commissar is a busy hombre these days. With the intention of cracking down on violations of the election Code of Conduct, he is tied up firing off  letters demanding explanations from candidates found to be contravening guidelines. In fact, he has been so busy issuing clarifications that he has no time to enforce any of them.In order to help the EC to remind candidates and parties about the dos and don’ts of election campaigning, the Ass assists by recapping below some of the salient points of Clause 46(1) of the Election Commission Act:Don’t: Character assassination on social media is banned with immediate effect. Candidates are advised to also desist from actual assassination of rivals.Do: Under Nepal’s democratic system, mass murderers, plunderers, pillagers, rapists and those accused of other minor offences can campaign openly in broad daylight hours.Don’t: Candidates who have partaken meeting allowances in the past 40 years are barred from either standing or running in elections.Do: Those who have embezzled billions in airport contracts, telecom licenses or in inaugurating highways that never got built may hit the campaign trail along those same non-existent highways.Don’t: It has come to the EC’s notice that a certain candidate wore a baseball cap with his party’s election symbol during a rally in Gorkha-2. The Commissar has asked the candidate in question to furnish an appropriate clarification within 24 hours, failing which the aforementioned cap will be confiscated forthwith.Do: Candidates from the ruling 5-party collision, may be draped with 25 kg marigold garlands provided they are not allergic to pollen.Don’t: The EC takes umbrage at the #NoNotAgain campaign, saying the hashtag contains a double negative that could confuse voters.Do: Even so, established parties are allowed to embellish, exaggerate, falsify, fake, tamper, or lie about their achievements during the last 30 years in office on Facebook and TikTok as long as the jingle has a catchy tune. To set an example, the EC posted on YouTube a melodious song composed by its own talented storekeeper exhorting Nepalis to vote.Don’t: Candidates are not allowed to have stickers with party symbols at the back of the cars that they have hired from Bihar and Uttar Pradesh.Do: But the Firstest Lady is allowed to threaten voters to cast ballots only for a Better Half who flies in on a helicopter.Don’t: Candidates found ringing temple bells will be given a stern warning about noise pollution. If they insist on ringing out the old and ring in the new, they will be rusticated on the spot. Playing madal or other traditional percussion instruments is in contravention of the Election Code of Conduct Article (13), Clause (1) and Sub-clause (d).Do: Parties are allowed to use fleets of Boleros to blare their anthems through loudspeakers. The Co-Finance Minister can take part in a Tharu Peacock Dance even if he is making an ass of himself.

Election dos and don’ts

<a href="https://nepalitimes.com/news/ball-in-balen-s-court">Nepal’s newly-installed Prime Minister Balendra Shah</a> unveiled his Council of Ministers after taking the oath of office on Friday in Kathmandu.&nbsp; Besides Nepal's pre-existing problems, his team will immediately have to deal with the fallout of the West Asia conflict to satisfy an electorate impatient for change. The Rastriya Swatantra Party (RSP) won a majority in the 5 March election and capped the Cabinet size at 15. Shah, a structural engineer and musician, himself has taken charge of the Defence and Industry Ministries. There has been an attempt to make the Cabinet inclusive with women in five of the new portfolios.&nbsp; After much negotiation, the powerful Home Ministry, a bone of contention between Shah and RSP Chair Rabi Lamichhane, has gone to Sudan Gurung, a hitherto little-known figure who <a href="https://nepalitimes.com/here-now/who-or-what-is-hami-nepal">rose to prominence after the September GenZ protest</a> and won the election from Gorkha-2.&nbsp; Gurung will be in charge of Nepal’s internal security apparatus and maintaining law and order. And with Gurung, a close ally of the Prime Minister, in charge, some note the Home Ministry will be a hook for Shah if Lamichhane, with his share of controversies, steps out line.&nbsp;  <figure> <img src="https://publisher-publish.s3.eu-central-1.amazonaws.com/pb-nepalitimes/swp/asv65r/media/20260327090324_c7725ea5fb9ffbf96df25a7b3122520b7ae3ee10548aed3f37781a7e5440e51a.jpg" data-media-id="editor_2" data-image-id="20260327090324_c7725ea5fb9ffbf96df25a7b3122520b7ae3ee10548aed3f37781a7e5440e51a" data-rendition-name="original" width="1440" height="960" loading="lazy" alt="Balen Shah swearing in NT"> </figure>  Notable RSP leaders, including vice-chair DP Aryal, were said to have been vying for the portfolio.&nbsp; Gurung is the founder of the non-profit Hami Nepal, which worked primarily in earthquake relief in 2015, and emerged onto the national stage during negotiations to appoint Sushila Karki as interim PM after the unrest. He was also involved in key negotiations that cemented Balendra Shah and Rabi Lamichhane’s political partnership in the runup to the election.&nbsp; Most new Cabinet members are not just first-time ministers, but are also freshmen lawmakers. Many are experts in their fields. Finance Minister Swarnim Wagle is an <a href="https://nepalitimes.com/here-now/nepal-needs-to-rebrand-itself">economist </a>with degrees from the London School of Economics and Harvard, and was previously Chief Economic Advisor at the UNDP Regional Bureau for Asia and the Pacific, and also served in Nepal’s National Planning Commission.&nbsp; Previously a member of Nepali Congress, Wagle exited the party in 2023 following differences with top leadership, and joined the RSP. Before joining RSP, Shrestha was elected to the Bagmati Provincial Assembly in the 2017 elections representing the r<a href="https://nepalitimes.com/here-now/rsp-s-activist-dna">eformist Bibeksheel Sajha Party</a>. He will immediately face the challenge of addressing the <a href="https://nepalitimes.com/news/rough-road-ahead-for-new-nepal-rulers">impact of the West Asia war,</a> including rising petroleum prices and a shortage of cooking gas. Sita Badi, who was elected through the PR system, is Minister for Women, Children and Senior Citizens. She was born and brought up in the underserved and marginalised Badi community in Surkhet and has been advocating for the rights and welfare of women, children, and minority communities. Other ministers include RSP spokesperson Pratibha Rawal as Minister for Federal Affairs and General Administration as well as Land Management, and Gita Chaudhary as Minister for Agriculture, Sunil Lamsal is Physical Infrastrucutre, Transport, and Urban Development Minister, Khadka Raj (Ganesh) Paudel as Tourism and Civil Aviation Minister. As minister Aryal came <a href="https://nepalitimes.com/editorial/skeletons-in-the-cabinet-k5x6py1v">under scrutiny </a>for his involvement in an employment agency that was investigated for illegal acquisition of wealth in 2020. If appointed House Speaker, Aryal will be expected to play a neutral and non-partisan role in Parliamentary affairs. &nbsp; With the full Cabinet announced on Friday, Prime Minister Shah and his team now have their work cut out for them. &nbsp;The government’s first priority will be ensuring the safety and long-term security of the almost two million <a href="https://nepalitimes.com/here-now/migrant-workers-in-wartime">Nepalis living and working in the Gulf</a> amid the ongoing conflict in the region, and taking steps to cushion Nepal’s economy from the Israel-US war on Iran. Nepal swears in new Cabinet

Rivers have been the lifelines of civilisations with their dynamic ecosystems providing vital services for human survival and ecological balance through the ages.&nbsp; But accelerating anthropocentric footprints are causing severe, and often irreversible, damage to river systems across the world, including those across High Asia, a region that sustains nearly a fourth of the global population downstream. An example is the <a href="https://nepalitimes.com/here-now/how-the-bagmati-civilisation-is-becoming-uncivilised" target="_blank">Bagmati River</a> that courses through Kathmandu, crosses the Himalayan foothills to join the Ganga in India. A river that once shaped the <a href="https://archive.nepalitimes.com/article/Nepali-Times-Buzz/when-it-comes-to-water-pollution,3196" target="_blank">Kathmandu Valley Civilisation </a>is now a polluted and biologically dead water body constricted by urban sprawl, choked by construction debris, chemical waste and untreated sewage.&nbsp; The loss of a sacred river is tragic enough, but its hazards related to health, life and livelihoods are not limited to the Valley, nor is its enormity fully gauged by the metrics of fatality, income loss, flood return periods, runoffs, embankment failure.&nbsp; It is a systemic collapse of ecological integrity, socio-economic stability and cultural heritage, affecting its downstream users as well. The death of Bagmati is a peril for a population size way bigger than circa 5 million residents of Kathmandu Valley. The degradation started in the 1980s and has accelerated. Why has not enough been done to save this iconic river that runs through Nepal’s capital?&nbsp; The Bagmati River Basin Improvement Project (BRBIP) was designed to make headway in restoring the river with a sewage treatment plant, dams for storing water to support dry-season runoff, recharge groundwater, creation of <a href="https://archive.nepalitimes.com/page/resurrecting-bagmati-the-river" target="_blank">green biodiversity corridors</a> along the river bank to also serve as recreation areas, reduce the urban heat island effect, and also provide cultural continuity. The project also envisages collection of hydrological data for managing Bagmati multipurposewater systems and providing flood forecasts and early warnings aimed at protecting lives and property, among other things. Most importantly, the project takes the integrated water resource management approach, which, in principle, is a holistic and collaborative way of managing all elements of the water cycle to ensure water security, public and environmental health and amenity.  <figure> <img src="https://publisher-publish.s3.eu-central-1.amazonaws.com/pb-nepalitimes/swp/asv65r/media/20260329040336_9605240fa8c7d649ce49fbe43565130e3187e979338ccf959c4e9b8c581b7a4c.jpg" data-media-id="editor_3" data-image-id="20260329040336_9605240fa8c7d649ce49fbe43565130e3187e979338ccf959c4e9b8c581b7a4c" data-rendition-name="original" width="2126" height="1577" loading="lazy" alt="Bagmati NT"> </figure>  This should pave the way for managing a river as a connected ecological, social, and economic system by enabling coordination across agencies and disciplines, stimulating technological innovation and financial investment. The success of this approach depends on long-term political will and commitment that transcend political cycles, but also needs strong community and civil society in defining issues and proposing solutions, creating and sharing knowledge, taking independent action to inform practice, monitoring and evaluating policies, and participating in public decision-making. Civil society, especially, in making the <a href="https://archive.nepalitimes.com/page/encounter-with-bagmati-river" target="_blank">revival of the Bagmati River</a> a pressing governance issue. The Bagmati Action Plan 2009, a precursor to the BRBIP, was designed in response to lawsuits filed in 2000 and 2004 by an independent legal practitioner of Kathmandu against waste dumping in the river.&nbsp; It took him almost two decades of legal battle for Nepal’s Supreme Court to pass orders for mandatory septic tanks in all homes in Kathmandu Valley, relocation of squatters from Bagmati river banks to government-built houses, and embargo on dumping and burying garbage on the banks of the river and its tributaries. Despite court orders, however, actual results have been unsatisfactory. Restoration of Bagmati barely made it to any political debate or electoral manifesto this time. Treatment plants have not been operational for years, yet no one is held accountable. The population ignores waste segregation or single-use plastic rules to check littering.&nbsp; The current condition of the river therefore seems to have more to do with the lack of public awareness and behaviour change than the failure of various master plans. Why does the deep danger of a dead river fail to arouse widespread civil society concern, let alone action? The apathy is perhaps underlined by an innately anthropocentric understanding of the river as a mere resource to be exploited, rather than the backbone of existence.&nbsp; Such a paradigm shift is possible when river or river systems are understood to be necessary for &nbsp;a harmonious coexistence with human populations. The more pertinent question is not whether a dead river can be restored because there are many examples from around the world where that has been successfully achieved. It is whether we choose to restore our rivers for intergenerational equity. This would require a holistic perspective and political will to revive reverence for a river system so that its symbiotic relationship with human settlements can be restored. A lifeline becomes liability

On Friday, Balendra Shah is taking his oath of office as Nepal's prime minister in a capital city of which he was a mayor till six months ago.
At 35, he will be among Nepal’s youngest prime ministers. His reticence and reclusiveness have reinforced his brand as a doer rather than a talker. This was a persona he cultivated as mayor of someone who cleaned up the city by managing garbage. But he also chased off sidewalk vendors in an effort to ‘beautify’ the city.&nbsp;
After being elected, Shah did not attend RSP events in official capacity, and he was absent at an MP orientation last week.&nbsp;
His refusal to engage with the press, and even stopping to post on social media, have added to the air of reclusiveness. But as prime minister, he may have to communicate more even if it just to stop conspiracy theories and intrigue.&nbsp;
The people he will now represent would like to know, and have a right to know, what he is up to. Otherwise the feeling will grow that Nepal is entering uncharted territory. Governance, the economy and investment do not like uncertainty.
Political scientist Pyakuryal notes that calling Balen a 'man of few words' may serve as a useful epithet if he governs with quiet efficiency rather than fanfare. "But as Prime Minister, he must engage the nation’s will, not simply manage from above," she says.
She adds: "The real test lies in his choice of style: will he lead exclusively, keeping decisions close, or inclusively, opening space for dialogue and shared ownership of governance?"
Nepal's newly-elected lawmakers were sworn in on Thursday. And once sworn in as PM on Friday, Balendra Shah is set to appoint a ‘minimalist’ Cabinet. Although the Constitution caps the size of the Council of Ministers at 25, the party has decided to stick to maximum 18 and not split ministries to accommodate loyalists as was done in the past.&nbsp;
&nbsp;"The Cabinet must support the leadership of the Prime Minister while ensuring accountability to the Parliament,” notes political scientist Sucheta Pyakuryal. “But the questions that come to mind are: will the RSP MPs readily submit to Balen’s leadership and is Balen’s absence from the party’s official events an unwillingness or hesitation to submit to the party?”
Prime Minister Sushila Karki and her ministers ended their interim tenures this week, and she was lauded for upholding her commitment to hold a free, fair and peaceful election. But her image was tarnished for her reluctance to release the investigation report on the September violence, as well as recommending her Home Minister Om Prakash Aryal for a National Assembly seat, and her personal secretary to the National Trust for Nature Conservation. President Ram Chandra Poudel has put Aryal’s nomination on hold. &nbsp;
The Investigation Commission report leaked on Wednesday said the state failed to stop the firing on protestors by Police on 8 September and blamed the Army for not preventing the arson next day. It recommended the prosecution of prime minister KP Oli, home minister Ramesh Lekhak, and Police chief Chandra Kuber Khapung.
Notable names said to be in consideration for the Cabinet include many who are experts in their fields, and RSP wants a young lawmaker as Speaker. The new government will plunge headlong into the economic fallout of the West Asia war.
RSP, with its near two-third majority, does not have to placate any coalition partner, so Nepal is at long last expected to have a stable government after 35 years. Despite hopes that there will not be the usual horse-trading this time, there is tension between supporters of RSP chair Rabi Lamichhane and Balendra Shah. The two have been negotiating in hotel rooms for Cabinet posts for loyalists.&nbsp;
Shah’s larger-than-life online persona and nationwide appeal delivered the RSP its overwhelming electoral victory this month, and this makes the party’s core leadership beholden to him. To what extent is Shah willing to meet Lamichhane’s demands is the critical question, and we will know the answer by this weekend.
Says Pyakuryal: “Because this election showcased personality politics rather than the regular party politics, the dangers of ego-clashes, power-tussles and intraparty realpolitik become very real and this kind of equation can greatly hamper the spirit of democracy, representation and collective good."

Ball in Balen’s court

Nepal’s new government hit the ground running with the arrests of former Prime Minister K P Oli and home Minister Ramesh Lekhak early Saturday morning.&nbsp;
Their dramatic detentions followed an inquiry commission report recommending that Lekhak, Oli, and former Police chief Chandra Kuber Khapung be investigated and prosecuted for negligence in failing to stop the killing of 19 young protesters by security forces during the protests on 8 September.&nbsp;
Interim PM Sushila Karki’s government faced considerable criticism from GenZ activists at the end of her 7-month tenure for failing to release the report and hold the previous UML-NC coalition to account.&nbsp;
Karki had left any decision on the report’s findings to new RSP government, but her government released it after the content was leaked earlier this week, a day before Nepal’s newly elected lawmakers took their oath of office.
By making the arrests of Oli and Lekhak as its first order of business, the new government, and especially Home Minister Sudan Gurung and Prime Minister Balendra Shah, have tried to show that they are decisive and mean business.&nbsp;
It has been hailed by many as signalling that Nepal’s new and young leadership will back up its pledges with action. However, others including the UML and some constitutional experts, say that the arrests have not followed legal procedures. The UML has mobilised its affiliated groups to start nationwide street protests.&nbsp;
The main divide seems to be over the perception that the new government is only interested in justice for the perpetrators of the 8 September Parliament massacre, and not against those who organised arson and vandalism of government buildings, homes of politicians, businesses and the media the next day.&nbsp;
While some celebrate what they see as the beginning of justice for the victims and survivors of the September violence, political analysts and legal experts express alarm over a lack of adherence to the rule of law.&nbsp;
K P Oli has a lot of experience being behind bars. He was jailed a dozen times in 1970s by the Panchayat regime for his extreme left activism and then spent 14 years in prison between 1974-1988.
Critics argue that the former leaders were denied due process and label their arrest a “political vendetta."
RSP supporters had made similar arguments in October 2024 and April 2025 that the arrest of party chair Rabi Lamichhane over misappropriation of funds from numerous cooperatives were &nbsp;politically motivated.
‘What is happening is unacceptable,’ wrote former minister and diplomat Nilamber Acharya wrote on Saturday morning. ‘Such acts of revenge and crackdowns do not bode well.’
In response to accusations of the arrests being partisan and politically-motivated, Home Minister Sudan Gurung took to social media, saying that the new government is fulfilling its promises: ‘No one is above the law,’ he wrote. ‘This is not revenge, it is the beginning of justice. I believe now that the nation will now take a new direction.’
There is also concern the new leadership has jumped the gun to implement the findings of the inquiry commission, which has itself been criticised in some quarters for concentrating on the events of 8 September rather than investigating the perpetrators of the anarchy on 9 September.&nbsp;
The first meeting of the Council of Ministers made the immediate implementation of the GenZ Movement Inquiry Report its first priority.
But there are questions as to whether the execution of the report will be impartial. Home Minister Gurung will now dictate how the recommendations &nbsp;will be conducted, since he is himself referenced in the report in connection with the unrest on 9 September.&nbsp;
In fact, the report also outlines how supporters stormed Nakhu Prison on 9 September to organise Rabi Lamichhane’s jailbreak. Will Minister Gurung also go after his own party's leadership? &nbsp;
With the UML already calling for nationwide protests against the detention of its leaders, there is concern that Nepal is plunging straight into turmoil instead of stability.
The UML leadership has been unrepentant about the 8 September events. Oli has defiantly blamed infiltration and outside forces for the killings, and unlike the Nepali Congress the UML has not managed its own leadership changeover.&nbsp;
The NC under Gagan Thapa as well as the Nepali Communist Party of Maoist leader Pushpa Kamal Dahal have so far been silent about the detentions even though former Home Minister Ramesh Lekhak is from the NC.
Oli and Lekhak’s arrests will now be challenged in the courts. But their detention also signals to Nepal’s political old guard that the tables have turned: legacy leaders cannot be complacent and assume they will disappear from national consciousness for past deeds without being held accountable for what happened during their watch.
The RSP government under Prime Minister Balendra Shah seems determined not to let bygones be bygones. But while that is all and well, it remains to be see whether the party can deliver on the need of the electorate for tangible governance reform.
The danger is that the new rulers may be defined by the same tactics of political revenge as its predecessors in the name of meting out justice.
