This year’s World Press Freedom Day on 3 May falls during COVID-19 lockdowns in many of our countries. Restriction on movement means journalists all over the world are facing obstacles in getting interviews and data, and verifying stories before publishing.In addition, the global pandemic has been used by many governments to control not just the people’s movement but also their right to information. Journalists have been intimidated or attacked, and photojournalists and videographers on the frontlines often risk getting infected while documenting stories.<a style="font-size: 15px; letter-spacing: 0.01em;" href="https://www.nepalitimes.com/editorial/lockdown-crackdown/" target="_blank" rel="noopener noreferrer">Lockdown Crackdown</a>, EditorialTwo recent webinars conducted by Global Investigative Journalism Network (GIJN) and Finance Uncovered (FU) showed that recent government moves to restrict the press in Nepal are not unique – they are happening in many countries around the world.There have been efforts by authorities to criminalise journalism, and this is putting journalists reporting on the pandemic at risk, noted Courtney Radsch of the Center to Protect Journalists at the GIJN webinar. In Nepal, too, there have been <a href="https://www.nepalitimes.com/editorial/lockdown-crackdown/" data-saferedirecturl="https://www.google.com/url?q=https://www.nepalitimes.com/editorial/lockdown-crackdown/&amp;source=gmail&amp;ust=1588303395047000&amp;usg=AFQjCNE0w7-uF8_CXAUiqOy9AfnGn8Y2Rg">attempts by various government agencies to censor information. </a><figure><img src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221109121124/636b8dd29c7e80680e06b36cjpeg.jpg" alt="" width="746" height="560"/><figcaption>Photo: MIN RATNA BAJRACHARYA</figcaption></figure>Last month, the portal <a href="http://www.kathmandupress.com/" data-saferedirecturl="https://www.google.com/url?q=http://www.kathmandupress.com/&amp;source=gmail&amp;ust=1588303395047000&amp;usg=AFQjCNHevp5RQMt3kOoZW-Z80WS2OffnTg">Kathmandu Press posted a story</a> about alleged corruption during the purchase of medical equipment involving people in high places. This story was deleted from the site by a software company maintaining the portal’s homepage which had links to individuals in the Prime Minister’s Office involved in the deal.On 27 April, Radio Nepal aired a live interview of former prime minister Baburam Bhattarai that was sharply critical of Prime Minister K P Oli. The government asked the head of the state-owned radio station and its news editor for an explanation, and got the interview deleted from Radio Nepal’s site.On 18 April, Press Council Nepal (PCN) sent a letter to Nepal Telecommunication Authority to shut down certain web-based portals and ban them from publishing false news. In all these recent cases, the government appears to be using the cover of the COVID-19 crisis and the excuse of protecting privacy and shielding the public from fake news and character assassination to crackdown on the free press.“Many supposedly democratic countries like the United States, India and Nepal are censoring the press and making it very difficult for press freedom to prevail while covering COVID 19,” said <a href="https://www.nepalitimes.com/latest/in-locked-down-nepal-print-is-still-king/" data-saferedirecturl="https://www.google.com/url?q=https://www.nepalitimes.com/latest/in-locked-down-nepal-print-is-still-king/&amp;source=gmail&amp;ust=1588303395047000&amp;usg=AFQjCNGhb3EiYv_dsV9Zmyy4FohVmEadqA">Kosmos Biswokarma editor of Kathmandu Press</a>. Tampering with the website without permission raised grave questions of freedom of press in this country, he added.The mission of journalism is to use the citizens’ right to freedom of expression to keep them informed. Journalists go to great lengths, and put themselves at considerable risk, to gather and investigate factual information to alert the public and authorities about wrong-doing and malpractice.However, citizens today get their information not just from the mass media but also from the Internet. The dissemination of fake news, rumours, defamation, violation of privacy on social media is not journalism. Governments should make that distinction.The authorities should not mistake misinformation for journalism, and not use objectionable social media content for blanket suppression of journalistic information. There has to be a mechanism to track such content and take action against perpetrators. It is the Press Council Nepal’s job to trace these sources, and not issue directives to ban portals. In fact it is not the PCN’s job to close down the media at all.During emergencies like the COVID-19 pandemic, due diligence rules are relaxed and there is a lack of transparency in big deals. Because it is the journalist’s job to speak truth to power, this often gets them into trouble, as happened in Nepal with the coverage of the <a href="https://www.nepalitimes.com/latest/nepal-to-test-covid-19-test-kits-from-china/" data-saferedirecturl="https://www.google.com/url?q=https://www.nepalitimes.com/latest/nepal-to-test-covid-19-test-kits-from-china/&amp;source=gmail&amp;ust=1588303395048000&amp;usg=AFQjCNHDyxZuQKhAZpSJr9rwB_DeXQd1Bw">Omni Business Corporate International</a> in the direct purchase of test kits and medical equipment from China at inflated cost.Shiva Gaunle of the Centre for Investigative Journalism Nepal (CIJ-N) says the biggest problem journalists are facing during the present crisis is getting data and verifying them. “It is not just the lockdown and restrictions on mobility, news items are taken off home pages or shut down, how can Nepal claim to have right to information and rule of law?” he asks.Journalism is not a crime, and fake news is not journalism. But there are signs the party may have A Plan. That all along, it has been aiming not for ‘stability and prosperity’, but for the <a href="https://www.nepalitimes.com/here-now/spooking-nepalis-by-snooping-on-them/" target="_blank" rel="noopener">extension of control</a>, the <a href="https://www.nepalitimes.com/editorial/rule-by-law/" target="_blank" rel="noopener">stiffling of dissent</a>, the intimidation of critics, the <a href="https://www.nepalitimes.com/banner/gagging-the-press-in-installments/" target="_blank" rel="noopener">muzzling of the media</a> and the constriction of civil society. There may be a <a href="https://www.nepalitimes.com/here-now/which-way-nepali-politics-in-2020/" target="_blank" rel="noopener">power struggle at the top</a> between Prime Minister Oli and his comrade Pushpa Kamal Dahal, but on matters of control and domination the party has <a href="https://www.nepalitimes.com/here-now/one-body-two-heads/" target="_blank" rel="noopener">one body with two heads</a>.The Cabinet has zero accountability and no performance evaluation. Instead, ministers regularly threaten critics with crude scare tactics. They take their cues from Prime Minister Oli, who last week accused editors in the Nepali media of being “without hearts”. It is true that the criticism of Oli across a broad-spectrum of the national media over <a href="https://www.nepalitimes.com/here-now/the-business-of-politics-undermines-nepals-democracy/" target="_blank" rel="noopener">his dealings with the Yeti Group</a> has been relentless, but we have received no satisfactory explanation of why the consortium gets preferential treatment in leases of former royal property by the Nepal Trust.The government’s actions over the past two years may seem ad hoc and haphazard, but taken together there appears to be a method to the madness. Let’s take the <a href="https://www.nepalitimes.com/banner/no-speaker-no-parliament-in-nepal/" target="_blank" rel="noopener">sidelining the NCP’s own Shivamaya Tumbahangphe</a> and the bullheaded approach to replace a <a href="https://www.nepalitimes.com/banner/the-rise-and-fall-of-comrade-mahara/" target="_blank" rel="noopener">rape-accused Speaker</a> with a murder-accused Speaker. If we had to cite just one example of why there is <a href="https://www.nepalitimes.com/latest/getting-away-with-murder/" target="_blank" rel="noopener">impunity and blatant flouting of the rule of law</a> in this country, the appointment of <a href="http://archive.nepalitimes.com/blogs/thebrief/2011/05/31/hearing-set-for-case-against-minister-agni-sapkota/" target="_blank" rel="noopener">Agni Sapkota</a> to the post of Parliament Speaker is it.Read also: <a href="https://www.nepalitimes.com/banner/no-speaker-no-parliament-in-nepal/" target="_blank" rel="noopener">No Speaker, no Parliament in Nepal</a>, Sewa BhattaraiEver since the end of the conflict 14 years ago, the Maoists, the UML, NC and the security forces have been <a href="https://www.nepalitimes.com/banner/yesterdays-enemies-todays-comrades/" target="_blank" rel="noopener">partners in crime</a> in sweeping their combined <a href="https://archive.nepalitimes.com/article/editorial/state-of-impunity,2976" target="_blank" rel="noopener">wartime atrocities</a> under the carpet. Families of the victims and survivors of the war demand justice and truth, but every government since 2006 has tried to rig the <a href="https://www.nepalitimes.com/banner/12-years-later-justice-is-a-mirage/" target="_blank" rel="noopener">transitional justice</a> mechanism, and not a single perpetrator has been brought to trial. In fact, perpetrators get to lead Parliament.Agni Sapkota is accused of murdering <a href="https://www.himalkhabar.com/news/111027" target="_blank" rel="noopener">Arjun Lama, an activist of the UML</a>, in Kavre in 2005. The irony of it all is that the UML and the former Maoists are now unified in the Nepal Communist Party. After years of struggling for justice for her husband, Purnimaya Tamang finally told this paper this week: “I have lost all hope for justice now.”Pushpa Kamal Dahal may have been technically right in stating last week in Chitwan that he was responsible for the deaths of “only” 5,000 of the 17,000 people killed during <a href="https://www.nepalitimes.com/latest/nepals-transition-to-peace-needs-justice/" target="_blank" rel="noopener">the conflict</a>. But who is keeping count? If this vulgar non-repentance rattled many Nepalis, imagine what it did to the families of the disappeared and the survivors of that terror-filled decade.One of the provisions of the Comprehensive Peace Accord signed in 2006 was the establishment of a <a href="http://archive.nepalitimes.com/regular-columns/One-To-Many/victims-waiting-for-justice,698" target="_blank" rel="noopener">Truth and Reconciliation Commission (TRC) and a Commission for Investigation on Enforced Disappeared Persons (CIEDP)</a>. But all governments since have conspired to make these commissions ineffectual by appointing party loyalists to their senior positions so that no one ever has to answer for war crimes. This week, the NCP and NC appointed new handpicked commissioners to the TRC and CIEDP.Aside from transitional justice, the NCP has been trying to dismantle just about every sector in which Nepal has done well. There are <a href="https://www.nepalitimes.com/from-the-nepali-press/taking-away-forests-from-communities/" target="_blank" rel="noopener">attempts to dilute the laws</a> governing <a href="https://www.nepalitimes.com/banner/who-now-owns-nepals-forests/" target="_blank" rel="noopener">community forestry</a>. Pushpa Kamal Dahal hinted in Madi last week that he intended to change the by-laws governing Chitwan National Park. Under pressure from the fossil fuel lobby, the Finance Ministry is said to be thinking of scrapping <a href="https://www.nepalitimes.com/banner/nepals-electric-transport-future-is-here/" target="_blank" rel="noopener">the tax rebate on electric vehicles</a>. And this week, the Home Ministry was reported to be drafting a new Social Organisations Act which will allow it to close down non-government organisations it does not like.Taken together, it is not hard to see what the NCP has been working hard to do in the past years. In an Orwellian sense, when the party said ‘stability’, it always meant ‘control’.<h2>10 years ago this week</h2>...The <a href="http://archive.nepalitimes.com/news.php?id=16728" target="_blank" rel="noopener">analysis by Ashutosh Tiwari</a> in <a href="http://archive.nepalitimes.com/issue/486" target="_blank" rel="noopener">issue #486 of 22-28 January 2010</a> shows us how the power centre may have shifted in the last ten years, but the lust for power among our political leaders remains the same. As two Communist alpha males continue to battle it out in the ruling NCP, the latest casualty is the post of Speaker, with the sidelining of Shivamaya Tumbahangphe in favour of a murder-accused candidate: Even accounting for politicians’ lust for power, what’s wrong with our particular democratic structure that keeps on returning the same old politicians to power no matter how many Roman numeral andolans we have?On the outside, our system has the requisite avatar of a democracy (multiple parties, elections, political horse-trading, etc). Dig deeper, and you will find that it’s not the voters who call the shots but the party leaders, who have designed their parties’ internal structures in such a way as to keep them in power for as long as they live. THE TWO - YEAR ITCH

<img width="1050" height="751" src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221108151124/636a676c9c7e80680e0599d8jpeg.jpg" alt=""/>On 11 December, the Prime Minister and Cabinet's office tabled the 'bill to amend and integrate laws relating to the constitution and operation of Nepal special service' in the parliament secretariat.Prakash Panta, member of the National Assembly from the opposition Nepali Congress has requested the parliament to take the Special Service Bill (SSB) back. With allegations that the bill restricts the fundamental rights of citizens, there is concern that provisions of SSB will violate citizens’ fundamental right to privacy.NC parliamentarian Radheshyam Adhikari says this is a direct threat to  citizens' fundamental rights like privacy and freedom. "This bill shows that the government is against democracy and an open society, and does not believe in transparency and accountability. It will allow the government to snoop on anyone it does not like, and use the information to threaten or blackmail them.”Read also: <a href="https://www.nepalitimes.com/editorial/censuring-censorship/" target="_blank" rel="noopener">Censuring Censorship</a>, Editorial The SSB will allow the National Investigation Bureau (NIB) to collect any information on anyone without a warrant. The Act's Section 10, subsection 6 states: ‘In the course of information collection or counterintelligence, the Bureau can monitor, intercept, or record the conversations of people or organisations under suspicion or monitoring, made in public, or through any other audio visual or electronic medium.’The Bill also defines interception as the act of monitoring communication channels and gathering data. Though the Bureau has in the past spied on individuals, it is not authorised by law to do so. Now, the bill gives it the right.The Bill makes it compulsory for people to give up any information an  investigation officer requires, and if they refuse the investigators can acquire the information by spying on them if necessary.Read also: <a href="https://www.nepalitimes.com/opinion/nepal-has-press-freedom-but-no-freedom-after-press/" target="_blank" rel="noopener">Nepal has press freedom, but no freedom after press, </a>Shashank GautamCritics say this has created the fear of misuse and breach of privacy in the name of investigation. It could also lead to leakage of information and violate fundamental freedom in direct contravention of the constitution.Article 8 of the Constitution states that information regarding a person’s residence, property, documents, statistics, correspondence, or character, cannot be violated unless otherwise required by law.Former Chief Justice Kalyan Shrestha says the bill increases the chance of misuse of power. "There should be clear provisions about where the right to privacy can be breached with monitoring and where it cannot. And there should also be provisions for legal redress if someone's privacy is breached when the government uses this right," he says.Read also: <a href="https://www.nepalitimes.com/banner/gagging-the-press-in-installments/" target="_blank" rel="noopener">Gagging the press in installments</a>, Sewa Bhattarai Constitution expert Bipin Adhikari goes further, stressing that the law will endanger the country’s democratic polity itself. "A person at the highest level of government may use these provisions to undermine the system itself," he says, referring to how the former king Gyanendra Shah used Article 123 to take power.There is also precedent set by the former head of the Centre for the Investigation of the Abuse of Authority Lokman Singh Karki, who in 2013 operated a state within a state and regularly tapped the phone calls of 293  critical politicians, security officers, civil society leaders, judges and journalists. When Parliament decided to impeach him in 2016, the phone tapping was prominent in the list of reasons.However, there are some who say the danger to democracy has been blown out of proportion. The former head of the National Investigation Bureau Deviram Sharma says, "This law is not meant to snoop on ordinary citizens' phone conversations. It intends to monitor terrorism, antinational activities,  and the activity of dubious foreigners. A draft of the bill was actually prepared 17 years ago, and it has been tabled with timely amendments."Read also:<a style="background-color: #ffffff; font-size: 15px; letter-spacing: 0.01em;" href="https://www.nepalitimes.com/latest/nepal-undermining-free-expression-hrw/" target="_blank" rel="noopener"> Nepal undermining free expression: HRW</a>In fact, the draft bill does state that the law is needed to control ‘spying, armed insurgency, coup, inciting others to violence, aiding foreign countries or organisations, breaching the harmony between people of different classes, races, ethnic groups, religions and communities, secessionism, spreading hate and violence, armed and underground groups, illegal activities on border areas, etc.’But that is precisely what worries rights activists, who say that the definition of whom the state is allowed to spy on is so vague and broad that anyone in authority can use it to snoop on political or business rivals, the media or critics of the government.Government across the world have intelligence agencies that are given powers to spy on their own citizens, but these powers are strictly limited by law. Even so, some democratic states like India, the US and UK have made it  easier for intelligence agencies to spy on their citizens, especially when it comes to terrorism. But the Panchayat system collapsed, and with it the first attempt to allow the government to spy on its citizens.The law was discussed again during the Maoist war, and a draft was even drawn up in 2001, but it was not tabled. Even today, snooping on private citizens is barred by law, but that has not stopped the National Investigations Bureau and others to snoop on calls and messages.Security agencies in Nepal regularly use call/sms data in their investigations, which is actually illegal. Some have even made private information public. After Advocate Baburam Aryal and four others filed a case against the practice in February 2016, then Chief Justice Kalyan Shrestha and judge Devendra Gopal Shrestha had ruled that a person's right to privacy was "entirely private and fundamental" and limited the practice.Read also:<a style="background-color: #ffffff; font-size: 15px; letter-spacing: 0.01em;" href="https://www.nepalitimes.com/latest/ifj-asks-nepal-to-revoke-media-gag/" target="_blank" rel="noopener"> IFJ asks Nepal to revoke media gag</a>The verdict stated that since there was no law which allowed security officers to tap phone calls or look at sms, the officers would have to take permission from the District Court before doing so."That is a temporary provision. In the long term, there needs to be balance between individual's right to privacy and the state's need to investigate. A full-fledged law is the permanent solution," says ex-Chief Justice Shrestha.The NIB was previously under the Home Ministry, but in February 2018 it was brought under the purview of the Prime Minister’s Office and Cabinet Secretariat. Although the Bureau’s main duty is to safeguard national security,  the proposed bill expands its area of work to include human trafficking, drug trafficking, illegal wildlife trade. Read also:<a href="https://www.nepalitimes.com/editorial/a-creeping-coup/" target="_blank" rel="noopener"> A creeping coup,</a> Editorial"The objective of the Bureau is to protect the national interest. Giving it unlimited powers increases chances of misuse, especially since departments under the PMO are not accountable to any other government department," says Hemanta Malla, former DIG of Nepal Police.There is still time for parliamentarians to debate the Bill and change its provisions if required, but the government appears to be intent on using its majority in Parliament to ram it through. Experts say the bill should have provisions for legal redress, and provisions against transfer or sale of information collected. NC MP Radheshyam Adhikari concludes: "The way it is reads now, it lets the government pry into people's lives, intimidate them and threaten to disclose their private details if they don't obey." "The government is pushing through a law that is above the constitution. The law will grant extraordinary powers to the Bureau any time, which are to be used only in emergencies. But there is not enough awareness in civil society about this. Yes, security forces should have powers, but there should also be check and balance. The law should provide for investigation of the Bureau, as government investigation will not be enough." <figure><img width="640" height="516" src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221108151124/636a676e9c7e80680e0599d9jpeg.jpg" alt=""><figcaption> </figcaption></figure><figure><img width="640" height="514" src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221108151128/636a67719c7e80680e0599dajpeg.jpg" alt=""><figcaption> </figcaption></figure>"The Bill is meant to restrict undue activity from foreigners. For example, then chief secretary of the government Lilamani Pudel made a 9-point code of conduct about officers meeting foreigners. That angered them. Baburam Bhattarai had promised to not transfer any secretaries, but transferred one of them within 18 days of becoming PM. We need to stop this kind of meddling. The current protests against the Bill is instigated by such foreigners."

Spooking Nepalis by snooping on them

Photo: SUVRA KANTI DAS</figcaption></figure>On Day of the Imprisoned Writer 2018, Indian author <a href="https://www.nepalitimes.com/latest/arundhati-and-shahidul-write-to-each-other/">Arundhati Roy penned an open letter to Shahidul Alam</a>, the renowned Bangladeshi photojournalist who had been incarcerated for over 100 days. ‘Dear Shahidul,’ Roy wrote, ‘I believe the tide will turn. It will. It must. This foolish, shortsighted cruelty will give way to something kinder and more visionary.’Shahidul Alam replies in his book, The Tide Will Turn, a photography and text collection lovingly named after Roy’s letter. Combining sketches from fellow inmates, historical work by Bangladeshi photographers, reflections and political commentary, The Tide Will Turn does more than document Alam’s time in jail and his views: it serves as a curated collection of political art and writing, acting as a critique of autocracy.Alam was arrested and detained on 5 August 2018, shortly after a televised Al-Jazeera interview where he criticised Bangladesh's Sheikh Hasina government for its response to protests by young students demanding road safety. The months after saw a worldwide campaign for his release with mass exhibitions, petitions, demonstrations and letters from prominent figures. <figure><img width="1698" height="1254" src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221108151116/636a65609c7e80680e059926jpeg.jpg" alt=""><figcaption> </figcaption></figure>In Nepal, journalists and students <a href="https://www.nepalitimes.com/latest/freeshahidulalam/">protested in front of the Bangladesh Embassy</a> in Kathmandu and lit up the city’s walls with projections of quotes and photographs by Alam during the visit to the Nepal capital by Sheikh Hasina for a South Asian leaders’ summit.Alam, still imprisoned, was awarded the <a href="https://www.nepalitimes.com/banner/shahidul-alam-photo-kathmandu-award/">Photo Kathmandu Award of Excellence</a> on 26 October 2018, both to celebrate the immense impact he has had on generations of Nepali journalists and photographers and as a clear sign of solidarity with one of South Asia’s most prominent photojournalists.‘There is a Bangla saying – “Apnake dhonnobad janie choto korbo na” (I will not belittle you by thanking you),’ Alam writes in his preface. ‘This book is my way of making amends.’Alam dedicates the first part to the prisoners in Keraniganj Jail in Dhaka. Without a camera to document his stay, he uses vivid writing to capture images of his detainment: the surroundings, the guards, his inmates and their stories, and the sparrows he made friends with.The chapter also includes notes, sketches, a mural and even a radio made by inmates who were concerned that Alam ‘a journalist, did not have access to news’. The chapter can almost be read as a standalone, a poignant reflection on <a href="https://www.nepalitimes.com/banner/shahidul-alam-100th-day-in-jail/">his 107-day incarceration</a>.The longest section of the book provides a detailed historical commentary on Bengali photography, touching on artists who have captured some of the most striking images to come out of Bangladesh, as well as on Alam’s own work. With photospreads of select iconic images, the chapter also makes for a stunning collection of Bangladeshi art over a century.The third section of The Tide Will Turn centres entirely on Bangladeshi politics. Alam uses the 1971 Liberation War as a starting point to discuss identity, secularism and the failures of the government, detailing his own experience with the 2013 Dhaka garment factory collapse and the killing of Bangladeshi-American secular blogger Avijit Roy. There is an underlying critique of autocracy running through the book, but it is this chapter that really reveals to us <a href="https://www.nepalitimes.com/banner/the-death-of-democracy/">Alam’s commitment to free speech and democracy</a>.The Tide Will Turn is best summed up by Alam himself in his letter to Arundhati Roy: ‘The tide will turn, and the nameless, faceless people will rise. And despite the government shelving it, <a href="https://www.nepalitimes.com/editorial/own-worst-enemy/">tens of thousands of people poured into Mandala Square</a> on Wednesday in an unprecedented show of force. They wanted the Guthi Bill to be scrapped and ministers who have made disparaging remarks to be sacked.Read also:<a href="https://www.nepalitimes.com/editorial/towards-a-police-state/">Towards a police state</a>, Editorial<a href="https://www.nepalitimes.com/banner/rift-in-nepals-ruling-party/">Rift in Nepal's ruling party</a>, Kunda DixitConspicuous by his silence in all this is NCP co-chair and <a href="https://www.nepalitimes.com/banner/rift-in-nepals-ruling-party/">impatient prime minister-in-waiting</a> Pushpa Kamal Dahal. He seems to be <a href="https://www.nepalitimes.com/here-now/the-ship-of-state/">letting Oli stew in his own juice</a>. The government tried earlier to squeeze the press with the Media Council Bill, but that too backfired badly. Indeed, Oli has centralised so much power in himself that when things go wrong, like now, he has to take the flak.It is not just the new laws that have badly exposed the government’s intent. Nearly two years into its tenure, the ruling party made up of former UML and Maoists has little to show for itself. Laws concerning local governments are in limbo, creating uncertainty over jurisdiction and decision-making.Says advocate Radheshyam Adhikari: “We see the government go from one blunder to the next, and it begs the question of whether the Prime Minister is in charge.”It is hard to see what Oli can do now except take recourse in a cabinet reshuffle. A cabinet face change is a time-honoured, time-buying tactic of Nepal’s rulers, and that could be his next move.

Nepal PM stirs hornet’s nest

Their modernistic, martial moves would not look out of place in a tv reality show. But the lyrics tell a different story:It is time to sharpenthe shining khukri againThis YouTube video clip shows members of the Samana Cultural Group affiliated with the Biplav faction continuing where the mainstream Maoist party left off after the ceasefire in 2006.https://www.youtube.com/watch?v=Vpqh0qAN72sSongs like these were hits during the insurgency, when Maoist propaganda units toured the country performing and mustering public support for the revolution. In many places, it worked.But even though Nepal has gone from war to peace, from <a href="https://archive.nepalitimes.com/article/nation/nepal-from-royal-to-republic,3736" target="_blank" rel="noopener noreferrer">monarchy to republic</a>, and many of the performers have either migrated for work overseas or turned to other professions, members of the <a href="https://www.nepalitimes.com/here-now/its-a-crime-not-to-call-it-terrorism/" target="_blank" rel="noopener noreferrer">Biplav faction</a> are still singing to show that the revolution continues.The tradition of revolutionary songs did not begin with the Maoists. Ranudevi Adhikari, the first female voice on radio, sang songs against the <a href="https://archive.nepalitimes.com/article/Nepali-Times-Buzz/the-rana-reign-a-recap-of-history,3751" target="_blank" rel="noopener noreferrer">Rana regime </a>that were broadcast from clandestine stations in 1949. One of them went:                Nepali, Nepali,                Let’s march forward                with the flag of revolution in our handsThe genre came to be known as janabadi, and the songs were revived during the Panchayat when four youngsters, Raamesh, Raayan, <a href="http://archive.nepalitimes.com/news.php?id=3643#.XQtmIhYzaUk" target="_blank" rel="noopener noreferrer">Manjul </a>and Arim, established a group called Ralfa.“At the time, the only songs were about love, not about the harsh life of poor people,” remembers Raayan, who today heads the Nepal Academy of Music and Dance. “Our intention was to bring awareness and to change society through music.”https://www.youtube.com/watch?v=2UMN8Sm9H-sThe group went on to create rousing songs like <a href="http://archive.nepalitimes.com/news.php?id=868#.XQtmIxYzaUk" target="_blank" rel="noopener noreferrer">Gaun Gaun Bata Utha</a> and Gariba ko Chameli, and toured Nepal singing songs protesting against the Panchayat regime and establishing the pragatishil genre, which shares many features with protest music worldwide.The lyrics mainly dealt with social inequities and injustice. The music was often martial and easy to repeat and understand because it was based on simple folk tunes. When performed as dances, the songs were deliberately non-sexual, featuring uniformed men and women.https://www.youtube.com/watch?v=Mm-NhAb2XRAThe tunes were instrumental in the success of the anti-Panchayat people’s movement of 1990 and the 2006 anti-monarchy protests. During the 1996-2006 insurgency, the messages focused on injustice and an exhortation to rise up and fight. There were krantikari (revolutionary) songs eulogising courage on the battlefield and mournful ones about martyrs.“The function of revolutionary songs was to recruit people to the revolutionary cause, and to rally the people,” recalls Mani Thapa (video below), who headed a Maoist cultural group. “They were relevant at a particular moment in history, and we don’t really sing such battle-ready songs anymore.”https://www.youtube.com/watch?v=3UnxO2TAn_QMany of the songs are now lost because they were never recorded, but also because the cause dissipated after the war. Writer and music analyst Raman Ghimire believes this is the fate of all revolutionary songs: “They are associated with a particular ideology and are only relevant as long as the movement needs them. They are never going to be popular in the mainstream.”The Maoist party’s cultural wing attracted many talented lyricists, composers and singers, but it was later dismantled. “After the ceasefire we had intense debate about which way we should go, towards peace or towards another revolution (shanti ki kranti),” remembers Laxmi Gurung (video below) who joined the Maoists out of revenge after her leftist father was disappeared by state security and her husband killed. It is her voice in dozens of revolutionary songs, including Rana Maidan Ma, in which a line says, ‘the lives of brave warriors bloom in the battlefield’.https://youtu.be/zZRtHbEGuDYLaxmi Gurung (above) joined the Maoists after her father and husband were killed. She did vocals for dozens of revolutionary songs.“More bloodshed will not be good for the country,” says Gurung now, adding that it is hard to survive as a singer in peacetime. Other members of her troupe have chosen other paths  too. Mani Thapa became a politician, while Maila Lama (video below) who sang songs exhorting guerrillas to battle, has joined the Biplov faction.Pragati Mahara of the Maoist Pratirodh Cultural Group today sings songs about social ills and transformation. “The songs about battles are a part of history,” says Mahara. “Now that our revolution is over, we are more focused on the need of the day.”https://www.youtube.com/watch?v=tfkOcWj7TJoMeanwhile, the original Ralfa generation is still active, perhaps more so than the Maoists who came after them. But even they have distanced themselves from politics. As head of a government institution, Raayan is focused on promoting Nepal’s folk art.Raamesh also shuns political affiliations, even though Ralfa’s songs were used by many political movements: first against the Panchayat, then by the Maoists, who saw them as precursors to their own revolutionary songs, and finally by political parties during the 2006 anti-monarchy protests.Raamesh is now more active as a children’s song creator. “We sing people’s songs, which speak up for the poor and disenfranchised. If anyone wants to use them for a good cause, they are welcome. But using it for vested political interests is a crime,” he says.Unlike Maoist songs, Ralfa’s numbers are evergreen because they speak of the larger causes of justice and equality. There is a lesson there in what makes a song endure, while others disappear.Jeevan Sharma, who established the Raktim Cultural Group, is among the few revolutionary singers who has gone mainstream. “The people always need a voice, and songs that speak truth to power. If they do that, songs do not need to be associated with any political party – they can have a life of their own.”Sharma’s own song of the life of the disenfranchised, Simali Chhaya ma Basera, has that long shelf-life.https://www.youtube.com/watch?v=Izb4dfqUt1ISince the Raktim Cultural Group was associated with the NCP Masaal led by Mohan Bikram Singh, Sharma’s songs were unofficially banned during the monarchy days and the composer himself was semi-underground during the Panchayat and the war years.Ironically the Maoists, who once promoted revolutionary songs, are today <a href="https://www.nepalitimes.com/opinion/creeping-control-over-the-press-in-nepal/" target="_blank" rel="noopener noreferrer">cracking down</a> on protest songs. It is true, Nepalis are a tolerant lot. But this week, something snapped.Citizens have been gathering on the streets, braving water cannons and tear gas to oppose a bill in Parliament that would dismantle the centuries-old tradition of guthi community trusts to manage religious sites and festivals.Coming soon after the Media Council Bill, and detention by police of a YouTuber for posting a satirical review of a bad movie, the slew of recent street protests reflects growing disillusionment with and defiance of a powerful Nepal Communist Party (NCP) government that is perceived to be corrupt to the core and uncaring of the public interest.Read also: <a href="https://www.nepalitimes.com/banner/scripted-arrest/">Scripted arrest</a>, Masta KC<a href="https://www.nepalitimes.com/opinion/nepal-has-press-freedom-but-no-freedom-after-press/">Nepal has press freedom, but no freedom after press</a>, Shashank Shrsethahttps://youtu.be/uf2W5I3r9hoIn the past months, citizens of Chapagaon, Baudhha and Thali have spontaneously risen up to blockade roads, demanding that they be repaired. The management of such entities is traditionally passed down from one generation to the next.The Guthi Bill would create a central government authority to manage community trusts all over the country. It would have more executive powers than Guthi Sansthan, the current body that oversees trusts. Guthi members and heritage conservationists say the government is working with the land mafia to take over Guthi property.“The government doesn’t understand how the guthi system works,” said activist Alok Tuladhar, “it just want to usurp the land. The government’s intention is total control, not just the guthi but also free speech and other rights enshrined in the Constitution.”The protests that began on 9 June have snowballed with more groups and activists joining in. In Parliament, the opposition Nepali Congress halted proceedings on Tuesday, calling for the bill to be scrapped.<img src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/2022110813110/636a457a9c7e80680e04d388jpeg.jpg" alt="" width="2129" height="1419">Minister for Land Management and Cooperatives Padma Kumari Aryal defended the Bill in Parliament, saying it was intended to bring uniformity to guthi administration in order to protect heritage and culture. She says many trusts do not keep proper accounts and are not answerable to anyone.Minister for Home Affairs Ram Bahadur Thapa said the government accepted moral responsibility for the street violence, and promised to investigate. It was loud, brash, irreverent.On the basis a complaint from the film’s producer director Milan Chams, police arrested Gautam on Friday and he has been languishing in a jail cell for the past four days. Pranesh Gautam must have hoped that the review would get him his publishing channel Meme Nepal, the elusive virality content creators seek. It got him in jail.Gautam forgot one critical part of the equation: You can no longer speak your mind in Nepal. Maybe you can, as long as you do not offend or disagree with anyone. What are the limits of satire? He is trying to undermine a right that is fair and constitutional just because he did not like the messaging.Free speech is a two way street, it protects both the ‘good’ and the ‘bad’. To ensure the right things are said we must also provide the stage for the bad. Subjective censorship is a slippery slope. But at its core, we all have the freedom to express ourselves, no matter how poorly or eloquently. It is a freedom that sees the best and worst of it exercised on the Internet, and there has been an increasingly worrying trend to limit speech under this administration.The proposed IT Bill, amendments to the Penal Code and the new Media Council Bill all show a creeping and steady infringement on freedom of expression in Nepal. There is an attempt to stifle dissent and alternative opinion with jail time and fines under the guise of discipline and ‘sensitivity’.A report by Freedom Forum found 104 incidents of violations in 2018 alone with multiple journalists and editors being booked under the Electronic Transactions Act – a law created for monitoring online banking transactions. Currently, the IT bill allows the government to sentence the accused to 5 years in jail and up to Rs150,000 fine for ‘improper’ social media posts. And how about Chams’ supporters openly abusing Meme Nepal and Gautam by saying ‘M**ji harulai thikka paryo’. Should these Internet posts not be subjected to the same scrutiny?No one sets out to make a bad movie. As a content-maker myself, I get it. To find a little known, part-time comedian ripping your movie to shreds when it is so early in its release can be maddening and heartbreaking. But what is also true is that artists must have thick skins, not everyone will like what we make, and audiences can be pretty ruthless.If Gautam’s review in Meme Nepal did pan Bir Bikram 2 and it threatened Nepal’s entire film industry as has been claimed, it just exposes just how weak must be an industry that an absurdist review can wreck it.How we react to Gautam’s unlawful incarceration matters because of the precedent it sets. To allow this case to be ruled in favour of Chams’ team would basically send a message that in Nepal you can express your views as long as someone does not disagree.The review was not perfect, but that is not reason to silence the reviewer. The explicit language and the over-the-top display was not my cup of tea, but was Pranesh Gatuam entitled to make it? Absolutely.The Human Rights Measurement Initiative recently released a report showing declining Freedom of Opinion and Expression in Nepal (3.9 out of 10) and called it ‘very concerning’. Nepal has press freedom, but no freedom after press

If the new law was in place then, the singer could have been jailed and/or fined.“The draft Act is a direct threat to the people’s right to free expression and to press freedom,” says <a href="https://www.nepalitimes.com/from-the-nepali-press/press-freedom-must-be-defended-by-its-maximum-application/" target="_blank" rel="noopener">Shiva Gaunle</a>, former head of the Federation of Nepalese Journalists, adding that the definition of what is objectionable is deliberately left vague to control content.There is also an Advertising Act in the anvil that lays out vague parameters about what is acceptable in paid notices in the media, with 5 years imprisonment and/or Rs500,000 fine for infringement. Critics say this is another way to pressure the media by threatening advertisers. Says media law expert Baburam Aryal: “There is a clear intention to regulate the Internet platformwise, and thereby control content deemed critical.”

The daily 10-hour curfew at Tribhuvan International Airport from 8 November that will last five months has affected tourism during Nepal’s peak season, with some hotels and trekking agencies here reporting cancellations into spring next year. The reduced hours at Nepal’s main aviation gateway till 31 March means that a third of all flights have been cut. This has also caused ticket prices to surge by up to eight times of normal fares. For example a Kathmandu-Delhi ticket that used to cost Rs12,000 is now listed at Rs50,000, and even then seats are not available.&nbsp; “Especially if they are here to trek, change in flight dates can cause tourists to miss their connections,” says Jagan Timilsina, who runs a trail running and outdoor education business. &nbsp; Pokhara is feeling the brunt as hotels report last-minute cancellations for November because of flight disorders. Some hoteliers also say although there have been some cancelled trips, most itineraries have been rescheduled.&nbsp; Hari Prasad Sharma Gaire of the local chapter of the Hotel Association of Nepal says the Kathmandu airport closure should have been timed for the off-season. He told us: “Starting construction during the peak tourist season was a mistake and will cause the tourism industry to lose a lot of business. The upgrade could have been spread out over a longer time but closed for fewer hours at night so that disruption was minimal.”&nbsp; Nearly a third of the 1.2 million tourists who visit Nepal annually come to Pokhara, which is also the gateway to Mustang, the Annapurna treks and pilgrimage tourism to Muktinath. Photo: KRISHNA MANI BARAL/NEPALI TIMES ARCHIVE</figcaption> </figure>  Even without the Kathmandu airport closure affecting tourist arrivals, Pokhara was already suffering from a decline due to many factors like the poor state of the Prithvi Highway, the shortage of luxury accommodation for high-end tourists, and the reluctance of international airlines to start direct flights to Pokhara despite an expensive new airport that was inaugurated two years ago.&nbsp; “There was a lot of initial excitement on the construction of the international airport,” says Timilsina, “but it hasn’t delivered as expected due to politics. People have invested in nearby businesses, and have faced losses.” India has blocked direct flights from its cities to Pokhara because the facility was built by a Chinese company. Although tourists and pilgrims from India hit record levels this year, the poor state of the highways and the Indian bus accident on the highway to Kathmandu in July that killed 27 pilgrims from Maharashtra state dampened arrival figures. Gaire says, “While tourist arrivals to Pokhara are now approaching pre-Covid levels, we haven’t seen the improvement we were expecting. We need a better marketing strategy. What are our embassies abroad doing?”&nbsp; Indeed, Pokhara used to be a favourite destination for Chinese tourists. There was a boom in arrivals from China before Covid, especially after a popular Chinese tv serial was shot on location here. But arrivals from China have not really recovered since the pandemic because of the economic slowdown there. Promoting Pokhara airport to handle direct flights from Chengdu or Kunming could revive Chinese arrivals.&nbsp; Nepal’s Civil Aviation Authority (CAAN) has used the Kathmandu airport closure as an excuse to arm-twist international airlines to start flying to Bhairawa, which has barely been in operation for two years since it was inaugurated. So far, Fly Dubai, Thai AirAsia, Jazeera and Qatar are flying to Bhairawa, but most use it as a hop before flying on to Kathmandu, which does not reduce congestion at Kathmandu.&nbsp; An ideal situation could have been to get Pokhara to run to full capacity while Kathmandu is partially out of action. Pokhara entrepreneurs are puzzled why the CAAN and the national government have not taken more interest in promoting Pokhara as an alternative to reduce the congestion in Kathmandu. Nepal’s football team that was flying to Dushanbe this week couldn’t get tickets via Delhi, and took a domestic flight to Bhadrapur, crossed over to Bagdogra and flew on to Delhi to catch their flight to Tajikistan.

Pokhara’s tourism woes

An excerpt of a conversation between an anthropologist and linguist Mark Turin, PhD and Lava Deo Awasthi, PhD, the first Chairperson of the Language Commission of Nepal. Nepali Times: What is the role of Nepal’s Language Commission and when was it formed? Lava Deo Awasthi: The Constitution of Nepal (2015) created a Language Commission (LC) with the following four core mandates: (a) to develop eligibility criteria for gaining status as an official language and offer recommendations to the Government of Nepal about the official language(s) in each province; (b) to offer recommendations to the Government about measures to be taken for the conservation, promotion, and development of languages; (c) to suggest possible ways of using mother tongues in education by assessing their stage of development; and, (d) to conduct studies, carry out research and perform monitoring functions about the response to the constitutional provisions for the federalisation of languages in Nepal. The Commission was founded in 2016 and I was appointed as the Chairperson of the Commission in September of the same year by the Cabinet of Ministers. What in your own professional and educational background helped to prepare you for the role? I have worked with the Government of Nepal for about 30 years, alongside holding teaching appointments at universities in Nepal. Prior to assuming the role of the Chairperson of the Commission, I served as permanent Secretary to the Government of Nepal and worked as the Chief Administrator of the Central Development Region. I was appointed as Director General of the Department of Education and completed my assignments as Joint Secretary at the Planning, Monitoring and Educational Administration Divisions of the Ministry of Education.&nbsp; In addition, I have taught courses as a visiting professor at Tribhuvan University and Kathmandu University for more than three decades. Later, I also started supervising MPhil and PhD students at the Far Western University in Mahendranagar, Kanchanpur. My PhD project from the Danish University of Education was dedicated to making sense of Nepal’s social construct and commitment to multilingualism, exploring the persistence of monolingual school practices in the face of constitutional promises and state commitments to multilingualism. I conducted a survey of Nepal’s languages and carried out a qualitative study of the Tharu language in the district of Bardia. I analysed language policy statements and explored classroom pedagogies in schools. I documented how teachers showed a tendency to resist change and maintain the status quo because they were not consulted when new educational language policies were introduced. Teachers also exhibited a deeply-held adherence to the Gurukul education system which appears to have been harnessed as a way to resist newer pedagogical ideologies imported from the West. Recognising how engrained these rich traditions of knowledge transmission are, I wanted to know how students’ engagement in the learning process appeared to have dwindled, creating a gap between children’s home languages and the language(s) of the school. Whilst statutory provisions for education in the mother tongue were oriented towards promotion, classroom pedagogies remained resolutely monolingual and exclusionary. The result was that multilingual education policies that had been introduced in Nepal did not result in meaningful changes in classroom practices. My research was also a reflection of childhood traumas I had experienced at the earliest stage of formal education. My home language, Baitadeli, has a strong oral tradition and no written literature. English is my fifth language in terms of exposure and competence, and my home district of Baitadi is well-known for its loyalty to the local language. I had to drop out of school after completing my sixth grade. Staying at home, I received much attention from my family and had much greater exposure to my native language, culture and environment. My overall impression is that dropping out of school had a surprisingly positive impact on my life. The opportunity offered a surprising dividend for me as I gained mastery in my mother tongue and received extensive exposure to folk literature and Indigenous knowledge and survival skills, cultivating my interest in language, culture, literature and local cosmologies.&nbsp; Now that I reflect on it, I appreciate how language has always played a key role in my life. I grew up in a multilingual environment: brought up with Baitadeli, Hindi, Sanskrit, Nepali and English. Language played a major part in my decision to leave school and my later success is closely linked to my competence in several languages. It was rewarding to be at home with my family as I deepened my understanding of native language and culture, which in turn helped me to harness and refine my art of living. Languages matter so much to me because they are both software and hardware. Later, when I was in secondary school, I realised that my command of my home language contributed significantly to enhancing my Nepali and English. My first strategic goal was to create an environment conducive to implementing the provisions of the Constitution of Nepal in relation to language. My priority was to prepare a detailed action plan for my six-year tenure in consultation with language stakeholders, including language experts, professionals, activists, Indigenous community members and representatives of relevant national and local-level institutions. The Commission formed a body of high-level advisors to ensure that the Chairperson’s work was well-informed and credible. The advisors to the committee had highly visible professional and social reputations in Nepal and had much experience in the field of language conservation, promotion, research and development. Another strategy we adopted was to establish close institutional linkages with federal, provincial, and local level governments for collecting opinions and disseminating information widely.&nbsp; What critical issues did you have to consider while discharging your duty? When Nepal’s new Constitution was drafted, a number of concerns could not be adequately addressed. These related to the conservation of languages, the recognition of official languages at the provincial level, and the use of mother tongues at federal, provincial, and local levels. These unresolved issues and matters pertaining to the federalizsation of Nepal’s languages were passed on to the Language Commission to address and resolve.&nbsp; Regarding the recommendations for official languages, a five-year timeline had been set by the Constitution. With great effort, we succeeded in having all provinces agree to recognise their official languages as per the recommendations of the Commission.&nbsp; What were your greatest achievements during your term? One of the greatest achievements was that we succeeded in setting a language agenda at all levels. Nepal’s language communities and other stakeholders expressed the view that this was the first time their languages were recognised and their voices heard by the state. People participated in debates and discussed issues relating to language that in all likelihood had never before happened in their lifetimes, at least not in ways that were supported by the state. We encouraged people to speak in their own language(s) and provided translators during plenary sessions and group discussions. Another major achievement was developing criteria for the status planning of languages at federal, provincial, and local levels, and to recommend 11 province-level official languages, in addition to the Nepali language. Similarly, a notable achievement was recognising Indigenous languages spoken by smaller communities, all of whom faced ongoing marginalisation and high levels of endangerment. The Commission identified 9 new languages that had not been reported in the 2011 census, and provided a framework for recognising official languages within a municipality. The commission emphasised the need for documentation and digitisation of languages for developing corpora and archives at national and sub-national levels.&nbsp; Languages of historical importance as well as classical languages were given recognition for their protection, growth, and development. Recommendations were made for the conservation, promotion and development of Nepal’s marginalised languages that are threatened by majority languages and for those languages that hold particular power at local and global levels. Recommendations were also made for how best to safeguard Nepal’s languages from the ever-growing spread of English and other powerful, globalising languages.&nbsp; A further important aspect of the Commission’s work was to emphasise mother tongue medium instruction in schools across the nation. Recognising the role of language in children’s cognitive, socio-emotional and academic development, the Commission suggested strategies for linking schools with ward-level language clusters for use in the classroom. The importance of nurturing and respecting a child’s first language was reiterated in the Commission’s recommendations for children’s learning and all-round development. By the end of my term, a remarkable change could be observed in terms of building trust within and across Nepal’s diverse language communities. A network of language groups and stakeholders across the country proved to be a powerful way of bringing all language communities under one roof for a collective review of and response to the process of federalising language policy. The many language stakeholders across Nepal appreciated the opportunity to work within a coordinated framework, and—feeling empowered by this—seemed genuinely enthusiastic about the initiatives taken by the Commission.&nbsp;  <figure> <img src="https://publisher-publish.s3.eu-central-1.amazonaws.com/pb-nepalitimes/swp/asv65r/media/2024111811114_b45297fdd2fedf17bdb6313e495a1062c0d87f1a19fa5349f871f220b75f93ab.jpg" data-media-id="editor_1" data-image-id="2024111811114_b45297fdd2fedf17bdb6313e495a1062c0d87f1a19fa5349f871f220b75f93ab" data-rendition-name="original" width="1500" height="1000" loading="lazy" alt="Dr Lava Deo Awasthi NT"> </figure>  What were the most significant challenges for you as Chairperson? One of the major challenges was winning people’s trust in advocating for the mission of the Language Commission. I faced considerable resistance as I sought to emphasise the use of native languages in families and communities. While the Commission advocated for multilingualism and promoted linguistic diversity, the prevailing policy circles and central level institutions had been deeply influenced by a one-language discourse and ideology of Nepali only. The spread of English also poses a huge threat to Nepal’s languages. However, people in power do not seem to see this as a problem. They tend to abandon their own languages in preference for English. The way that Nepal’s municipalities are increasingly introducing English as a medium of instruction at the earliest stage of a child’s school-based education has proven to be detrimental to their cognitive development, socio-emotional wellbeing and academic success. Most of Nepal’s elites have been heavily influenced by the spread of English and remain unaware about its impact on their home languages as well as on the inter-generational transmission of Indigenous languages in the country. I wish that we could have produced more compelling evidence to show the consequences of making poor policy choices for our children’s education. Demystification calls for a collective response. To make change happen across this entire, complex and federalising country was daunting work and left like a race against time. I feel that I could have done more to offer concrete examples in favour of using the mother tongue as a medium of children’s education at the earliest stages of a child’s education. What do you see the Language Commission achieving in the next 5-10 years? The Language Commission will have to ensure that all of its key recommendations are implemented at all levels of government. In 10 years’ time, all seven of Nepal’s provinces will have their official languages in place. These languages will also be recognised as languages of federal business, alongside Nepali. I anticipate that all official languages in the federal and provincial systems will have a national portal for inter-language corpora using machine translation to fulfil their federal, provincial and local level language functions, and that all languages spoken in Nepal will be represented through a digital database in the national archive. The Office of Statistics will monitor the status of Nepal’s languages over time. By the end of the next decade, each municipality in the country will have recognised one or two official languages at the local level, based on speech populations. Other local languages will have received community-level legal recognition and official status to fulfil their functional roles. Languages that are highly endangered or at risk will be entitled to receive state grants for enhancing local level capabilities to encourage families and young learners to speak the language. Incentive schemes will be introduced in municipalities that promote language within the family and at home. Inter-generational transmission of languages will have received welcome and timely attention across Nepal. It is my hope that all schools—public and private—will have introduced mother tongue medium instruction at the earliest stage of school education, at least up to class five. Nepali, English and other national as well as classical and foreign languages will be taught as subjects. The existing policy of English medium education at the early stage of education will be abolished. The Government of Nepal will be held accountable if the number of speakers of any language decreases or if local communities face language loss and greater endangerment. Under the aegis of the Language Commission, a Centre for Language Research and Innovation will be created with world-class facilities for language documentation and archiving in collaboration with Tribhuvan University’s Central Department of Linguistics and other relevant institutions. Harnessing the vastness of Nepal’s linguistic diversity, the Language Commission will morph into a centre of excellence for national and international communities to engage in collaborative language research, to share experiences and document best practices at in service of global linguistic diversity and Nepal’s many Indigenous languages.

Languages are both software and hardware

Nearly 750,000 Nepalis went abroad for employment in the past year, and more than 100,000 left on student visas. Most of them were young Nepali men and women, and the number has been increasing every year. As with other sections of society, Nepal’s security agencies also face a recruitment crisis. Nepal Police opened recruitment for 64 inspectors in September, and received 2,239 applications, compared to 2,718 candidates last year. Police also invited candidates for 256 assistant sub-inspectors this year for which it received 17,756 applications – down from 19,932 last year. It is the same story in the Nepal Army, the number of applicants for the post of Officer Cadet (Second Lieutenant) went down from 6,144 for 400 open seats in 2019 to 4,390 in 2020. Meanwhile, applicants in the paramilitary Armed Police Force went down from 857 applications for 75 posts in 2021 to 536 applicants for 99 posts last year. While the number of applicants appears higher than the demand, the data shows a significant decrease in applications for vacancies in Nepal’s law enforcement agencies. Security personnel are recruited on the basis of rank and age in Nepal, and the age cutoff for entry into Nepal’s security agencies is typically 25 years. Sociologist and migration expert Ganesh Gurung says that the demographic of young, physically fit Nepalis emigrating abroad in search of better opportunities has impacted recruitment into law enforcement and the military here at home. “The returns from working in Nepal’s police and army are minimal, whereas overseas job opportunities are more attractive,” Gurung says. “The work may be physically demanding abroad, but the pay is a lot higher.”  <figure><img src="https://publisher-publish.s3.eu-central-1.amazonaws.com/pb-nepalitimes/swp/asv65r/media/20241116041148_a7e477e0ee2f56acf16c2559fdb24d8f0377f7bc1f9e56138bc40108fc4fa33f.jpg" data-media-id="editor_0" data-image-id="20241116041148_a7e477e0ee2f56acf16c2559fdb24d8f0377f7bc1f9e56138bc40108fc4fa33f" data-rendition-name="original" width="800" height="534" loading="lazy" alt="Nepal Police"><figcaption>Nepal Police</figcaption></figure>  Nepal Police spokesperson DIG Dan Bahadur Karki agrees that the physical and mental demands of a law enforcement job is incomparable to the income that security personnel earn. “A young Nepali who works in Dubai earns enough to build a home in the village within four years, while a Nepali with the same qualifications and physical ability in a security agency here barely makes enough to survive,” says Karki. “Obviously the youth prefer foreign employment.” Security agencies are now worried about the quality of inducted manpower. “There is a difference in work ethic between an applicant chosen from a competitive pool of 50 candidates versus one chosen from a pool of three candidates,” explains Gurung. “Unmotivated employees hamper the overall performance of the state apparatus.” Nepal Army spokesperson Brigadier General Gaurab Kumar KC says recruitment has not been hampered by outmigration: “We have still been getting more than three times the applicants than there are open posts, so we are not yet worried.” Even so, the passing rates of aspirants have gone down for security forces after the Public Service Commission began examinations for military recruitment in 2015. In fact, the Nepal Army complained about the Commission’s involvement in recruitment. Still, the number of vacant military posts tends to exceed the number of passing candidates. Nepal Army’s KC says that the military will not compromise on intake criteria even if there are fewer passing applicants. “Unqualified persons will not be admitted even if there are less-than-required passing candidates. We will re-advertise if that is the case.” But Nepal’s security forces now also have to worry about retention of existing personnel. About 900 Nepal Army, 600 Nepal Police, and 300 Armed police personnel resign every year before the completion of their tenure.  <figure><img src="https://publisher-publish.s3.eu-central-1.amazonaws.com/pb-nepalitimes/swp/asv65r/media/20241116041148_b8cd62f70eea3aac7d3d3778615a5b70b1e20550c9bd76321f051f9c766fd2a9.jpg" data-media-id="editor_1" data-image-id="20241116041148_b8cd62f70eea3aac7d3d3778615a5b70b1e20550c9bd76321f051f9c766fd2a9" data-rendition-name="original" width="750" height="378" loading="lazy" alt="Armed police forces"><figcaption>Armed Police Force</figcaption></figure>  In 2020, Home Minister Ram Bahadur Thapa recalled almost 1,000 police personnel who had been deployed for the security of VIPs after long-standing criticism that security forces were being misused to cater to political and bureaucratic leadership. However, security personnel have continued to be assigned to high-ranking officials as glorified housekeepers. In December 2022, Rabi Lamichhane’s Home Ministry had instructed its offices to recall unauthorised security personnel assigned to high-ranking officials, following which 500 officers from Nepal Police and Armed Police Force were withdrawn from their details. But the Nepal Army does not have to follow such rules, and the practice of army personnel serving high-ranking active-duty and retired military personnel remains. Conditions here are dire enough that many active duty officers in Nepal’s military and police forces have chosen to leave their jobs to serve in the Russian Army to fight in the Ukraine war. The hierarchical culture and chain of command of politics, bureaucracy, law enforcement and military has also meant that abuse and mistreatment of subordinates is rife in Nepal’s security forces. “Feudalism is alive and well within our security institutions,” says Gurung. “When soldiers and security forces who swore to protect and serve the nation are made to be at the beck and call of politicians and bureaucrats, it is easy to understand why they are disillusioned with their jobs and why they choose to quit and find jobs abroad.”

Job insecurity in security forces

Earlier this month, Nepal received Rs1.6 billion from the World Bank as part of its <a href="https://nepalitimes.com/news/will-nepal-ever-be-paid-for-saving-trees">Forest Carbon Partnership Facility (FCPF)</a>, rewarding the country for increasing its carbon sink capacity. Nepal is the first in South Asia to benefit from this facility, and it is specifically to recompense the country for increasing forest cover in 13 Tarai districts between 2018-2024. “We are also trying to get another Rs13 billion from the facility while also preparing for free market-based carbon trading in the international market,” says Nabaraj Pudasaini of the REDD (Reducing Emissions from Deforestation and Forest Degradation in Developing Countries) Implementation Centre. Big emitters of greenhouse gases are under pressure to reduce their carbon emissions, and many have signed agreements to do so by investing in decarbonisation projects in developing countries. Countries that emit more than a specified amount of carbon would be able to buy emission rights from countries that emit less. Nepal is internationally known for its community forestry program which has been largely credited for <a href="https://nepalitimes.com/banner/tree-mendous">increasing tree cover to over 45%</a> in less than three decades. But this achievement had not been adequately recognised or rewarded internationally before. Forests, especially in the tropics, absorb and store large amounts of carbon while releasing oxygen in a process known as photosynthesis. <a href="https://www.fao.org/forest-resources-assessment/en/">Preventing deforestation</a> and increasing canopy cover is considered a much more achievable goal than reducing emission in the scale necessary to limit global average temperature to 1.5°C above pre-industrial levels. COP11 in Montreal in 2005 first proposed reducing carbon emissions by improving forest quality by halting degradation. By 2015, a new mechanism of financial assistance was created to help less developed countries with sustainable management of forests <a href="https://www.un-redd.org/">(called REDD+)</a>. Under this new mechanism, countries receive aid based on their efforts to prevent forest degradation and increase carbon sink, and in 2021 the World Bank was entrusted with implementing it. Nepal’s FCPF receipt this month was calculated on the basis of 2.4 million tons of carbon stored at a rate of $5 per ton. In the second phase, Nepal will receive more than Rs4 billion within the next year for storing an additional 7 million tons of carbon. Eighty per cent of this amount obtained from carbon trading needs to be spent on local beneficiaries and indigenous communities.&nbsp; But carbon trading is not easy, Nepal needs to prove that protected forests will not be destroyed in future.  <figure> <img src="https://publisher-publish.s3.eu-central-1.amazonaws.com/pb-nepalitimes/swp/asv65r/media/20241121091132_c8a381c9a95aa86fec558951650d97bb87914741f01766982ba2b086af001f16.jpg" data-media-id="editor_4" data-image-id="20241121091132_c8a381c9a95aa86fec558951650d97bb87914741f01766982ba2b086af001f16" data-rendition-name="original" width="1500" height="999" loading="lazy" alt="Greenbacks for greenery NT "> <figcaption>Photo: KUNDA DIXIT</figcaption> </figure>  Explains carbon trading expert Yugan Manandhar. “Forests should be handed over to the community and shown that they are managed sustainably. Proving this will be particularly challenging; forest encroachment and degradation is rife in the Tarai.” <a href="https://nepalitimes.com/multimedia/nepal-is-going-up-in-smoke">Deliberate forest fires</a> have also added to the challenge because they increase carbon emissions and reduce the sink capacity of forests. The basis for the amount that Nepal received was set five years ago by calculating the carbon reserves of forests in the 13 Tarai districts. In the meantime, sustainable forest management, tree plantation, forest destruction and erosion control were prioritised to increase carbon reserves in those forests. Nepal is signing another carbon trading agreement during the ongoing Baku climate conference. The <a href="https://www.leafcoalition.org/">Lowering Emissions by Accelerating Forest finance (LEAF Coalition) </a>proposes to sell the carbon stored in the forests of Bagmati, Gandaki and Lumbini provinces. For this, Nepal signed the letter of intent three years ago at COP26 in Glasgow. The target is to store 70 million tons of carbon in 32 million hectares of forest in the three provinces per which Nepal will receive Rs13 billion in four years at $10 per ton with provisions to increase the rate if various conditions are met. However, the agreement in itself doesn’t guarantee the amount. According to the targets set by Nepal, forest degradation should be stopped and carbon reserves increased by protecting tree cover. Preparations are also underway for clean air carbon trade because it has offset fossil fuel use by introducing 30,000 electric vehicles. Nepal has been selected for the first round to receive $40 million within one and a half years through the Clean Air System of the World Bank. Given that most of Nepal’s energy mix is from biomass, replacing them with electric stoves can significantly improve health by reducing indoor pollution as well as strengthen the country’s capacity for carbon trade. “Nepal's goal now is to sell carbon in the free market where carbon credits are bought and sold based on supply and demand in an open and transparent manner,” adds Pudasaini of the REDD Implementation Centre. “Nepal can now set its own price and bargain with interested buyer countries and organisations.” Lately, India has been discussing setting up a carbon market. Nepal has exported Rs12.72 billion worth of electricity to India so far this fiscal year, which can be traded under Nepal’s carbon market. “Carbon trading can create significant economic benefits for Nepal, which will help reinvest in development and environmental protection projects,” says Manandhar. “But we must prioritise sustainable management of forests, cutting older trees and allowing regrowth as well as promoting electric stoves and electric vehicles.”
