<figure><img src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20230112100132/63bfd47a9c7e80680e0d30aajpeg.jpg" alt="" width="960" height="640"/><figcaption>Photo: GOPEN RAI</figcaption></figure>Just as outmigration of Nepali youth is a safety valve that lets the government off the hook to find jobs for them at home and the money they send home is the country’s economic lifeline, this year’s elections served as a political safety valve.Economic frustration can easily turn into political unrest, and the election of various independent, excluded and previously outlawed individuals has helped release some socio-political tension.There were many ups and downs with implementation of the 2015 Constitution, but it did channel accumulated grievances through political representation for those left out in the past.To be sure, the established parties still hold sway. Proof of this was the election of Sher Bahadur Deuba as leader of the Nepali Congress (NC) parliamentary party, which paves the way for his sixth term as prime minister.But the elections in 2022 also allowed Nepali voters to vent their fury, and bring in the likes of Balen Shah in Kathmandu and Rabi Lamichhane in Chitwan.Read also: <a href="https://www.nepalitimes.com/banner/government-of-the-leaders-for-the-leaders-by-the-leaders/">Government of the leaders, for the leaders, by the leaders</a>, Shristi KarkiThe polls have even provided new political space for former Madhes separatist C K Raut, and for the indigenous Tharu community of the Tarai to carve a separate political identity for their Janamat Party.Just the presence of these personalities and parties will not be enough to bring meaningful change, but their representation is the first step in righting past wrongs.The Constitution may be flawed and incomplete, but it has recognised Nepal’s ethno-cultural diversity to a limited extent. There is a difference between diversity and division. Nepal’s ethnic, linguistic, and religious mosaic is in fact our nation’s social capital, our cultural wealth.The role of elected representatives now is not to try to meld, but manage this medley. Nepalis are now politically astute, and cannot be pushed around. The goal of the new Parliament must be to broaden this awareness so it translates into inclusive and equitable progress.Read also: <a href="https://www.nepalitimes.com/opinion/caste-vote/">Caste vote</a>, Chandra KishoreDeuba defeated Gagan Thapa to lead the NC party by the vote count, but he lost at the moral level. Gagan has rightly gauged the national mood for generational change not just within the NC but in the other old parties. He has shown that internal party democracy is necessary to safeguard Nepal’s democracy.Unlike Deuba, there were no rivals for Pushpa Kamal Dahal and K P Oli from within their parties because they sidelined all potential adversaries long ago. But the Maoist and UML parties are already feeling the aftershocks of Gagan Thapa’s challenge to Deuba. Many young turks are thinking: if he can do it, so can we.The rise of the RSP and RPP in November elections also show that there is a socio-political churning afoot in Nepal. There is disenchantment in a section of the electorate with federalism, republicanism, and secularism — the three pillars of the 2015 Constitution.  The rout of Madhes-based parties which were at the forefront of the federalism struggle was a rude awakening.Nepal now needs a stable government that can deliver. But the NC needs support from smaller parties, which means more backroom deals. A NC-UML coalition, on the other hand, would make them too dominant and drown out new voices.The Nepali people in their wisdom have sent a strong message to the established parties: you may continue to be in power, but your days are numbered. Safety valve politics

Nowhere is this truer than in Nepal where none of the main parties got a majority in November elections, and are wooing fringe parties by freeing their cadre serving time in jail for crimes.Since Parliament has not convened yet, the main parties have taken this decision by ordinance so they get the total 138 seats in the House to form a government.A cabinet meeting of the caretaker government on Sunday sent a letter to President Bidya Devi Bhandari informing her about the ordinance to amend the National Criminal Procedure (Code) Act 2017, which would allow the government to grant amnesty to political prisoners.Subsection 8 of Section 116 of the Criminal Procedure Code stipulates that no case which is under consideration at the stage of appeal, reference, review or revision shall be subject to withdrawal.The ordinance seeks to add a provision which will allow dismissal of pending court cases against parties or groups engaged in violent politics.Read also: <a href="https://www.nepalitimes.com/banner/arnico-panday-the-political-scientist/">Arnico Panday, the political scientist</a>, Nepali TimesIf passed, the ordinance will facilitate the release of Nagarik Unmukti Party leader Resham Chaudhary to join the government and give the governing alliance the number it requires in Parliament. Chaudhary’s wife Ranjita Shrestha is the chair of the party and one of three newly-elected MPs from the new party. Resham Chaudhary is serving a life sentence for his involvement in the 2015 Tikapur massacre of policemen.The ordinance will also benefit Janamat Party leader C K Raut, some of whose party cadres are in prison. Janamat Party has six elected MPs.But more importantly, it sets a precedent for amnesty for Maoists, security forces and politicians who are accused to war crimes during the 1996-2006 conflict.Government spokesperson Gyanendra Bahadur Karki tries to put a gloss on the decision by saying that the ordinance was designed to bring parties that have had “violent disagreements to the country’s political system to the mainstream … and foster political unity”.But the real intention behind the ordinance is not lost on most Nepalis, and the opposition UML as well as other parties that won seats in the November elections expressed outrage.Read also: <a href="https://www.nepalitimes.com/latest/seats-of-power/">Seats of power</a>, Shristi KarkiInterestingly, the most vocal criticism of the ordinance came from within the Nepali Congress (NC) which leads the coalition. In a scathing rebuke, NC leader Gagan Thapa wrote on social media: ‘The ordinance is legally, politically and morally unsound. It is unconstitutional and against the spirit of democracy and the parliamentary system.’Thapa is challenging Prime Minister Sher Bahadur Deuba for leadership of the party. But Deuba appears to be more intent on striking deals with Maoist leader Pushpa Kamal Dahal over the next prime minister, president, house speaker, and other constitutional appointees.Resounding criticism also came from other NC leaders like Bishwa Prakash Sharma and Shekhar Koirala, as well as newly-elected young MP Pradip Paudel. Party leaders have said that the party was not consulted before the ordinance was introduced.This is not the first time Deuba has used an ordinance to form a government during his fifth term as Prime Minister. In August 2021, he amended the Political Parties Act just so that his ally Madhav Kumar Nepal could form a new party and join his coalition.He repealed that amendment when it had served its purpose, and had come under widespread criticism from constitutional experts for blatant political expediency.Read also: <a href="https://www.nepalitimes.com/banner/back-to-the-future/">Back to the future</a>, Santa Gaha MagarThe reaction to this executive decision has been even more  negative, with the main opposition UML, the legal fraternity, security chiefs and civil society demanding that the government withdraw the ordinance forthwith.On Tuesday, the Supreme Court Bar Association added its voice to the condemnation of the move: ‘An ordinance to amend the law proposed by a caretaker government before the first session of the newly-elected parliament disregards the people’s mandate and makes a mockery out of the constitution, rule of law and the Supreme Court’s established recognition of criminal law.”Deuba’s decades-long grip over NC party leadership gives him a significant advantage over any other leader aspirant within the party, and he has tried to railroad the ordinance despite NC dissidents and the new independent RSP doing well in elections.The RSP’s newly-elected MP from Lalitpur-3, Toshima Karki said: “That the caretaker government can stoop so low to free criminals from jail just to stay in power shows their greed for power. This is against the rile of law and will spell disaster for the country.”Despite some support from within the NC and sympathy from the public, Gagan Thapa’s chances of winning parliamentary party leadership and becoming Prime Minister remain slim.Read also: <a href="https://www.nepalitimes.com/banner/in-with-the-new-out-with-some-of-the-old/">In with the new, out with (some of) the old</a>, Anita Bhetwal“I don’t see the old leaders trusting the newer generation with the leadership and handing over the reins at this point in time,” notes political analyst Indra Adhikari.She adds: “Our socio-political structure has historically favoured the elite which means that political access is limited, and power rarely changes hands.”However, the Proportional Representation (PR) candidates chosen by seven nationally-recognised parties are set to be certified as elected before preparations for parliamentary party elections. Parties have sent the finalised list to the Election Commission, which will forward them to the President.As much as the FPTP candidates reflected the political leadership’s disregard to field women and minority communities in direct elections, the PR list finalised by parties reflects the status-quo and nepotism of the established parties.The ordinance is proof that the caretaker government is determined to bend Constitution any which way to keep the coalition intact despite some of its members suffering huge losses in elections. Nepal’s traditional politicians, it seems, want to carry on doing what they have always done.Indeed, the PR list has almost entirely filled the 33% constitutional quota for female representation in parliament. It is getting more difficult to agree on a power sharing deal with coalition members who fared badly in the polls.Up for grabs is not just who gets to be minister in the next government, but also the positions of president, chief justice and other constitutional bodies.Nepalis who cast their votes for change are already dismayed that this is reeking like politics as usual, with familiar backroom wheeling dealing and horse-trading.  With 10,560,082 valid Proportional Representation (PR) votes counted, the UML came first  with over 2.8 million popular votes, while the NC got 2.7 million votes. The Maoists and the new Rastriya Swatantra Party (RSP) came third and fourth respectively with over 1.1 million votes each. The royal-right RPP, and the Tarai-based JSP and Janamat have also received enough votes to get PR seats. Only seven political parties will be recognised as national parties in the House, with coalition members CPN-Unified Socialists and LSP failing to cross the 3% vote threshold.  Since neither the coalition nor the opposition have a clear majority of 138 in Parliament, hectic negotiations on government formation and appointing constitutional heads have been going on.For now, the 4-party coalition that carried into both the local and general election seems to have held, but everything is up in the air, and no permutation or combination is being ruled out.On Monday, coalition leaders decided to keep the alliance, although there were grumblings from Maoist leader Pushpa Kamal Dahal that alliance partners did not ‘transfer’ votes to his party as they were supposed to. Smaller Tarai-based parties like the LSP, Nagarik Unmukti and Janamat are also negotiating with the coalition. This would give the coalition a total of 136 seats which is two seats short. There is still the possibility that the JSP, which was allied with the UML, will defect to the coalition.Although the alternative RSP has kept its options open, joining the reviled big parties would be against everything it has stood for. It is more likely that the JSP and the Janamat will be courted by the coalition.“CK Raut may take his Janamat into government because it would help him break into the mainstream which is something he has always wanted,” says political analyst Indra Adhikari. But amid discourse about party alliances and government formation, there are questions as to why it is difficult for parties to achieve a simple majority during elections. Most recently, in 2013, the NC and UML, which were the two largest parties in Parliament, formed an alliance after either party failed to obtain a majority in the polls. In 2017, UML and Maoist Centre merged after the election to become a large leftist alliance. “Our constitutional arrangement doesn’t allow for any one party to come into a majority,” adds Adhikari. “Since our socio-political structure has historically favoured the elite and the influence and political access is limited, power rarely changes hands.”Furthermore, she adds, the PR system which was supposed to reserve 40% of parliamentary seats for excluded groups lessens the possibility of any one party obtaining a majority.What the alternative RSP decides will be important, even as the rightwing RPP says it wants to stay in the opposition. The two parties may look different, but both have an anti-federalist stance. RSP leader Rabi Lamichhane refused to cast his ballot for the provincial assembly on 20 November.Arnico Panday told Nepali Times : “We got a lot of votes because people had high hopes that we would do something. Next time, we will get votes because we will have shown that we get things done.”Only nine out of 225 women who stood for direct elections won seats this time, slightly up from seven women during the last election. Bidya Bhattarai of UML was re-elected in Kaski -2, and young RSP candidates Sobita Gautam and Toshima Karki defeated popular mainstream candidates in Kathmandu-2 and Lalitpur-3. Remaining female MPs will be chosen through the PR closed list to fulfil the 33% parliamentary participation quota.Out of the 225 women, only 25 candidates were fielded by Nepal’s mainstream parties, lending credence to the fact that the political leadership tends to overlook women while fielding candidates for competitive positions. “Women are seen to be less capable in winning elections because they cannot raise campaign funding, do not have connections to big businesses or political contractors,” explains Adhikari.She adds: “Moreover, some of Nepal’s notable female politicians— who could win if they contested direct elections— would rather be elected through the PR system because that guarantees them a seat in parliament as opposed to the possibility of spending money and losing in direct elections.”For now, the coalition partners appear to have been spooked by the strong showing of the RSP and the poor performance of the Maoist and Unified Socialists. But it does not look like they have got the message of voters, or mended their ways. Prime Minister Deuba and Maoist leader Pushpa Kamal Dahal are already haggling over which of the two gets to be PM first under their secret pre-election seat-sharing deal.

Seats of power

The Chief Election Commissar is a busy hombre these days. With the intention of cracking down on violations of the election Code of Conduct, he is tied up firing off  letters demanding explanations from candidates found to be contravening guidelines. In fact, he has been so busy issuing clarifications that he has no time to enforce any of them.In order to help the EC to remind candidates and parties about the dos and don’ts of election campaigning, the Ass assists by recapping below some of the salient points of Clause 46(1) of the Election Commission Act:Don’t: Character assassination on social media is banned with immediate effect. Candidates are advised to also desist from actual assassination of rivals.Do: Under Nepal’s democratic system, mass murderers, plunderers, pillagers, rapists and those accused of other minor offences can campaign openly in broad daylight hours.Don’t: Candidates who have partaken meeting allowances in the past 40 years are barred from either standing or running in elections.Do: Those who have embezzled billions in airport contracts, telecom licenses or in inaugurating highways that never got built may hit the campaign trail along those same non-existent highways.Don’t: It has come to the EC’s notice that a certain candidate wore a baseball cap with his party’s election symbol during a rally in Gorkha-2. The Commissar has asked the candidate in question to furnish an appropriate clarification within 24 hours, failing which the aforementioned cap will be confiscated forthwith.Do: Candidates from the ruling 5-party collision, may be draped with 25 kg marigold garlands provided they are not allergic to pollen.Don’t: The EC takes umbrage at the #NoNotAgain campaign, saying the hashtag contains a double negative that could confuse voters.Do: Even so, established parties are allowed to embellish, exaggerate, falsify, fake, tamper, or lie about their achievements during the last 30 years in office on Facebook and TikTok as long as the jingle has a catchy tune. To set an example, the EC posted on YouTube a melodious song composed by its own talented storekeeper exhorting Nepalis to vote.Don’t: Candidates are not allowed to have stickers with party symbols at the back of the cars that they have hired from Bihar and Uttar Pradesh.Do: But the Firstest Lady is allowed to threaten voters to cast ballots only for a Better Half who flies in on a helicopter.Don’t: Candidates found ringing temple bells will be given a stern warning about noise pollution. If they insist on ringing out the old and ring in the new, they will be rusticated on the spot. Playing madal or other traditional percussion instruments is in contravention of the Election Code of Conduct Article (13), Clause (1) and Sub-clause (d).Do: Parties are allowed to use fleets of Boleros to blare their anthems through loudspeakers. The Co-Finance Minister can take part in a Tharu Peacock Dance even if he is making an ass of himself.

Election dos and don’ts

India and Pakistan are twins separated at birth. Tensions between them have been at a hair trigger ever since independence and has erupted into full scale conflict at least four times in the past 80 years.
The 22 April terrorist attack in Kashmir that killed 25 Indian tourists and a Nepali citizen, threatens to escalate tension between the two nuclear-armed nations. India has squarely blamed Pakistan for the attacks, and Prime Minister Narendra Modi has given his military “operational freedom” to respond. Pakistan has said it has credible intelligence of an Indian military strike and its officials have promised a “full spectrum” response — a code for a <a href="https://nepalitimes.com/editorial/thinking-the-thinkable">nuclear retaliation</a>.
For Nepal, the killing of its national in the Pahalgam attack comes as another stark reminder that in conflicts from Afghanistan to Iraq, from <a href="https://nepalitimes.com/opinion/how-to-agree-an-armistice-in-ukraine">Ukraine</a> to Israel, <a href="https://nepalitimes.com/news/10-nepalis-from-one-town-fighting-in-ukraine">Nepalis are getting caught in the crossfire</a>. The last time full-scale fighting broke out between <a href="https://nepalitimes.com/opinion/peacemongers-at-india-pakistan-border">India and Pakistan</a> on Kargil in 1999, at least 22<a href="https://nepalitimes.com/here-now/india-s-trial-by-fire-for-soldiers-from-nepal?%27%5C%22="> Nepalis fighting for the Indian Army</a> were killed in action.
Three of Nepal’s immediate neighbours (China, India, Pakistan) have nuclear weapons, and they do not have good relations. With China supplying weapons, <a href="https://nepalitimes.com/editorial/war-and-warming">missile technology</a> and other support to Pakistan, this triangular friction could set off a regional conflagration.&nbsp;
<a href="https://www.nature.com/articles/s43016-022-00573-0" target="_blank">Research at Rutgers University</a> has calculated that even a week-long tactical nuclear exchange between India and Pakistan would throw up so much smoke and debris into the atmosphere that it would block out the sun for years, and lead to a collapse of the <a href="https://nepalitimes.com/news/grow-nourish-sustain-together-world-food-day">global food system</a>. This does not take into account the radioactive fallout that prevailing winds would blow up to <a href="https://nepalitimes.com/here-now/lives-on-the-line-in-the-himalaya">the Himalaya</a>, contaminating glaciers that are the sources of <a href="https://nepalitimes.com/here-now/saving-what-is-left-of-himalayan-rivers">Asia’s main rivers</a>.
The impact of <a href="https://nepalitimes.com/news/climate-breakdown-linked-to-thame-flood">climate breakdown </a>on High Asia was already ringing alarm bells about its <a href="https://nepalitimes.com/news/himalayan-icecap-melting-faster-than-thought">shrinking ice cap</a> reducing the dry season flow of water downstream. Water was going to be the next strategic commodity, geopolitical experts warned, and the next wars in Asia would be over water.
That water war is already happening. India retaliated to the Kashmir attack by suspending the <a href="https://www.nytimes.com/2025/04/24/world/asia/india-pakistan-indus-waters-treaty.html" target="_blank">Indus Waters Treaty</a> of 1960 mediated by the World Bank that has withstood at least three wars between India and Pakistan. The treaty gives India control over the three eastern tributaries of the Indus (<a href="https://en.wikipedia.org/wiki/Beas_River" target="_blank">Beas</a>, <a href="https://en.wikipedia.org/wiki/Ravi_River" target="_blank">Ravi</a> and <a href="https://en.wikipedia.org/wiki/Sutlej" target="_blank">Sutlej</a>), while Pakistan got water from the Indus and two of its western tributaries (<a href="https://en.wikipedia.org/wiki/Indus_River" target="_blank">Indus</a>, <a href="https://en.wikipedia.org/wiki/Chenab_River" target="_blank">Chenab</a> and <a href="https://en.wikipedia.org/wiki/Jhelum_River" target="_blank">Jhelum</a>.
Pakistan was assured of 70% of the annual flow, and India could use a reasonable amount of water for<a href="https://archive.nepalitimes.com/news.php?id=15231"> irrigation and hydropower</a>. &nbsp;Within days of its threat, India stopped water flowing down to Pakistan from the Chenab river and is reportedly preparing to do the same on the Jhelum.
The sabre-rattling has reached a crescendo. Besides threats and counter-threats there are also symbolic drills, with the Indian Air Force practicing landing on an expressway in Uttar Pradesh by its Rafale, Su-30 and Jaguar fighter jets to demonstrate ‘operational readiness’. In response Pakistan test-fired its Abdali ballistic missile that can carry a nuclear warhead and has a range of 450km.&nbsp;
The danger is that with ultra-nationalist rhetoric and the beating the war drums by both sides, India’s government and Pakistan’s military may have to ‘do something’ to appease domestic public opinion. But any tactical strike, an artillery exchange, or territorial incursion could quickly escalate out of control.
Expecting an Indian retaliation for the Pahalgam killings, Pakistan is using<a href="https://nepalitimes.com/opinion/interfaith-collaboration-for-nuclear-disarmament"> nuclear deterrence </a>and warning of “catastrophic consequences”. The two neighbours came close to a nuclear exchange in 2019 after an attack on the Indian military in Kashmir, and prompt international intervention led by the United States cooled tensions.&nbsp;
This time, the <a href="https://nepalitimes.com/news/trump-shock-wave-hits-nepal">Trump administration</a> is too distracted and not as engaged. Pakistan has denied it was responsible for the terrorist attack and called on Washington to stop a possible Indian retaliation. India and Pakistan have stopped overflights by each other’s airlines, and some international carriers have even stopped flying over Pakistan fearing an air war.
Washington, Beijing, the UN and the EU have all urged restraint. Iran, which has good relations with both India and Pakistan has sent its foreign minister to urge both countries not to go into a tit-for-tat war. Iran has its own nuclear flashpoint to worry about with tensions in Israel, &nbsp;Yemen and Syria.
India and Pakistan both share similar problems of joblessness, <a href="https://nepalitimes.com/here-now/why-nepal-s-poverty-rate-is-stuck">poverty </a>and <a href="https://nepalitimes.com/here-now/climate-change-new-threat-to-nepal-s-rhinos">environmental threats</a>. Neither side needs the threat of a senseless war, and we in the neighbourhood do not need it either.&nbsp;

Nukes in the neighbourhood

The streets of Patan are alive this month with lavender jacaranda trees under rain-washed skies as <a href="https://nepalitimes.com/banner/the-red-god-rises-again-in-patan">the chariot of Rato Matsyendranath</a> is pulled across town. This is the festival of the rain god, and inevitably the heavens opened up and pre-monsoon showers pelted the chariot as it started being pulled in Pulchok last week. Thousands of devotees, onlookers and the chariot procession organisers thronged the streets on the first day last week. The rhythmic cymbals and drums exuded a vibrant energy as the enormous four wheels turned and the chariot lurched.&nbsp;  <figure> <img src="https://publisher-publish.s3.eu-central-1.amazonaws.com/pb-nepalitimes/swp/asv65r/media/2025051007050_81df97744db16f732a419dc1f1579d235ce3df37642b078f50b83bd4bd026688.jpg" data-media-id="editor_1" data-image-id="2025051007050_81df97744db16f732a419dc1f1579d235ce3df37642b078f50b83bd4bd026688" data-rendition-name="original" width="1000" height="1503" loading="lazy" alt="Divine chariot"> </figure>  The<a href="https://archive.nepalitimes.com/article/Nepali-Times-Buzz/Red-rain-god,3141"> red rain god</a> has Hindu and Buddhist antecedents, alternatively called Bungadya and<a href="https://nepalitimes.com/here-now/kathmandu-s-gravity-defying-chariot-festival"> Karunamaya</a> — reflecting Kathmandu Valley’s syncretic mixture of the two religions.&nbsp; “Bungadya is a profoundly <a href="https://nepalitimes.com/opinion/12-full-opinion/marketing-the-intangible">intangible form of heritage</a>,” explains heritage expert Monalisa Maharjan. “It embodies traditional knowledge,<a href="https://nepalitimes.com/multimedia/reviving-nepal-s-craft"> artisanal skills passed down through generations</a>. Local communities and specific families have specified roles in being custodians of the heritage, ensuring their survival over the centuries.” There are many legends and stories about this annual tradition. Lichhavi king Narendra Dev is supposed to have brought Rato Matsyendranath from Assam to Kathmandu Valley to convince Guru Gorakhnath to lift a spell that created a two-year drought in Kathmandu.  <figure> <img src="https://publisher-publish.s3.eu-central-1.amazonaws.com/pb-nepalitimes/swp/asv65r/media/20250510050520_347a9a398f8a9abc4a7fb4e2774fde8264cccbdce8bdab23851ab3f0e73c3e8a.jpg" data-media-id="editor_6" data-image-id="20250510050520_347a9a398f8a9abc4a7fb4e2774fde8264cccbdce8bdab23851ab3f0e73c3e8a" data-rendition-name="original" width="1503" height="1000" loading="lazy" alt="Divine chariot"> </figure>  Matsyendranath was Gorakhnath’s mentor, and upon seeing him, the serpents were released, unleashing the rains. The chariot festival honours the return of this life-giving rain. The deity is seen as an icon for thriving agriculture, t<a href="https://nepalitimes.com/here-now/before-the-next-monsoon">he arrival of monsoon</a> showers, and the welfare of the community. Patan does not sleep for a month as the chariot is pulled through various neighbourhoods. It unfolds at a state level with the president (formerly the king) attending the climax of the Bhoto Jatra in Jawalakhel later this month.&nbsp; The intergenerational transmission of tradition is unique in the world, and the reason the festival is one of the most vibrant cultural expressions that thrives despite inroads of modernity. The other unique aspect is that it is a transnational festival, binding Patan with Guwahati in the Indian state of Assam.  <figure> <img src="https://publisher-publish.s3.eu-central-1.amazonaws.com/pb-nepalitimes/swp/asv65r/media/2025051005058_8bc685ada13045d863b28e3eed91c931da2b510714586af6fd7eb5d1e298a24a.jpg" data-media-id="editor_9" data-image-id="2025051005058_8bc685ada13045d863b28e3eed91c931da2b510714586af6fd7eb5d1e298a24a" data-rendition-name="original" width="1000" height="1503" loading="lazy" alt="Divine chariot"> </figure>  “Unlike Nepal, where the deity commands grandeur and devotion, many in Assam are unaware of Rato Matsyendranath,” says Khagen Sharma of Gauhati University, which convened <a href="https://nepalitimes.com/news/nepal-assam-connection-revived">a symposium in February in Guwahati on the rain god</a>. Attending was a delegation led by Lalitpur Mayor Chiribabu Maharjan, organisers of the festival, and builders of the chariot. After the symposium, a committee was formed to explore and revive the tradition in Assam as well. Although the team had planned to visit Nepal this month, logistical challenges delayed the trip. Still, there are plans to build a Guru Matsyendranath statue in Assam to reestablish regular worship practices in the Guwahati shrine.&nbsp; The vines used to build the chariot in Patan are sourced from the jungles of Assam. But Sharma notes that in recent years unclear regulations have blocked the official import of the vines, although they are still brought to Nepal informally. The <a href="https://archive.nepalitimes.com/article/Nepali-Times-Buzz/makers-of-machhindranath,2204">chariot making</a> has also had a taste of modernisation in recent times. In the past, even a single nail or piece of steel was avoided. But over time, the wooden structure, particularly the shaft between the wheels, has been replaced with bronze. When that too proved unstable, metal clamps were introduced, which have become a pragmatic compromise.&nbsp;  <figure> <img src="https://publisher-publish.s3.eu-central-1.amazonaws.com/pb-nepalitimes/swp/asv65r/media/20250510050524_b2a819a5791612f14c81d30fc393dbd3f99f0c64b90a9110e8b0855d944bfa93.jpg" data-media-id="editor_12" data-image-id="20250510050524_b2a819a5791612f14c81d30fc393dbd3f99f0c64b90a9110e8b0855d944bfa93" data-rendition-name="original" width="1500" height="998" loading="lazy" alt="Divine chariot"> </figure>  Another welcome change is the focus on safety. Builders climbing the chariot’s tower now wear harnesses and there are efforts in crowd control. The most visible change in recent years has been the involvement of Patan’s enthusiastic youth in the festival — the tradition is now passing to a new generation. Says Matsyendranath expert Vidhu Kayastha: “There is more energy, the young people in red t-shirts this year were very organised, these modern touches aren’t diluting our culture, they’re keeping it alive in new forms.” He adds, “We are <a href="https://nepalitimes.com/here-now/searching-for-a-homeland-away-from-home">reconnecting with our roots</a>, we have more resources, more awareness than ever before. We must not be swept away by western values that may not serve us, and in some ways, cause more harm than good. We must revive our own culture.”&nbsp;

Divine chariot

The discourse around <a href="https://nepalitimes.com/editorial/nepal-s-corruption-carousel">corruption in Nepal</a> is mainly about politicians and bureaucrats accepting bribes and kickbacks. The private sector usually does not get as much blame.
But the prevalent <a href="https://nepalitimes.com/here-now/nepal-s-crony-communism-exposed">climate of cronyism</a> in Nepal means that the politicians and businesses are often hand in glove. The private sector is generally considered to be in favour of free market competition to encourage <a href="https://nepalitimes.com/here-now/nepal-has-to-curb-corruption-before-wooing-investors">investment</a> and innovation so that wealth is generated.
But insider trading, cartelling, and conflict of interest have become a given in Nepal’s private sector, and it all happens with the blessings of the government. In fact, <a href="https://nepalitimes.com/news/the-business-of-politics-in-nepal">tycoons have become legislators and politicians have become businessmen</a>.
“Such collusion kills the free market, and does not allow entrepreneurship and innovation to flourish,” says Kush Kumar Joshi, former president of the Federation of Nepal Chamber of Commerce and Industries (FNCCI).
An example of this is the Dangote Group of Nigeria, which was planning for a cement factory in Nepal. A Dangote executive told us that Nepal’s cement cartel got the government to sabotage their plans.&nbsp;
Earlier, the same cartel tried to do the same thing to the Chinese companies Hongxi and Huaxin, arguing that Nepal’s cement industry was capable of meeting domestic demand and did not require foreign investment. Ultimately, Hongxi partnered with Nepal’s Shivam and Huaxin with former FNCCI president Suraj Vaidya.
In 2019, industrialists successfully lobbied lawmakers to prevent foreign investment in agriculture by amending the Foreign Investment and Technology Transfer Act. Two years later,<a href="https://nepalitimes.com/news/aid-rarely-aids-agriculture-in-nepal"> foreign investment in agriculture</a> was opened, but only if 75% of the products were exported.
There is a long history of local lobbyists obstructing the entry of multinationals, like J Walter Thompson advertising agency and the international shipping company Maersk. Microbreweries, which can be operated by restaurants, have been prohibited at the behest of larger beer companies. The <a href="https://archive.nepalitimes.com/news.php?id=1292">private dairy sector </a>opposed the government-owned Dairy Development Corporation when it tried to begin production in Pokhara a decade ago.
“The<a href="https://nepalitimes.com/news/business-as-unusual?fbclid=IwAR3qEnUrVu9pRhZU669FR1F4zF95uPJKBpbQbq-q1Bm26p7OMVw-8JBP7FU"> business sector</a> is a reflection of Nepali society and government which do not care about <a href="https://archive.nepalitimes.com/news.php?id=6725">ethical business practices</a>,” says former CNI president Hari Bhakta Sharma. “The environment is not conducive to the few businessmen who are honest.”
Lobbying by businesses is not unusual in a democracy, but its basic character should be for the collective good, not individual greed.
“This kind of profit-over-everything mindset is fatal for businesses. Entrepreneurs must prioritise social, worker, and customer welfare,” adds Sharma.
Industrialists have actively lobbied for the removal of policies that prevent loan misuse and require bank loans in specific areas. They have partially reversed such directives.
Until the economic slowdown, Nepal’s fastest growing industry was construction. But even there, cement and steel rod manufacturers colluded by price-fixing. Banker Parshuram Kunwar Chhetri says Nepal’s corporates just do not believe in free market principles, adding: “Their ideas go against competition benefiting consumers. It is all about price fixing, cartels and monopolies.”

Ideologically, Nepal’s Communist parties are supposed to be against the neoliberal free market, globalisation and the ‘imperialism’ of international financial institutions like the World Bank and the IMF. But cronyism is rife there, too.
Two years ago, the FNCCI and the Confederation of Nepalese Industries (CNI) accused the IMF of interfering in Nepal's domestic economic policy after the Fund demanded economic reforms as conditions for its Extended Credit Facility.
Says economic analyst Sujeev Shakya: “How can we expect an honest and ethical business sector when we as a society tend to laud those who earn money through illicit and corrupt means rather than lament their <a href="https://archive.nepalitimes.com/article/editorial/Editorial-moral,667">moral bankruptcy</a>?”
In October 2012, the Chaudhary Group’s CG Electronics warehouse in Kathmandu caught fire. A surveyor certified that the company had suffered Rs580 million damage, which was paid out by United Insurance Company.
The Commission for the Investigation of Abuse of Authority (CIAA) directed the Nepal Insurance Authority to investigate suspected insurance fraud, and found that the fire damage was actually Rs340 million.
The Patan High Court ordered Chaudhary Group to return the excess amount, a decision the company challenged in the Supreme Court. But in March, the apex court also found the Chaudhary Group guilty of insurance fraud.
Chaudhary Group's Binod Chaudhary, Nepal's only known dollar billionaire, is a Nepali Congress central committee member and MP, former president of FNCCI and founder of the CNI.
Then last February, the Central Investigation Bureau questioned Binod Chaudhary and arrested his brother Arun Chaudhary of CG Holdings over their alleged involvement in the illegal acquisition of the state-run shoe factory, following an investigative report by Ukaalo Online.
In 2021, Chaudhary and his family’s offshore business dealings landed them <a href="https://nepalitimes.com/here-now/nepal-s-richest-man-in-the-pandora-papers">in the Pandora Papers list</a> by the International Consortium of Investigative Journalists (ICIJ) for hidden assets in Panama.
Says Krishna Khanal, assistant professor of business ethics at King’s College: “Cronyism, political collusion, and anti-competitive cartelling are routine in the private sector. There is no other objective than to make money at any cost.”
Conflict of interest is rife in Nepal’s share market. In 2023, Ghorahi Cement owned by Triveni Group issued primary shares at a premium price. There is also evidence that a river was diverted for the construction of its business tycoon Upendra Mahato’s Mediciti Hospital. Bhatbhateni owner Min Bahadur Gurung is also involved in Lalita Niwas land grab scam in Baluwatar.
Meanwhile, Shankar Group Vice President Sulabh Agrawal, former honorary consul of Kyrgyzstan, was arrested by the police during the <a href="https://nepalitimes.com/news/nepal-s-uneven-covid-19-deaths">Covid-19 pandemic </a>after he was found selling 67 infrared thermometers from a vehicle with diplomatic credentials. He was later acquitted by the court for price-gouging.
Nepal’s most influential corporates were accused of evading billions in VAT by forcing invoices. Freedom Forum invoked the Right to Information to collect evidence of the involvement of CG Foods, Him Electronics of Shekhar Golchha, Morang Auto Works of Bishnu Agarwal, Sulabh Agarwal’s Jagdamba Steels, United Builders of Shakuntalal Hirachan, United Traders of Anuj Agarwal, and Min Bahadur Gurung’s Bhatbhateni Supermarket.
Most of these businessmen have held leadership positions in the FNCCI. Former FNCCI presidents Shekhar Golchha, Pashupati Murarka and Pradeep Jung Pandey, along with members of the federation's governing council Birendra Kumar Shanghai, Shashikant Agrawal, and others all have unpaid dues of Rs22 billion to Nepal Electricity Authority.&nbsp;
Former FNCCI president Chandiraj Dhakal was blacklisted by the Credit Information Bureau Nepal for non-payment of bank loans.
He had previously obtained permission to use 36 hectares of government forest land in Chandragiri for 40 years without competition, and had received an exemption to build a ropeway there. The 54th report of the Auditor General, stating that Nepal had suffered as a result of these decisions, had suggested that the state be investigated for leasing land at low rates allowing large revenue exemptions.
Another ex-FNCCI president Pradeep Jung Pandey was sentenced to prison in 2014 following a corruption case spanning three decades. Former FNCCI treasurer Gyanendra Lal Pradhan is currently facing charges of <a href="https://nepalitimes.com/news/black-white-and-grey">money laundering </a>through insider trading.&nbsp;
Former FNCCI president Pashupati Murarka was acquitted by the special court in a corruption case, but it is still pending in the Supreme Court. His cement company was found to have exploited the environment by over-mining limestone at various times.&nbsp;
His Siddhartha Minerals was also found to have encroached forests in Palpa, following which the District Forest Office registered a criminal case against him and co-investor Manoj Kedia. Arrest warrants were issued for six people, including Murarka and Kedia, but Muraka was released on bail, while Kedia is on the run.
Current FNCCI president Chandra Prasad Dhakal during his tenure as a member of the Securities Board of Nepal (SEBON) was accused of conflict of interest in being a regulator in the sale of shares in a company that his family had invested in.&nbsp;
Dhakal is the chair of the IME Group, which owns banks, insurance, remittance companies, several cable cars and hotels, and has been embroiled in numerous ropeway-related controversies — most recently for allegedly using political connections to suppress local opposition to a<a href="https://nepalitimes.com/editorial/progress-and-or-preservation"> cable car project in Pathibhara</a>.
Another example of fraud committed in collusion with political leadership is Himalayan Reinsurance, the investors of which include prominent businessmen who have led FNCCI and CNI in the past, including Shekhar Golchha, Pashupati Murarka, Bhawani Rana, Rajesh Kumar Agrawa, Rohit Gupta, Amit Mor, Satish Mor, Shashikant Agrawal, and Sulabh Agrawal.
During <a href="https://nepalitimes.com/here-now/lessons-not-learned-from-the-pandemic">the Covid-19 pandemic</a>, the Nepal Insurance Authority requested approval for a reinsurance company through an emergency notice, even though such a government-operated company already existed. But Himalayan Re-insurance was granted permission without any explanation as to why another reinsurance company was needed, or how it was selected out of the five companies that submitted proposals.
It was found that the Securities Registration and Issue Regulation was amended to allow this company to issue shares at a premium price, allowing the shares priced at Rs100 to be sold for Rs206. Himalayan Re-insurance raised Rs6 billion. The Companies Act stipulates that primary shares can be issued at a premium price only after three years of operation, a criteria Himalayan Re-insurance did not fulfil.
Open competition, consumer protection, worker welfare, environmental consciousness, anti-corruption, and tax responsibility are the foundations of a country’s healthy business world. But most captains of Nepal’s industry themselves do not uphold those principles.
The business community here is instead actively engaged in lobbying and colluding with the political leadership, and forcing the appointment of their candidates to lead various regulatory bodies.&nbsp;
“While the <a href="https://nepalitimes.com/multimedia/reviving-nepal-s-craft">new generation of entrepreneurs</a> operating in sectors linked to external markets such as IT seem sensitive to and compliant with professional codes, ethics, professionalism, and honesty are sorely lacking in Nepal’s business sector in general,” says Rameshore Khanal, former Secretary of the Ministry of Finance.
He adds: “Even those following ethical practices have been forced to seek political favours for fear of being left behind. There will thus be<a href="https://nepalitimes.com/banner/it-does-not-pay-to-have-integrity"> no integrity in the private sector </a>until there is honesty in politics.”
Following the publication of this report in Himalkhabar, a Supreme Court judge on the condition of anonymity said: “Businessmen do not adhere to the principles of judicial independence, <a href="https://nepalitimes.com/opinion/federalism-rule-of-law-and-the-judiciary">rule of law </a>and <a href="https://archive.nepalitimes.com/article/editorial/government-to-governance-editorial,4200">good governance</a>. They use intermediaries and political connections to approach judges and win cases. Meanwhile, nobody raises these issues in public.” &nbsp;

Nepal's only growth industry: private sector corruption

This is the 67th episode of Diaspora Diaries, a Nepali Times series in collaboration with Migration Lab providing a platform to share experiences of living, working, and studying abroad. <h2>Alpana Adhikari, UK</h2> Back in Nepal, I had worked as a nurse for a decade, but I had my heart set to go overseas. My reason for wanting to migrate, however, was a bit different as it was for my son. He has a disability, and considering his situation from multiple perspectives—including societal attitudes, the preparedness of schools, and the availability of facilities for individuals with his condition—Nepal did not feel safe for my baby.&nbsp; I had to migrate, no matter what, for his sake. The facilities here in the UK for children with his condition are significantly better, and I am glad he and my husband will join me in a few months.&nbsp; I was applying via private routes like everyone else when the Government to Government pilot program between Britain and Nepal was announced. The G2G scheme was unique as we were treated with dignity and valued for our skills: they covered costs for the ticket and visa, reimbursed us for exams we had taken and costs involved in the preparation and testing of the Objective Structured Clinical Examination were also covered.&nbsp; I started work in March last year, and currently am based in the respiratory ward of a hospital. I am enjoying my work a lot. In one year, I have received 26 WOW nominations which are notes of appreciation from patients we have served. ‘Alpana is one of the kindest nurses I have seen. Awesome and talented … always smiling, never appears tired and helps everyone,’ one patient testimonial said. Another: ‘You can see clearly that she cares about her patients…She was cool amidst great stress and ALWAYS with a smile which gave me confidence.’ I am also the International Educated Nurses Advocate which means I can raise issues with management about issues facing international nurses here.&nbsp;  <figure> <img src="https://publisher-publish.s3.eu-central-1.amazonaws.com/pb-nepalitimes/swp/asv65r/media/20250511160536_87b959c7550bbd1272ebf840d9f24735db008307ad825e4aa15e66c1662a7fd4.jpg" data-media-id="editor_1" data-image-id="20250511160536_87b959c7550bbd1272ebf840d9f24735db008307ad825e4aa15e66c1662a7fd4" data-rendition-name="original" width="1590" height="1600" loading="lazy" alt="DD 67"> <figcaption>One reason Alpana Adhikari migrated to the UK was so there would be better facilities for her son, who has a disability. </figcaption> </figure>  Recruitment from NHS linked hospitals is free but when we migrate through private routes, agencies either charge upfront costs or in some cases, there is wage deduction once the nurses start earning.&nbsp; I have met Nepalis who have paid up to Rs 1 million for the same job. These costs can go even as high as Rs3 million for work in caregiving or nursing homes. I am lucky not to have to pay anyone for my posting.&nbsp; But beyond costs, I think there is also a reputational advantage of coming through the government selection process at the hospital. Such programs need to be expanded more because nurses are migrating anyway and it would save people a lot of unnecessary costs and hassles. I will always be protective about Nepal and am grateful for the experience I gained, but it is true that nurses lack dignity in the workplace back home. Nursing is laborious work and completing the education takes a fortune but the pay for nurses in Nepal, other than at a handful of hospitals, is unfairly low.&nbsp;  <figure> <img src="https://publisher-publish.s3.eu-central-1.amazonaws.com/pb-nepalitimes/swp/asv65r/media/20250511160540_2a483361070e6e65413cf3bcf3be7af0581044f85c3e6da25a66dc87042af9d9.jpg" data-media-id="editor_2" data-image-id="20250511160540_2a483361070e6e65413cf3bcf3be7af0581044f85c3e6da25a66dc87042af9d9" data-rendition-name="original" width="2048" height="1536" loading="lazy" alt="DD 67"> <figcaption>Alpana Adhikari while working as a nurse in Nepal.</figcaption> </figure>  It naturally makes nurses want to migrate. People often ask me what the difference in the UK and Nepal is. Work is similar but in terms of technology, there is less paperwork here as everything is digitised. Treatment is also more nurse-led and we have more say while making recommendations about medicine and discharging decisions which can be empowering. I am not sure what it is about nursing but I am always in high spirits and energetic about showing up to work every day. To be a good nurse, you have to have the passion for patient care.&nbsp; Sometimes people tell me it is because my family has not yet joined me which has freed up my time to singularly focus on work, but I do not believe that is true. It is not just about the income. Sometimes after long hours at work when it has been a particularly busy day, a phone message from my manager and colleagues appreciating me for a job well done can go a long way.&nbsp; Likewise, the WOW recommendations from my patients have boosted my confidence. One of my elderly patients who had a mental illness and I bonded, and she felt comfortable enough to open up with me. She would then refer to me as her friend with everyone.&nbsp; It is little things like this that can make a big difference. I had previously come to Japan as a language student as well.&nbsp; I grew up in Ghandruk and had just started my Bachelor’s course when a friend suggested we try to go to Japan so I just followed the trend and stayed here for three years as a student.&nbsp; Two years after returning to Nepal, I re-migrated to Japan under the SSW scheme which was at its early stages and only open to nursing initially.&nbsp;  <figure> <img src="https://publisher-publish.s3.eu-central-1.amazonaws.com/pb-nepalitimes/swp/asv65r/media/20250511160536_305bb5cb5095da6148911dae8b07356ece5b292148e6c8e57a39fd31d811624b.jpg" data-media-id="editor_4" data-image-id="20250511160536_305bb5cb5095da6148911dae8b07356ece5b292148e6c8e57a39fd31d811624b" data-rendition-name="original" width="720" height="960" loading="lazy" alt="DD 67"> <figcaption>Binu Gurung on arrival in Japan to work as a nurse three years ago.</figcaption> </figure>  I take care of the elderly Japanese who are mostly above 80 years of age, a few even above 100. I try not to get too attached to patients but it is of course not always easy because of the nature of the job and patients we serve.&nbsp; Patients dying of age is common as it is not a care facility where patients recover to return to their homes. Just recently, an elderly lady who had been here from the day I joined 5.5 years ago passed.&nbsp; These leave you a bit खिन्न and emotionally drained. Most are dementia patients who do not &nbsp;even recognise their family members. That is why some nurses who come to Japan because they want to just migrate overseas at any cost without considering the kind of employment realise that caregiving might not be for them.&nbsp; You have to be mentally, physically and emotionally prepared for it. If you are short-tempered by nature, for example, it may not be the best fit. However, for those who are genuinely interested in care work like I am, there are many growth opportunities in nursing which are also financially rewarding.&nbsp; While working under the SSW visa, I was able to take training classes on the side and passed the national exam for nursing. I was then able to change my visa from SSW to nursing caregiver visa. My son joined my husband and I recently in Japan and has started school.
