This is the 31st instalment of <a href="https://www.nepalitimes.com/diaspora-diaries">Diaspora Diaries</a>, a regular series in Nepali Times with stories of Nepalis living and working abroad. It had been nine years and one month since I had been working in Malaysia. I was planning to return home for good after reaching the 10-year mark. But I met with a life-threatening accident at the steel plant where I worked. It was dangerous work, and the explosion reminded me in the cruelest way just how dangerous it was. I was unconscious for five days in hospital. When I came to, I realised I had lost my left hand. I wept. As a worker who has only done physical labour all my life, what was I worth without my hand? The idea of returning home made me uncomfortable. I felt like it would be better if I just died there in Malaysia, disappeared without trace. Losing my hand, I had also lost my sense of dignity, confidence. The desire to isolate myself just grew stronger. But as time passed, I started coming to terms with reality. Malaysia was a second home to me. Of my nine siblings, seven have previously worked there. I had family and friends there who reached out to me, took care of me, fundraised for me and showered me with love. It was evident that I had earned the goodwill of people who stood by me at the lowest point in my life. I had no education or skills. To get a job that paid liveable wages overseas felt like the only option. After nearly a decade in Malaysia, I was well liked by my supervisors. I had good duty hours. My struggle in Malaysia allowed me to provide well for my family. In those nine years, I came home thrice on vacation. I had gone there with dreams and ambitions, but I was on my final flight home, maimed and dispirited. I had narrowly escaped death, but dreaded homecoming. I only told my family back home about my situation 15 days after regaining consciousness at the hospital. They were shocked and heartbroken, and insisted I come home immediately. I hung around in Malaysia with a missing limb. I refused to return home without compensation for my workplace accident. I wanted to benefit from their social security scheme and although I heard there were provisions for such support, being able to access it entailed paperwork and constant follow up. In particular, it also required the employer’s proactive support and follow up as they are more aware of the SOCSO program and how to access it than workers like us are. I also relied on informal support of friends and family until I got this sorted out. I may have lost my limb but my responsibility as a father continued so I decided to persist. I had nothing to lose after what had happened. They gave it out of love, but I used to feel bad as I felt these were handouts out of pity and it was discomforting and perhaps hurt my pride. I would feel bad about having these ungrateful thoughts, and for the reluctance to appreciate their generosity and kindness. These were complex emotions to deal with. My persistence finally paid off. I now get a monthly disability benefit of 824 Ringgit ($185) via bank transfers from SOCSO every three months. If I face any problem, the foreign employment board in Kathmandu supports me. I will benefit from this throughout my life which is a relief. It has helped me with some of my household expenses, and has ensured my children’s education. The Governments of Nepal and Malaysia have signed a social security agreement that makes it easier for people to benefit from the scheme in case of accident or death. The agreement provided me with strong support to claim my dues. I am hopeful that the Nepal government can facilitate such support by following up with the employer or the Malaysian government because workers like me do not necessarily know how to work the system there. For workers who face mishaps like I did or families of the deceased, I hope I can serve as an example or source of information about what is possible during these trying times. But without my limb, I cannot work at all. What can I do with a meager Rs2,100? Which is why the lifelong Malaysian SOCSO benefit is important for me. Through the contributory Foreign Employment Welfare Fund and mandatory insurance under Nepal’s labour approval process, I also received a one time support of around Rs800,000 which provided some financial relief. Thankfully my labour permit was valid, if not, I would not have been eligible. I worry about those in my situation deprived of benefits because they do not have a valid labour permit or are unaware of social security benefits like the SOCSO scheme. Even after years, I can feel the weight of my missing limb. My phantom fingers feel like they are tightly clutched together and causes pain and discomfort throughout my waking hours. I use prosthetics but it is heavy and unnatural. I still break down when I watch shows like Indreni that cover similar stories. The memories do not go away, and the tears do not stop. When the odds are heavily stacked against you and you are left with lasting scars, lifetime social security support can at least provide something reliable to fall back on. After all, the Constitution guarantees us the right.Nepalis in Nepal are voting on 13 May in local polls, but once again we are not allowed to. Nor can we cast our ballots in general elections later this year. We may not be allowed to vote in the next polls in five years, either.I had recently engaged with fellow Nepalis in Qatar about what their expectations from the government back home regarding the upcoming elections were, and despite the Constitution guaranteeing the right to vote what they thought about being prevented from exercising it.The sentiment among Nepalis was broadly similar. Not being allowed to vote means we do not have a say in matters that directly impact us or our families back home.This is despite the Constitution guaranteeing us our rights and a subsequent 2018 Supreme Court order to the government to make all the necessary arrangements to ensure us our voting rights.Read also: <a href="https://www.nepalitimes.com/here-now/diaspora-diaries-1/">Diaspora Diaries 1</a>, Nepali TimesMany countries allow absentee voting, and if our leaders had been willing, Nepal's embassies could be easily mobilised to facilitate it. But there is no interest, conversation or movement in that direction.There should at least have been discussions on the how’s and why’s, and not the present demeaning radio silence.The lack of interest shows that it is not just the practical challenges to facilitate overseas voting that the government does not want to entertain, but also the principle of allowing us to vote.At a time when frustration towards politics is at an all time high regardless of where Nepalis are based, it is a pity that those of us abroad cannot channel our frustration through the ballot box.Nomination filing is underway in Nepal, and candidates have started campaigning in an attempt to influence voters. Amidst the frenzy, despite being a significant chunk of the population, we are not in anyone’s radar.Read also: <a href="https://www.nepalitimes.com/here-now/diaspora-diaries-2/" target="_blank" rel="noopener noreferrer">Diaspora Diaries 2</a>, Nepali Times It seems as if we overseas Nepalis do not need to be influenced — not even with empty promises — which also means the issues that concern us do not get their due attention.It is ironic how on the one hand, public discourse has been dominated by the upcoming election in which migrants are not given much consideration, while on the other hand, falling remittances sent by migrants has become an issue of grave public concern.Those in power are even calling on us to send money legally to help the country. Our notes count, but our votes don’t, as the saying goes.The sole focus on remittances without a second thought for those sending money home is tragic. If the officials back home only understood that the two cannot be separated.If they realise that remittances are indeed critical for our economy and gets nervous when there is a dip, why do they do nothing to ease the lives of the senders?Read also: <a href="https://www.nepalitimes.com/here-now/diaspora-diaries-3/">Diaspora Diaries 3</a>, Nepali TimesInstead, we are grossly inconvenienced by a system designed to make our lives difficult even before we migrate, during our time abroad, and when we return.Worrying about falling remittances alone is not meaningful. Remittances are linked to both quality and quantity of the overseas jobs. Emphasis by the Nepal government on capturing well-paying, available jobs abroad is limited. Instead, even the lucrative jobs that could be channelled to Nepalis are lost because of our complex labour approval system.Workers, for example, cannot take on assignments if the duration of the contract is less than two years under Nepal’s labour approval system, no matter their benefits. How many jobs have we lost to other countries because our approval system is so complicated and time consuming that employers would rather look elsewhere so they can fill the vacancies on time?Has anyone compared how much more time it takes to deploy one worker from Nepal compared to other countries? These concerns are especially pronounced after the pandemic when many lost their jobs and returned, or many like me had to compromise on our salaries during the business downturn due to Covid-19.Read also: <a href="https://www.nepalitimes.com/here-now/diaspora-diaries-4/">Diaspora Diaries 4</a>, Nepali TimesThere are many restrictions and hurdles for those of us who are overseas, and who send or carry money home. Amid concerns regarding illicit transfers of money or gold smuggling, it is us migrants who get scapegoated and punished. I cannot easily bring home gold for my sister’s wedding, or an iPhone for my wife without getting severely punished.Every few months there is a new boss who introduces a new set of rules regarding what we can and cannot bring to the country, many times without any sound reason, and we get penalised accordingly. The rules change and are confusing even for me as a journalist who keeps track of all these regularly as part of my profession. How are others expected to keep up?I understand the concerns regarding illicit transfers that drive such decisions. But claiming to tackle these informal transfers by harassing migrant workers lets the real criminals off the hook. We workers get victimised even when we have nothing to do with  the smugglers, even while the problems at hand remain unaddressed.Any action taken is just for show or a bare scratch on the surface. It is as if the broader message from the government to us is that we should toil hard in the desert heat day and night, and send money home — but we cannot decide how to use it.Nepal's remittances are falling. But have the leaders and those in power ever done anything concrete to better understand why people use the informal hundi channel to send money and what steps can be taken to compete with this transfer?Read also: <a href="https://www.nepalitimes.com/here-now/the-qatar-job-mirage/">The Qatar job mirage</a>, Nepali TimesWhen both the commissions for transfer and exchange rate is better than formal rates, while being more convenient for both the sender and recipient who engage in phone transactions for home-based pick up and delivery of the amount, should we be surprised that many, especially those who earn very little and have very long working hours, should opt for this informal system of money transfer?What has been done to ensure easy digital transfers of remittances? What has been done to reduce the cost of transfer of remittances? What incentives are there for a normal worker to opt for formal transfers?It is just not about foreign employment or remittances, but issues that concern us as citizens being prevented from having a say in the elections. Even when we are disenfranchised from our voting rights, the election and state of affairs in Nepal remains an important part of our discourse and concern.One overseas Nepali shared with me that being away makes him understand the importance of having good leaders and representatives for economic growth and development, which he got to witness directly in ways that one may not have had a chance to back in Nepal.Another said that not being able to vote despite being on the voters list is a wasted opportunity to influence election outcomes and choose strong candidates. The election is also tied to our own futures back home. Many of us were compelled to migrate even for very low paying jobs with very little reward because of the government’s inability to provide jobs back home.One of my colleagues who has been in Qatar for the last 25 years has never once voted, and there is nothing he can do about it.I cannot speak for all, but for us sweating in the Gulf, our ultimate destination is always Nepal. We may stretch our employment until either our employers or our bodies allow it, but we will all come home eventually.However, the decision to return is never easy. What will we come back to, especially as returnees who could be potential entrepreneurs or jobseekers?When I talk to my colleagues here from the Philippines, it is evident how their government recognises their value, not just in words but in action.She shared how she recently cast her ballot for elections in the Philippines from Qatar. Our notes count, but our votes don’t

December 18 will also be <a href="https://www.un.org/en/observances/migrants-day" target="_blank" rel="noopener noreferrer">International Migrants Day</a> as well as Qatar’s National Day.For Nepalis, the 2022 World Cup is personal. The eight stadiums in Qatar where the games will be held are built on the blood, sweat and tears of tens of thousands of migrant workers, including from Nepal.“There is lots of excitement here in Doha with the FIFA Arab Cup that is going on,” says Ram, a Nepali construction worker from Dang district who worked on the impressive Lusail Stadium where the finals will be played on 18 December next year. “It seems these structures have come up virtually overnight, it is unbelievable. But I have come to realise it is all about money.”Ram himself makes $274 per month. Although it is a raise from the $206 he earned when he first started four years ago, he had to pay $1,000 to a recruiter in Nepal for the job. There are hundreds of thousands of Nepalis like Ram, the unknown builders of the impressive infrastructure. Lusail Stadium does have a wall full of photographs of some of the workers who helped build the stadium.Read also: <a href="https://www.nepalitimes.com/editorial/the-days-of-international-migration/">The Days of International Migration</a>, EditorialBut Ram and migrants from other countries may have perhaps felt a deeper sense of pride to be associated with the World Cup had they been treated with more dignity, paid on time and in conditions free of <a href="http://archive.nepalitimes.com/article/nation/home-workers-dead,3229" data-saferedirecturl="https://www.google.com/url?q=http://archive.nepalitimes.com/article/nation/home-workers-dead,3229&amp;source=gmail&amp;ust=1639713374238000&amp;usg=AOvVaw0UO_qQXo_rc9m3mSCaKu3r">exploitation and abuse</a>.In an online media briefing on Wednesday organised by Human Rights Watch (HRW), researchers said that although labour laws are relatively better in Qatar, things have not improved on the ground, and there is pushback from construction contractors working on World Cup infrastructure.<img src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221110161148/636d1e079c7e80680e0af3eajpeg.jpg" alt="" width="455" height="286">"Qatar's legal framework is better than other countries' in the region, but the conditions on the ground are still bad. If they want to be a role model as they claim, much more needs to be done to protect workers rights," said May Romanos of Amnesty International.Qatar won the bid to host the World Cup a decade ago and has been on a massive construction spree. After <a href="https://www.nepalitimes.com/latest/nepal-welcomes-qatar-labour-reform/" data-saferedirecturl="https://www.google.com/url?q=https://www.nepalitimes.com/latest/nepal-welcomes-qatar-labour-reform/&amp;source=gmail&amp;ust=1639713374238000&amp;usg=AOvVaw04tX5ly4i4sB_YfYnlcsz5">international media spotlig</a><a href="https://www.nepalitimes.com/latest/nepal-welcomes-qatar-labour-reform/" data-saferedirecturl="https://www.google.com/url?q=https://www.nepalitimes.com/latest/nepal-welcomes-qatar-labour-reform/&amp;source=gmail&amp;ust=1639713374238000&amp;usg=AOvVaw04tX5ly4i4sB_YfYnlcsz5">ht </a>in 2018 it promised to reform labour conditions, but there are still reports of <a href="https://www.nepalitimes.com/latest/world-cup-stadium-workers-in-qatar-unpaid/" data-saferedirecturl="https://www.google.com/url?q=https://www.nepalitimes.com/latest/world-cup-stadium-workers-in-qatar-unpaid/&amp;source=gmail&amp;ust=1639713374238000&amp;usg=AOvVaw271Oj55fgeZRSvzESgOBPb">unpaid wages</a>, high recruitment costs, deplorable living conditions, and death from heat stress.There have been at least 30 deaths of migrant workers at World Cup construction sites, rights group say, 18 of them unexplained. In Kathmandu, the coffins arrived on flights from Doha, and the same planes took more migrant workers to Qatar.‘Died in his sleep’ (सुत्दा सुत्दै मर्यो) has become a colloquial Nepali term and the fatalities were attributed to ‘natural causes’. Mostly, there was nothing natural about them – they were a result of overwork, heat stroke and official apathy.Nepali workers were dying in Qatar, but they were also dying to work in Qatar. And therein was the conundrum. The money they earned building stadiums in Qatar, helped them build homes for their families back in Nepal."At least 70% of the deaths are unexplained which is not acceptable, especially in a country with such an advanced health system,” said Nicholas McGeehan of the rights group FairSquare. “Being a migrant worker in Qatar today is really bad for your health, and can kill you."Rameshwar is from Sarlahi district and works as an electrician in Qatar. He supports a Brazilian football team, works at a labour supply company. Like many other Nepali workers, he is worried that he will be sent home in 2022 before the FIFA games begin.“They mostly want to keep the maintenance workers, and might send everyone else back,” he says on the phone from Doha. “I am worried I will lose my job. How will I provide for my family after I return?”To be sure, Qatar cannot be singled out for blame. The exploitation of workers by unscrupulous recruiters and harassment by officials starts back in Nepal, even before workers leave home.At a time when construction for the World Cup was going full swing in Qatar, the ambassadorial post in Doha was vacant from 2013-17 when migrant abuses, including sudden deaths of Nepali workers, was at its peak and getting worldwide attention.Then, Prime Minister Deuba’s government recalled <a href="https://www.nepalitimes.com/latest/nepal-must-now-send-skilled-workers-to-qatar/" target="_blank" rel="noopener noreferrer">Narad Nath Bharadwaj </a>without naming his replacement, at a time when the need for labour diplomacy in Doha was most critical.And this year, Nepal and Qatar <a href="https://www.nepalitimes.com/latest/qatar-police-recruitment-row-hits-nepalis/)" data-saferedirecturl="https://www.google.com/url?q=https://www.nepalitimes.com/latest/qatar-police-recruitment-row-hits-nepalis/)&amp;source=gmail&amp;ust=1639713374238000&amp;usg=AOvVaw1BlPr22LANN53NlkWnrTNk">bungled a lucrative employment deal</a> to supply the Qatar Police with 200 Nepalis. They would have earned Rs180,000 a month, excluding overtime pay and end-of-service benefits. Unscrupulous authorities and recruiters knew that desperate Nepalis would be willing to pay under the table. But things got so messy that all 200 job orders were cancelled.“Everyone wanted a piece of the pie until there was no pie left at all,” said one activist.Nepal has also failed to fulfil its promise of reintegrating workers who had to return due to the Covid-19 pandemic. Schemes like the <a href="https://www.nepalitimes.com/banner/missing-the-plot-in-nepals-job-scheme/" data-saferedirecturl="https://www.google.com/url?q=https://www.nepalitimes.com/banner/missing-the-plot-in-nepals-job-scheme/&amp;source=gmail&amp;ust=1639713374238000&amp;usg=AOvVaw1ZBnwLE_9JIp2B10Q7kd7h">Prime Minister's Employment Program</a> introduced with much fanfare have failed to deliver.There are reports that Qatar could be planning to send back many construction workers on extended leaves, including Nepalis, before the games begin in the stadiums and facilities they helped build.“Even if they let me stay, it is not like I could afford the tickets to go watch the games in the stadium,” says Rameshwor. “I will watch it on the TV screen.”There will be many Nepalis in the hospitality sector who will look after players and visitors in Doha during the World Cup, and workers are hopeful that there will be future projects they can engage in.But international rights watchdogs say the world’s attention is going to wane once the games are over and the media glare shifts. They say not a single worker died during construction of stadiums in London for the 2012 Olympics, and there is no reason why Qatar with its resources could not adhere to similar safety standards.“Despite Qatar’s PR offensive and sportswash, there is an urgent need for real and durable reforms because workers continue to suffer <a href="https://www.nepalitimes.com/latest/world-cup-stadium-workers-in-qatar-unpaid/" data-saferedirecturl="https://www.google.com/url?q=https://www.nepalitimes.com/latest/world-cup-stadium-workers-in-qatar-unpaid/&amp;source=gmail&amp;ust=1639713374238000&amp;usg=AOvVaw271Oj55fgeZRSvzESgOBPb">wage abuse</a>, employers avoid accountability, complaints are ignored,” said Hiba Zayadin of Human Rights Watch.Meanwhile, back in Nepal, politicians are already in election mode, and will be too preoccupied with their campaigns during 2022 to pay attention to migrant welfare. There are already lofty claims about how in the next five years, if they are elected, they will curb migration and create jobs back home.Most Nepalis have heard all that before, and the trust deficit is so high that out-migration to Qatar and elsewhere seems like the more reliable – and for many, the only – alternative.The government should immediately ensure that Nepal’s embassies in destination countries for migrants are adequately staffed and funded. It could diversify out-migration towards better, higher paying jobs, and use bilateral labour agreements like the one with Qatar that is currently being renewed for better worker protection.

Rights referees blow whistle on World Cup fouls

<figure><img width="708" height="499" src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221109181128/636be3319c7e80680e083eedjpeg.jpg" alt=""/><figcaption></figcaption></figure>A row has broken out in Nepal over the recruitment of Nepalis for the Qatar Police which tried to bypass the country’s <a href="https://www.nepalitimes.com/here-now/nepal-and-malaysia-rewrite-rules-for-migrant-labour/" target="_blank" rel="noopener noreferrer">foreign employment</a> rules, and in which Qatari officials appear to be involved.The Department of Foreign Employment (DOFE), the regulatory body overseeing recruitment of overseas workers from Nepal, last week raided three companies (SOS Manpower Services, DD Human Resources and Hope International) for conducting interviews without permission for jobs in the Qatar Police.Hundreds of workers had lined up and had been reportedly told that they would have to pay Rs800,000 each in exchange for the job if they got selected.Rules state that both foreign employers and recruiters are supposed to get demand letters attested at the concerned missions abroad, obtain pre-approvals to conduct interviews, and publicly advertise the approved vacancies. But the recruiters had allegedly not followed this process.“We received a complaint regarding such interviews being conducted after which we sent teams unannounced to investigate. The recruiters did not follow any of the due processes required,” Kumar Dahal, Director General of DOFE told Nepali Times.   Dahal added that the recruitment companies has submitted justifications which are being investigated. Meanwhile all three companies have been suspended until further notice. “This speaks volumes about the <a href="https://www.nepalitimes.com/banner/kleptocrats-of-kathmandu-and-kualalampur/" target="_blank" rel="noopener noreferrer">malpractices rampant in the recruitment</a> of process and that there is collusion between different parties involved,” Dahal added. <img width="705" height="532" src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221109181128/636be3339c7e80680e083eeejpeg.jpg" alt="">What made the issue more suspicious and caused an uproar is that a blue-plated Qatar Embassy vehicle was parked in one of the recruitment companies premises in Kathmandu when the raid took place, and there was a Qatari official present at the premises. The Qatar Embassy in Nepal has clarified it was not involved in the recruitment of Nepali workers, and was simply providing the vehicle to a Qatari delegation inspecting the recruiters. This is not the first time recruitment for Qatar has been in a controversy. The establishment of the Qatar Visa Center (QVC), a one stop service to simplify the <a href="https://www.nepalitimes.com/opinion/for-nepals-migrant-workers-good-news-in-small-bites/" target="_blank" rel="noopener noreferrer">immigration</a>, had also been criticised because it had been done without due consultation with the Nepal Government. While streamlining recruitment through a single-window for medical tests and biometrics was considered a welcome step to save time and money for <a href="https://www.nepalitimes.com/here-now/in-the-minds-of-nepals-migrant-workers/" target="_blank" rel="noopener noreferrer">migrant workers</a>, eye brows were raised about Hem Gurung of SOS, the private sector partner chosen by the Qataris to run QVC. SOS is one of the recruitment companies now under the scanner for last week’s unauthorised recruitment. After initial resistance from the Labour Ministry to approve the establishment of QVC, it began operations in Nepal from early 2019. Sujit Kumar Shrestha of NAFEA (Nepal Association of Foreign Employment Agencies) said there was speculation that all recruitment for Qatar was going to go through QVC, and they would be distributed to only 16 of the 854 recruitment companies in operation. The 16 were suspected to be forming a ‘syndicate’, which is against Nepal’s Foreign Employment regulation. NAFEA raised concern with the Foreign Ministry, Labour Ministry and the Parliamentary Committee. A taskforce was formed to investigate the issue, which is still ongoing.  “At that time we met QVC chair Hem Gurung and the Qatar Ambassador to Nepal and had been assured by both that that there is no syndicate. We had also raised the issue of hiring for the Qatar Police through a more transparent and competitive process which was received positively,” Shrestha said. Nepal's Ambassador to Qatar, Narad Nath Bharadwaj told Nepali Times from Doha that he had met Qatar Police officials last year who had expressed interest in hiring a few hundred Nepali workers. “I had advised that given the specific nature of this demand, it would be advisable to hire workers through a Government-to-Government agreement instead of through intermediaries,” Bharadwaj said. Qatar Police had previously hired 179 Nepalis through a few selected recruitment agencies, also leading to a row. Which is why Bharadwaj had suggested the government-to-government model, since this was for the Qatari state police. Last week, the Embassy in Doha resumed issuing demand attestation for Nepali workers, including for new ones, which had been halted during the pandemic. But there had been no demand letter for Qatar Police. Only existing workers on vacation were allowed to return. Because it is a government job, the Qatar Police openings present a more secure employment, and besides Nepalis there are recruits from Pakistan, Morocco, Sudan in the force. The intake will probably increase because of the <a href="https://www.nepalitimes.com/latest/world-cup-stadium-workers-in-qatar-unpaid/" target="_blank" rel="noopener noreferrer">2022 FIFA World Cup in Doha</a>. Nepalis in the Qatar Police are paid 3,000 Qatari Riyal (Rs97,000) for three months during training, after which they get Rs180,000 a month, excluding other benefits like overtime, end-of-service benefits, food and accommodation. However, few Nepalis who got those jobs in the previous batch of 179 recruits report paying recruitment agencies in Nepal Rs600,000 each for the job. “People confuse this job with other security jobs, but it is not the same,” a Nepali in the Qatar Police force told us on the phone from Doha. “It is a lot more professional. We have to undergo a grueling training in the initial few months when we are tested to our limits. Few could not handle it and returned. I now make close to USD3,000 a month and feel like my future is secure.” After training, the recruits are stationed at the courts, airports, jails etc and earn much better than other Nepali workers, with good facilities. Labour activists say it is unfortunate that this potentially rewarding job opportunity for Nepalis is now being thwarted by malpractice and vested interests of politically-connected individuals, and profit hungry recruiters in Nepal.

Qatar Police recruitment row hits Nepalis

It has been taken to task for <a href="https://www.nepalitimes.com/editorial/own-worst-enemy/" target="_blank" rel="noopener">non-performance and under-performance</a>. And rightly so. When it does take a decision it is usually the wrong one, like the project to fell a vast tract of forest for <a href="https://www.nepalitimes.com/here-now/economy-ecology-of-nijgad-airport/" target="_blank" rel="noopener">an airport that may never be built</a>, or <a href="https://www.nepalitimes.com/from-the-nepali-press/melamchi-delayed-by-government-extortion/">sabotaging Melamchi</a>.There is a lot to be critical of about the present government. They give profound speeches, make wild promises, pass the buck, come up with excuses and when nothing works, threaten the messenger of bad tidings.Yet, there are ministers in government who are working quietly behind the scenes to get things done. They do not say much, they speak softly and carry a big stick. The late Minister of Tourism Rabindra Adhikari was one of them, and he multitasked to get various projects off the ground. His <a href="https://www.nepalitimes.com/banner/the-last-journey/" target="_blank" rel="noopener">death in a helicopter crash</a> in April was a tragic loss for the country.Alas his successor, <a href="https://www.nepalitimes.com/here-now/unusual-appointment-extraordinary-tasks/" target="_blank" rel="noopener">Yogesh Bhattarai</a>, though full of youthful energy and ambition, has fallen into the trap of making populist proclamations and issuing daft orders like playing the <a href="https://www.nepalitimes.com/opinion/anti-national-anthem/" target="_blank" rel="noopener">national anthem during evening prayers at Pashupati</a>. Another NCP Young Turk in the cabinet who we do not hear much from is Minister for Labour, Employment and Social Security <a href="https://www.nepalitimes.com/here-now/win-win-migration/" target="_blank" rel="noopener">Gokarna Bista.</a> Even as energy minister in the Jhalnath Khanal administration in 2012, Bista was known for his low profile and no-nonsense style.In May 2018, as labour minister, Bista took the unprecedented step of stopping Nepalis from going to Malaysia to work, soon after a <a href="https://www.nepalitimes.com/banner/kleptocrats-of-kathmandu-and-kualalampur/" target="_blank" rel="noopener">crossborder investigation by this newspaper</a>, Himal Khabarpatrika and Malaysiakini exposed corrupt Nepali and Malaysian officials and private companies overcharging more than Rs5 billion ($450 million) from over 600,000 Nepali workers between September 2013 and April 2018.Read also: <a href="https://www.nepalitimes.com/banner/kleptocrats-of-kathmandu-and-kualalampur/" target="_blank" rel="noopener">Kleptocrats of Kathmandu and Kuala Lumpur</a>, Ramu Sapkota and Alyaa AlhadjriIt was regime change in both Malaysia and Nepal that allowed the recruitment mechanism to be overhauled. Officials and private companies in Malaysia, with political protection in the Barisan Nasional coalition of former Prime Minister Najib Razak, worked with influential brokers in Kathmandu to cheat Nepali workers.In July, the Malaysian Anti-Corruption Commission <a href="https://www.nepalitimes.com/here-now/punished-in-malaysia-ignored-in-nepal/" target="_blank" rel="noopener">began prosecution against</a> Malaysia’s former Deputy Prime Minister and Internal Affairs Minister, Ahmad Zahid Hamidi. Among the many charges against him was taking a $10 million bribe to permit company Ultra Kirana become a One Stop Centre for visa processing and labour migration from Nepal and other countries.No one has yet been charged in Nepal. Instead, Minister Bista came under pressure from powerful businesses with political protection, who had been profiting from fees levied on Nepali migrant workers.Despite this, Bista’s ministry pushed through an MoU with Malaysian Minister for Human Resources M Kulasegeran last year, which requires employers to pay for visa fees and air tickets of Nepali workers, as well as for other facilities.Read also: <a href="https://www.nepalitimes.com/here-now/nepal-and-malaysia-rewrite-rules-for-migrant-labour/">Nepal and Malaysia rewrite rules for migrant labour</a>, Kunda DixitIt took almost a whole year for the technical details of that deal to be worked out by a joint working committee, which finalised them in Kuala Lumpur on 12 September, opening the door for the resumption of Nepali workers going to Malaysia.All credit for ironing out this deal goes to Ministers Bista and Kulasegeran, who have kept the welfare of workers at the forefront of all negotiations. As the minister <a href="https://www.nepalitimes.com/here-now/nepal-and-malaysia-rewrite-rules-for-migrant-labour/" target="_blank" rel="noopener">told this newspaper in an interview last week</a>, the goal has been to ensure that workers are not exploited, spend less on fees, earn decent pay and are treated well in the workplace.<a href="https://www.nepalitimes.com/editorial/labour-pains/" target="_blank" rel="noopener">Nepali migrant workers</a> have been made to jump through hoops to get their paperwork done. They face harassment and demands for payoffs every step of the way before departure. Bista insisted on tackling this culture and making it as convenient as possible for workers to get the necessary tests and documents before departure.Read also: <a style="background-color: #ffffff; letter-spacing: 0.01em;" href="https://www.nepalitimes.com/editorial/bargaining-power/" target="_blank" rel="noopener">Bargaining power</a>, EditorialIn fact, one of the reasons for the delay in negotiations was Nepal’s insistence that the 37 institutions the Malaysians had recognised to do medical tests for workers needed to be increased to 122, and be located throughout the country. The ministry is also working to allow Nepali missions abroad, as well as provincial governments, to renew work permits. As with everything else in Nepal, laws and agreements are not enough. There are too many vested interest groups that have profited for too long from the sweat and blood of poor Nepali workers who will want to see this agreement fail.But let us give credit where it is due. REDUCING  LABOUR  PAIN

The sudden and massive flood on the Bhote Kosi early Tuesday morning washed away a strategic bridge on Nepal’s main border crossing with China for trade, tourists and pilgrims. Slurry from the nearly 10m high debris flow left 9 dead and 20 missing, 12 of them Nepalis and six Chinese nationals, and 150 others were rescued by helicopter.&nbsp; Four <a href="https://nepalitimes.com/banner/climate-smarter-himalayan-infrastructure">hydropower plants</a> Rasuwagadi, Trisuli III, Trisuli, &nbsp;Benighat and the Trisuli substation sustained heavy damage, knocking &nbsp;out 230MW of Nepal’s power supply – approximately 8% of the total. Over 100 cargo trucks and new electric vehicles parked at &nbsp;Timure Dry Port were swept away. Read also: <a href="https://nepalitimes.com/news/mapping-kangchenjunga-glacial-flood-risk">Mapping Kangchenjung glacial flood risk</a>, Gabe Allen Officials had initially thought &nbsp;the Bhote Kosi had flooded due to heavy rain in Tibet. However, the Department of Hydrology and Meteorology (DHM) and the National Disaster Risk Reduction and Management Authority (NDRRMA) now say a <a href="https://nepalitimes.com/here-now/living-below-nepal-s-melting-mountains">Glacial Lake Outburst Flood (GLOF)</a> is likely.&nbsp; NDRRMA spokesperson Suresh Sunar said it was too early to tell which one, but the flood was most likely the result of one of the glacial lakes in Tibet. Bhote Kosi begins on the north slope of the Ganesh Himal near the Nepal-China border, and its tributary Lende drains the catchment area north of Langtang. The level of water at a self-monitoring station in Timure in Rasuwa increased by 3.5m at 3:10AM on Tuesday morning while 13km downstream in Syabrubesi, the level rose by 3.65m at 3:30AM. The same station recorded 5.37m ten minutes later, after which it stopped giving a reading, possibly because the station was also washed away. The flood reached <a href="https://nepalitimes.com/here-now/neither-side-lost-both-sides-won">Betrawati</a> by 5AM, and some of the debris flow reached Mugling during Tuesday. The river meets the Bhote Kosi at the Nepal-China checkpoint in Rasuwa.&nbsp; “Analysis of weather forecasts and satellite data shows the Tibet region did not receive enough rain to cause this scale of flooding,” explained Binod Pokharel, associate professor of hydrology and meteorology at Tribhuvan University. “The flood could have been caused by a GLOF."&nbsp; Two weeks ago, Chinese officials had reportedly warned the Rasuwa District Administration in Nepal to be on high alert for floods on rivers that originate in Tibet. It could be that Chinese scientists had observed the alarming<a href="https://nepalitimes.com/here-now/the-climate-crisis-is-a-water-crisis-in-the-himalaya"> expansion of glacial lakes</a> in the Lende and Bhote Kosi catchments. If that was the case, it is an example of the kind of trans-boundary forewarning that would be critical to save lives in future.&nbsp;  <figure> <img src="https://publisher-publish.s3.eu-central-1.amazonaws.com/pb-nepalitimes/swp/asv65r/media/20250708100736_1710142917b30d4f85b343ed52743554d723db918c708f0bade8a0491ba999b2.jpg" data-media-id="editor_9" data-image-id="20250708100736_1710142917b30d4f85b343ed52743554d723db918c708f0bade8a0491ba999b2" data-rendition-name="original" width="1001" height="500" loading="lazy" alt="Bhotekosi flood"> </figure>  However, Rasuwa’s Assistant Chief District Officer Dhruv Prasad Adhikari seems to have no knowledge of any warning from the Chinese side, either formally or informally. &nbsp; “The Chinese Embassy has said the cause of the flood is unknown that it will coordinate with Nepal to find the cause," Adhikari told us. Chinese Ambassador Chen Song and Prime Minister Oli visited the border on Tuesday (pictured). &nbsp; The sharing of real-time trans-boundary rainfall and river flow data would be crucial in early warning about the <a href="https://nepalitimes.com/news/mapping-kangchenjunga-glacial-flood-risk">risk and consequences of GLOFs</a> to reduce human and material loss. But Nepali officials say China has been reluctant to share weather-related information and data not just in this disaster, but in the past as well. “There is no mechanism or system in place for us to obtain hydrological and meteorological data of the Tibetan region,” said DHM Director General Joshi. The <a href="https://nepalitimes.com/here-now/for-destruction-ice-is-also-great-and-will-suffice">Himalaya is melting twice as fast as the rest of the world</a> due to a phenomenon called ‘elevation dependent warming’, and receding glaciers have led to an increasing number of transboundary GLOFs.&nbsp; According to <a href="https://nepalitimes.com/here-now/danger-nepal-s-glacial-lakes-are-filling-up">a 2018 ICIMOD study</a>, of the 47 of the most dangerous lakes that threaten Nepal, 25 are on glaciers in China, 21 in Nepal and one in India. Many of these glaciers are expanding rapidly due to global warming. One of the authors of the report, glacial lake expert Samjwal Bajracharya, says that the report was prepared based on data from 2015. But climate change has accelerated since then. Moreover, seismic activity has further destabilises the landscape, adding to <a href="https://nepalitimes.com/here-now/nepals-glacial-lakes-in-danger-of-bursting">GLOF risk</a>.&nbsp; “Considering the rapid rate of snowmelt and consequent increase in size of Himalayan glaciers, studies should be conducted every year, and a monitoring system should be set up on the glaciers,” says Bajracharya. “However, no studies have been conducted in the Himalaya in a decade, which has been our biggest weakness.” &nbsp;

Rasuwa flood likely a GLOF

Recent outrage in Sikkim over an Indian Army expedition climbing <a href="https://nepalitimes.com/here-now/saving-kangchenjunga">Kangchenjunga</a>, the world’s third-highest peak, has spiked attention to the need to balance mountaineering jobs with indigenous reverence for sacred landmarks. Kangchenjunga (8,586m) is not a peak as much as it is a mountain range with 16 peaks above 7,000m on the border between India and Nepal -- the word itself means ‘five treasures of the snows’ in Tibetan. Some of the highest prominences like Kangchenjunga West and Kangbachen are in Nepal, while the Main, Central and South Peaks are on the border. Climbing the peak from the Indian side has been banned since 2001 because the indigenous Lepcha community there regard the mountain as the abode of Dzoe-nga, the patron deity of Sikkim, which was an independent Himalayan Kingdom until it was annexed by India in 1975.&nbsp; Buddhists in Sikkim say their saint, Padmasambhava, recognised the mountain as a protective spirit. The state has declared the base of the mountain Kangchenjunga National Park, which covers an area one-third of Sikkim. ‘The act of scaling this sacred peak is not only a matter of serious concern but also a violation of both the prevailing legal provisions and the deeply held religious beliefs of the people of Sikkim,’ read a letter from Chief Minister Prem Singh Tamang (Golay) to Amit Shah, India’s Minister of Home Affairs and Cooperation.&nbsp; Tamang continued: ‘We further request Your Honour to take up the issue with the Government of Nepal to ensure that no future expeditions are permitted on the sacred mountain, in deference to the deeply held beliefs and cultural values of the people of Sikkim.’ Kangchenjunga was climbed for the first time exactly 70 years ago by a British team who told King Tashi Namgyal, the Choegyal of Sikkim, that they would not set foot on the summit. Photo: THE VOICE OF SIKKIM / FACEBOOK</figcaption> </figure>  <a href="https://nepalitimes.com/here-now/peak-climbing-season-2025-s4abrxny">This spring climbing season</a> alone, there were 70 climbing permits for foreigners issued for Kangchenjunga by the Nepal government, and made it to the top while one French climber died.&nbsp; One of the expeditions this year was an Indian Army team led by Col Ranveer Jamwal, who has summited the highest peaks on all seven continents, and Mt Everest thrice. Jamwal’s team was on the final leg of a ‘<a href="https://economictimes.indiatimes.com/news/india/nimas-summits-mt-kangchenjunga-concludes-historic-har-shikhar-tiranga-mission-successfully/articleshow/121341315.cms?from=mdr">Har Shikhar Tiranga</a>’ (The Tricolour on Every Peak) mission to plant the Indian flag at the highest points of each of India’s 28 states. Kanchenjunga was the last peak they had left, and the hardest, but the expedition put five climbers on the summit. What seems to have incensed the Sikkimese is that while it has banned climbing the mountain from its side, it was an Indian military expedition that went to Nepal to climb the mountain. After news broke of the climb in May, the Sikkim Indigenous Lepcha Tribal Association asked people to observe purification ceremonies in temples across the state. Mayalmit Lepcha of the association acknowledged that the Sikkim government was also partly at fault: “I don’t think such an expedition could have gone forward without the state government being informed, so it could have done something to intervene. It shows weakness. What’s done is done, all we can do is carry out these sanctification ceremonies.”&nbsp; In 2000, one year before Sikkim’s ban, the state allowed an Austrian team to attempt Kanchenjunga’s northeast face for a fee of $20,000, on agreement that they would stop 10m before the summit. Despite this, there was outrage over the expedition on the grounds that it violated Indian laws regarding the defiling of religious sites and Sikkim’s rights to maintain its culture after merging with India. The Indian Army expedition was also seen to have circumvented Sikkim’s law and violated religious sensibilities by going through Nepal. While the team may have thought they were respecting Sikkim’s beliefs by finding a way to complete the mission, the people of Sikkim saw it as defilement.&nbsp; The somber mood of the Sikkim people at the ritual contrasts sharply with Jamwal’s sense of accomplishment. “Without a doubt, the most difficult summit of my life,” he told reporters after the climb. “It tested every ounce of our will.”&nbsp;  <figure> <img src="https://publisher-publish.s3.eu-central-1.amazonaws.com/pb-nepalitimes/swp/asv65r/media/20250628060616_ccfe079c78dab788d19fe2080ee8a5d5dcb11de4157316f6d94e5964da097157.jpg" data-media-id="editor_4" data-image-id="20250628060616_ccfe079c78dab788d19fe2080ee8a5d5dcb11de4157316f6d94e5964da097157" data-rendition-name="original" width="787" height="377" loading="lazy" alt="Kangchenjunga: too sacred to climb NT"> <figcaption>Prayer flags along the Sikkim-Kangchenjunga trekking route. Photo: TREKKINGININDIA.COM</figcaption> </figure>  The <a href="https://nepalitimes.com/news/the-rise-and-fall-of-nims-purja">controversial Nepali-British mountaineer Nirmal Purja</a> was also on Kangchenjunga this spring the mountain, on a mission to summit all 14 8,000m peaks for a third time. He echoed Jamwal about the tough conditions: “The conditions above camp were extremely tough, with deep snow and challenging terrain—more crevasses than usual.” Nepal’s government has not said anything publicly, but it is unlikely that it will ban climbing on Kangchenjunga, since it is becoming popular with expeditions because of its technical challenges, and overcrowding on Mt Everest. Nepal does have bans in place for some of its mountains out of respect for local beliefs. <a href="https://nepalitimes.com/banner/to-open-machapuchre-for-mountaineering-or-not">Mt Machapuchre</a> (6,990m) the imposing pyramid that looms over Pokhara, for example, is seen as an icon of purity by the Gurung people and a symbol of Vishnu by the Hindu communities who live at its base. A strict climbing ban has been in place since 1957, when a British expedition led by Col Jimmy Roberts stopped 45m short of the summit – either because the last bit was too difficult or out of deference to local sentiments.&nbsp; Khumbila that stands above Namche Bazar is only 5,761m high, but like Kanchenjunga is considered the protector deity of the Sherpa people. Gauri Shankar on the Nepal-China border, called Chomo Tseringma by the local community, was off-limits between 1965 and 1979 due to its association with Lord Shiva and Gauri, his consort. Although expeditions are now allowed, there are not too many takers. In Tibet, climbing Mount Kailash is prohibited by the Chinese government because it revered by the Hindus, Buddhists and followers of the Bon faith. Even Mt Everest is regarded as sacred, and its Sherpa name is Chomolungma, Goddess Mother of the Earth.&nbsp; Economically, climbs on Kanchenjunga bring in decent revenue. This climbing season, the 41 permits, at $1,800 each, brought in $73,800. This is somewhat comparable to Makalu, Lhotse, and Annapurna I, but these numbers are dwarfed by the $4 million in <a href="https://nepalitimes.com/news/the-everest-industry">Everest permits</a>. Revenue from Kanchenjunga climbing permits is something Nepal could potentially forgo if necessary, but the expeditions also provide jobs to hundreds of high altitude guides, porters, base camp support staff and other logistical costs.&nbsp; As the third highest mountain in the world and the tallest in India, there will always be significant motivation to climb it from the Nepal side, especially as climbers are drawn by the technical climbing at high altitude.

Kangchenjunga: too sacred to climb?

In 2023, northern India suffered record-breaking heat. In 2024, it broke its own record. In 2025, the Indo-Gangetic plains and the Nepal Tarai suffered a prolonged pre-monsoon heat wave and humidity, forcing closure of schools and workplaces. This week, <a href="https://www.dw.com/en/europe-heat-wave-intensifies-as-fresh-warnings-issued/live-73108302">southern Europe is suffering the worst heat wave</a> since temperature records began. Football matches, tennis tournaments have been affected, and tourist sites have been closed off. Qatar has ordered a midday work curfew for Nepali and other migrant workers are the maximum temperature this week touched 45°C.&nbsp; Kathmandu Valley experienced its highest temperature in 25 years in May 2024 at 35.3°C. This year, the maximum temperature exceeded 30°C on many days — heat that till a decade ago would be considered unusual. Rains in early June also meant that towns in the mountains sweltered under high heat plus humidity.  <figure> <img src="https://publisher-publish.s3.eu-central-1.amazonaws.com/pb-nepalitimes/swp/asv65r/media/20250703090748_6975cfc2ad573f3a09ca301a299a9e92a420da7f1c5c90b8e4d061a2053dcd3e.jpg" data-media-id="editor_1" data-image-id="20250703090748_6975cfc2ad573f3a09ca301a299a9e92a420da7f1c5c90b8e4d061a2053dcd3e" data-rendition-name="original" width="1935" height="801" loading="lazy" alt="maximum average temperature in Kathmandu"> <figcaption>Source: DHM</figcaption> </figure>  Measuring just temperature does not give a true picture of how hot it is. When humidity is factored in, the heat index this summer has been much higher in northern India and Nepal. Also, the hotter the air temperature the higher the concentration of water vapour in it. “We feel it is getting hotter, and our statistics back that up,” says Shanti Kandel at the Department of Hydrology and Meteorology, which issued two heat wave warnings this year, compared to 11 last year. “We need more research to analyse how humidity is make this situation worse.” <a href="https://economictimes.indiatimes.com/news/india/india-faces-alarming-30-rise-in-moist-heat-stress-over-40-years-affecting-wide-swath-of-country-imd-study/articleshow/109376863.cms?from=mdr">A recent analysis</a> by the Indian Meteorological Department has found that heat stress in that country has increased by nearly 30% over the past 40 years. Similarly, India’s Council on Energy, Environment and Water (CEEW) noted that cities like Delhi, Chandigarh, Jaipur, and Lucknow have experienced a 6-9% rise in relative humidity in the last decade.&nbsp; It also states that <a href="https://www.reuters.com/sustainability/climate-energy/majority-indian-districts-face-high-heatwave-risk-study-shows-2025-05-20/#:~:text=%22About%2057%20per%20cent%20of,usual%20number%20of%20heatwave%20days.">60% of Indian districts</a>, home to three-quarters of the country’s 1.3 billion people face a high to very high risk from extreme heat, with rising night-time temperatures and humidity. The heat index is also called ‘<a href="https://nepalitimes.com/here-now/north-indian-heat-wave-hits-nepal">wet-bulb temperature</a>’ and is a measure of how hot the human body feels when humidity levels are also high — usually much hotter than the recorded temperature. For example, a wet-bulb temperature of 35°C is considered the maximum limit of heat and humidity that humans can handle, beyond which the body cannot cool by perspiration, leading to death. One indicator of increasing humidity is a rise in average minimum temperature, and Nepal recorded the highest figure since 1981 last year, with a peak of 15.8°C. Higher minimum temperature denotes warmer nights, which in turn is an indication of heat stress caused by increasing humidity, which in turn is a result of global warming. Aside from higher average temperatures worldwide this year, what makes heat and humidity more unbearable is that cities are always hotter than their surroundings. This is due to the <a href="https://nepalitimes.com/opinion/comment/preparing-for-kathmandu-s-heat-waves">urban heat island (UHI) effect</a> – for example the temperature inside Kathmandu’s Ring Road can be hotter by <a href="https://www.epa.gov/heatislands/what-are-heat-islands">up to 4°C during the daytime and by 1 to 3°C in the evening</a> compared to the outskirts. “Climate change is one reason for rising temperature, but there are other factors like increased heat in urban spaces due to concrete buildings and infrastructure, emissions from vehicles, industries, and home appliances,” explains urban planner Bhushan Tuladhar. He adds: “Much of this comes down to how we have developed our cities, not just our roads and buildings but also our water system, waste management, culture and customs as well as economy.” There is a feedback loop at work: as it gets hotter, more energy is used for fans, coolers, and air-conditioners which in turn add to the urban heat bubble. The way to reduce the UHI effect is to have more parks, tree-lined streets and water bodies to cool cities down.&nbsp; <a href="https://www.sciencedirect.com/science/article/abs/pii/S2212095525002093">A recent study published in the journal Urban Climate</a> by Nepali researchers at the University of Massachusetts, Tribhuvan University, University of Groningen, etc showed that even within Kathmandu, urban forests cooled neighbourhoods by as much as 1.2°C while ponds reduced the temperature by up to 0.85°C compared to nearby houses.&nbsp;  <figure> <img src="https://publisher-publish.s3.eu-central-1.amazonaws.com/pb-nepalitimes/swp/asv65r/media/20250703090748_e4de75dbdfb5fcfdeb0935eda364dc16b5dca8857ba335ab0f4586ebdc5093a9.jpg" data-media-id="editor_8" data-image-id="20250703090748_e4de75dbdfb5fcfdeb0935eda364dc16b5dca8857ba335ab0f4586ebdc5093a9" data-rendition-name="original" width="2580" height="1038" loading="lazy" alt="urban heat island in Kathmandu"> <figcaption>Source: URBAN CLIMATE et al.</figcaption> </figure>  ‘Our results demonstrate that blue-green spaces provide significant cooling benefits across the Kathmandu Valley, with distinct patterns by type, size, design, and urban context,’ concluded the paper, whose lead author is Saurav Bhattarai at Jackson State University in the United States. The old towns in Kathmandu Valley with traditional brick and tile architecture, ponds and trees managed hot summers better. Compact houses around a courtyard gave people just the right amount of sunlight, and use of clay mortar and bricks insulated houses in winter while cooling them in summer. There were open spaces, fertile land along the floodplains for farming, and brick pavements that allowed for seepage. “Our cities were planned taking nature into account,” says Sangeeta Singh, a professor of urban planning at the Institute of Engineering. “Kathmandu Valley is now built up, but we can still reintegrate blue-blue spaces into town planning with vertical gardening, urban forestry, using local material and harvesting rainwater.”&nbsp; Kathmandu’s municipalities have by-laws controlling building design and structure, but strict enforcement of land use and zoning are missing. Extreme heat disproportionately affects the urban poor who may not have access to fans or air-conditioners, exacerbating poverty.&nbsp; Cities in the plains have it even worse. As heat and humidity rise simultaneously, it could <a href="https://nepalitimes.com/banner/garmi-se-behal-chalo-nepal">reverse the current mass migration</a> of people from the mountains to the Tarai, where 53% of Nepal’s population lives. <a href="https://thedocs.worldbank.org/en/doc/92fbbbc6180238e18e7b239fad83e38a-0280032024/original/12-DHNT-Temperature-poverty-inequality-September-2024.pdf">A World Bank study</a> put the cost of a 1°C rise in temperature at 17.1% increase in poverty globally. Estimates put the total number of urban poor in developing countries exposed to the worst heat extremes at 26 million presently, this number is bound to grow to 215 million by mid-century, an over eight-fold increase. Meanwhile, 489,000 health-related deaths occur each year, 45% of them in Asia alone. “Heat has to be seen from a class perspective,” says Singh. “Those with money can afford gadgets and appliances to keep their homes and offices cool, but not day labourers or poor families living in cramped housing with poor ventilation.” Climate breakdown is going to widen the class divide in cities, as <a href="https://nepalitimes.com/banner/unthinkable-in-the-current-climate">summers become unliveable</a>. Says Singh: “We need policy intervention to address this class injustice. Our building by-laws and new town development must urgently integrate climate and energy efficiency elements.”

In the heat of the moment

The debate about who is less accountable to the public: politicians or bureaucrats is as old as Nepal’s democracy itself.
Some blame politicians for being beholden to the businessmen who finance their electoral campaigns, and are forced to return the favour with contracts and kickbacks when in power.&nbsp;
Others say it is civil servants who are neither civil nor servants, and know the inner workings of the system to exploit loopholes – they then teach ministers, MPs, mayors, or ward chairs which juicy projects can be squeezed. And everyone gets their share.
In reality, it is probably not a case of either, or. Both have their hands deep in the honey pot. Corruption is now such a given that yet another exposé in the mainstream press, like the latest visit-visa scam, does not raise eyebrows anymore.
We may have to edit Lord Acton’s famous quote to say that in Nepal we do not even need absolute power to corrupt absolutely. The ruling cartel has divvied up the spoils, so that no one ever faces charges. The three parties all know about the skeletons rattling in each other’s closets, and they cancel each other out.
Politicians and bureaucrats get all the blame for taking bribes, but what of the givers of bribes? In this crony capitalism, businesses invariably need political patrons in an elaborate <a href="https://nepalitimes.com/here-now/nepals-only-growth-industry-private-sector-corruption" target="_blank">national network of give-and-take</a>.
<a href="https://nepalitimes.com/here-now/nepals-only-growth-industry-private-sector-corruption" target="_blank">Politicians and businesses work hand-in-glove</a> so that conflict of interest in contracts, insider trading, cartelling, and non-performing assets of banks become the norm. Our survey after the 2017 local election showed that out of the 753 newly-elected local government chairs, <a href="https://nepalitimes.com/news/elected-contractors" target="_blank">nearly 300 were contractors</a> involved in sand-mining, quarrying, or transportation syndicates.
Nepal’s tycoons have discovered that instead of donating to election war chests of politicians, it is a much surer return on investment to spend the money to <a href="https://nepalitimes.com/news/the-business-of-politics-in-nepal" target="_blank">become legislators and politicians themselves</a>.
In democracies, there are checks and balances to control corruption when it becomes endemic. The Nepal Police and Central Bureau of Investigation (CBI) are supposed to do the detective work without political interference. The courts are required to be independent in dispensing justice and punishing crooks.
But the less said about the judiciary the better. A writ petition in the Supreme Court last week accused our sister magazine <a href="https://www.himalkhabar.com/" target="_blank">HimalKhabar</a> of contempt of court for two stories: one about how high courts have been overturning a majority of verdicts of district courts in cases of rape, and another about the Biratnagar High Court clearing a self-proclaimed holy man, Krishna Bahadur Giri, of rape despite police presenting physical evidence.
The doctrine of the separation of powers stipulates that it is when the other three pillars in a democracy are compromised that the role of the free press becomes even more vital. The world over, as soon as populist autocrats are elected to the executive, their first order of business is to co-opt the legislature and the judiciary. Then they buy off, intimidate, or neutralise the media with Strategic Lawsuits Against Public Participation (SLAPP).
Nepal’s officialdom seems to be taking midnight Zoom lessons from other despots on how to gag the media. Last month, popular talk show host Dil Bhushan Pathak was served an arrest warrant by the Kathmandu District Court for <a href="https://www.youtube.com/watch?v=-CntsnTrtG8" target="_blank">a YouTube explainer</a> about the alleged involvement of the son of Foreign Minister Arzu Deuba Rana in a reported purchase of Kathmandu’s Hilton Hotel.
The Lalitpur District Court ruled that Pathak could not be arrested without fair trial, but this week the Kathmandu District Court filed another case against the journalist based on a complaint by the Cyber Bureau, and put him on a fugitive list.&nbsp;
Without going into the veracity of Pathak’s explainer, it is deeply problematic that the Electronic Transaction Act has been invoked – proof that politicians are getting the courts and investigating agencies to make an example of a high profile journalist.&nbsp;
The intention is to silence media investigations into the fake refugee scandal in which the main partner in the ruling coalition is implicated, and in which one of its former home ministers was jailed last year.
The Kathmandu High Court has been mysteriously active in targeting journalists these days. <a href="https://bizmandu.com/" target="_blank">Bizmandu</a> and <a href="https://nepalkhabar.com/" target="_blank">Nepalkhabar</a> were served a notice last month <a href="https://nepalitimes.com/news/no-freedom-after-expression-y4inku06" target="_blank">to withdraw a story they did</a> on the Chair of the <a href="https://www.sebon.gov.np/" target="_blank">Security and Exchange Board of Nepal (SEBON</a>) Santosh Narayan Shrestha allegedly demanding kickbacks from hydropower investors.&nbsp;
Incredibly, the court even asked the two portals not to report on the subject anymore – a ruling so absurd that the Patan High Court overturned it a week later.&nbsp;
The allegations against Shrestha were made in a public meeting of the <a href="https://www.ippan.org.np/members/3060/bungal-hydro-ltd" target="_blank">Independent Power Producers Association of Nepal (IPPAN)</a>, and MPs demanded a <a href="https://myrepublica.nagariknetwork.com/news/parliament-demands-probe-into-sebon-chairman-over-alleged-commission-demand-40-32.html" target="_blank">Parliament inquiry</a> into the regulator. <a href="https://www.himalkhabar.com/144523/santosh-narayan-shrestha" target="_blank">HimalKhabar</a> reported this week that while Shrestha was reportedly demanding commissions from private investors for IPOs, he cleared primary share sales in Bajhang’s 10.75MW <a href="https://www.ippan.org.np/members/3060/bungal-hydro-ltd" target="_blank">Bungal Hydro</a> in which his family members have investments, company records show.
And then just on Monday, bureaucrats hoodwinked MPs by deleting references in a bill requiring a two-year ‘cooling off’ period under which retiring civil servants could be barred from holding constitutional positions for two years.
The contest for who is more corrupt: bureauacrats, politicians, or the private sector is on.
