People, after all, are entitled to lead dignified lives without others prying into their intimate affairs.However, some of the provisions of <a href="https://www.nepalitimes.com/banner/strongman-rule/" target="_blank" rel="noopener">the new Criminal Code Act</a> and the draft Privacy Bill <a href="https://www.nepalitimes.com/banner/suppressed/" target="_blank" rel="noopener">violate the principles of press freedom in a democracy</a>, and deliberately blur the lines between what is private and public. If these provisions are not amended, they will lead to the demise of journalism in this country. In fact, the laws appear to be designed to do just that. Read also: <a href="https://www.nepalitimes.com/banner/gagging-the-press-in-installments/" target="_blank" rel="noopener">Gagging the press in installments</a>, Sewa BhattaraiIt is in a journalist’s Code of Ethics that a private individual’s privacy should not be infringed upon. However, the Criminal Code twists this right to also include the privacy of those who hold public office. Citizens in a democracy have a right to know what public figures do, what they own, what they say in public or private.The new Code and Privacy Bill attempt to <a href="https://www.nepalitimes.com/banner/gagging-the-press-in-installments/" target="_blank" rel="noopener">gag the media and restrict the journalist’s role to hold power to account</a>. For example, they criminalise morphing of images. But the media democracies often employ photo montages as satire to better illustrate a story and drive home the message more clearly. The Code would also essentially <a href="https://www.nepalitimes.com/from-the-nepali-press/cartoonists-hit-at-restrictions/" target="_blank" rel="noopener">silences cartoonists</a>, since the definition of what can be construed as ‘ridicule’ is left so broad. Read also: <a href="https://www.nepalitimes.com/banner/suppressed/" target="_blank" rel="noopener">Suppressed</a>, Om Astha RaiLast week, the editor of Himal Khabarpatrika called me to tell me that he was going ahead with a morphed image on the magazine’s cover. He said he was trying to push the boundaries even though the Bill and Act expressly prohibit photo manipulation. It was a test. Having once served as editor of this weekly news magazine which has historically confronted the absolute monarchy and the extreme left to uphold press freedom, I felt it was important for Himal Khabarpatrika to once more stand up for its core values.  The cover image of Home Minister Ram Bahadur Thapa is photoshopped to show him in police uniform. The message here is the <a href="https://t.co/cLnwlgWQKA" target="_blank" rel="noopener">minister’s attempt to interfere with the Nepal Police</a> at a time when there have been a series of lapses in the way cases of rape, gold smuggling and restriction on the people’s freedom of movement have been handled. To be sure, the Criminal Code does not allow the media to manipulate photographs. But our point is that the media is here using the image of a public figure to make an important point about collusion and political interference. If Thapa was not Home Minister, doctoring his photograph to show him in police uniform could be construed as an infringement of his privacy. But he is a public figure who had made a series of controversial moves that affect the rule of law, and it is the media’s role to bring this to the notice of citizens in the clearest possible way. Press freedom must be defended by its maximum application

Vatsyayan in Kantipur, 25 August</figcaption></figure>It has only been two weeks since Nepal’s new Penal Code criminalised photography (Section 295), slapped heavy fines and jail terms for recording conversations (Section 293), and announced strict punishment for sending, receiving or using online data (Section 298). Another privacy-related bill in Parliament will prohibit people from publishing personal information of public officials. But it has already had a <a href="https://www.nepalitimes.com/banner/suppressed/" target="_blank" rel="noopener">chilling effect across the Nepali media</a>.A person who ridiculed the prime minister on Facebook was tracked down and arrested for photo-manipulating the prime minister's photo, which violates Section 295 of the Code. Editors of Nagarik, Annapurna Post and Kantipur were summoned to the Press Council for interrogation.Photojournalist Usha Titikshu was taking a photo of a damaged CCTV camera at an airport recently, when she was stopped. “Don’t you know the new rules about not taking photos?” she was warned.If enacted earlier, the new laws would have forced editors to spike their recent investigative reports on the Chief Justice’s doctored certificates, photos showing collusion between top politicians and medical college owners, and stories of corruption in high places.The Federation of Nepalese Journalists last week issued its Godavari Declaration demanding that the provisions be immediately rescinded. The International Federation of Journalists (IFJ), The Committee to Protect Journalists (CPJ), Reporters without Borders (RSF) and others <a href="https://www.nepalitimes.com/latest/amend-criminal-code-rsf/" target="_blank" rel="noopener">all condemned the move</a>, demanding that Nepal adhere to the international standards and principles of freedom of expression.Although the constitution guarantees press freedom as an inviolable right, the laws try to enforce constitutional provisions protecting a citizen’s right to privacy more strictly, even extending it to public figures.Read also: <a href="https://www.nepalitimes.com/banner/strongman-rule/" target="_blank" rel="noopener">Strongman rule</a>, Om Astha RaiPress adviser to the prime minister and former editor Kundan Aryal admits that a free press is important, but says the Nepali media has failed to self-regulate."Journalists do not rein themselves in, they feel free to make derogatory comments, especially about women. It is necessary to regulate the press,” he told Nepali Times. Such talk has already had a dampening effect, with editors and reporters now more wary of publishing information in the public interest. The fear is that the laws are so broadly defined and open to interpretation, anyone can be hauled over for anything.The crackdowns started coming thick and fast after the Nepal Communist Party government was elected to power in January: it consolidated the surveillance arms of the state in the PMO, proposed restrictions on advocacy through the National Integrity Policy, and banned popular areas for protest. Photographer Chandra Ale of Onlinekhabar recently faced questions when he was at Kalimati vegetable market where traders had locked up government inspectors. “A person asked me if I had permission to take photos. He followed me, and forced me to delete my pictures,” Ale relates.Photojournalist Usha Titikshu thinks there is a systematic plan to gag the media. “Threats to journalists are more common across South Asia, and we have not connected the dots to see that the same is happening in Nepal,” says Titikshu, citing the rape and deaths of journalists in India and <a href="https://www.nepalitimes.com/banner/the-death-of-democracy/" target="_blank" rel="noopener">the arrest of noted Bangladeshi photographer Shahidul Alam</a> who is being mistreated in jail. “We see our own government moving towards similar intolerance in Nepal.”Ujjwal Acharya, South Asia coordinator of IFJ and digital media watcher says: “Today one thinks twice before posting anything on social media. By the looks of it, the government intends to curtail all kinds of expression, especially investigative journalism.”Says Nagarik editor Gunaraj Luintel who answered an unprecedented summon from the Press Council: “It was overstepping its mandate, even asking me to explain a mistake in print to the parties involved. The council is only supposed to promote ethical journalism, but it has become an arm of the government. The aim is to increase censorship in a planned way.”Narayan Wagle, editor of Kantipur, was also summoned by the Press Council for the first time in his 30-year career, and says the it has outlived its usefulness.“The practice in democratic countries is that the government does not monitor the press. The press monitors itself through a code of ethics. But in Nepal, a new law about the Press Council is in the offing, which proves the government wants to further tighten the noose around the press.”Bikas Karki, president of Photo Journalists’ Club, agrees that the government’s real intention is control: “The Constitution has become like the elephant’s tusks, it is there just for show. The laws are the real teeth inside, which bite.”Nepal has gone through censorship before. The Panchayat system banned political parties, and the royal palace strictly controlled the press. In 2005, King Gyanendra tried to take the country back to those dark days. Some say the new Code is even worse than the Panchayat.“There were threats then, but they were verbal or even unspoken,” recalls photojournalist Gopal Chitrakar, who started out at Gorkhapatra during the Pancahayat. “I don’t remember such draconian measures. These new rules are in writing, they are backed by the law. That gives them legitimacy which is more dangerous.” Kundan Aryal reassured us that the Code and laws can always be amended. But this does not convince journalists who say the laws that restrict media freedom are inherently anti-democratic, unconstitutional and remove its check-and-balance function. Laws that are broadly defined are even more dangerous, and can be a path to authoritarianism.Read also: <a href="http://archive.nepalitimes.com/article/nation/varying-press-freedom-in-burma,1261" target="_blank" rel="noopener">Too little, or too much freedom</a>, Kunda Dixit <h4>The right to say the emperor is naked</h4> Satire flourishes best and is most prolific when there are controls on free speech, and Haribansa Acharya should know. He says he performed his most fulfilling and creative skits during the Panchayat.“Saying ‘17 Sal’ out loud was banned, since it was the year of King Mahendra’s coup. So we got away by saying ‘the year between 16 and 18’,” remembers Acharya. “We also called Prime Minister Surya Bahadur Thapa ‘Gham’ instead of Surya. We played cat and mouse with the censors, and it was more fun and creative. Today’s satire seems to lack that art.”Satire, in fact, seems less necessary when there is full freedom, but it is a lifeline during restrictive times. Even during the absolutist Rana and Shah reigns, the royals knew citizens needed to let off a little steam. So, they allowed one day in a year on Gai Jatra (on 27 August this year)when people had freedom to say anything. <figure><img width="1200" height="841" src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221107141112/636904bf9c7e80680e037d3ejpeg.jpg" alt=""><figcaption> </figcaption></figure>Culture expert Tejeswor Babu Gongah remembers Gai Jatra revelers burning an effigy of the Panchayat, an act that would have people locked up on any other day of the year."Humour is one space where you can raise issues that you cannot elsewhere, therein lies its power to question authority,” he adds.Some have noted that this year’s Gai Jatra seemed subdued, with fewer shows. On social media, there were comments that satirists had already started self-censoring because of the new Criminal Code.Satirist Manoj Gajurel, who has made a career out of lampooning kings, prime ministers and guerrilla commanders, says: “Humour has a social responsibility to carry the people’s message to authority when it refuses to listen to direct communication.”However, an elected government now wants to take away that right of Nepalis to poke fun at power. Section 306 of the Code specifically prohibits ‘satire’ and categorises it under libel, and Section 295 prohibits caricatures.“I feel a great sense of dread,” admits cartoonist Durga Baral, who went underground during the Panchayat but continued to produce cartoons under the pen-name Batsyayan, despite threats."Freedom of expression is our basic right, and if we are not free to speak out, it all gets bottled up inside.”Nepali cartoonists are pushing back. Last week, Rabin Sayami drew a savage cartoon that tore the government to shreds over its callousness in not investigating the Kanchanpur rape case, and killing a protester. It depicted a smiling Pushpa Kamal Dahal and a smug Prime Minister Oli with a smoking gun in his hand (above). The rapist holds a bloody knife, and has his back turned. Two photos of the rape victim and a dead protester hang on the wall.Sayami was warned by friends to be careful, and that he might be sent to jail. He says the cartoon was a test: “To see if we are still a democracy.”Read Also: <a href="https://archive.nepalitimes.com/article/Nepali-Times-Buzz/saparu-the-festival-of-death-and-rebirt,2543" target="_blank" rel="noopener">Saparu</a>, Sonia Awale<a href="http://archive.nepalitimes.com/news.php?id=11225#.W4fAI84zbIU" target="_blank" rel="noopener">Festival of death and satire</a>, Desmond DoigCode wordsWhile Nepal's journalistic community is up in the arms about the latest Criminal Code, lawyer Madhav Basnet says it is not as worrying as perceived, for the following reasons: <ul><li>The 1990 Constitution was the first one to clearly mention the right to privacy.</li><li>Nepal has a long history of laws against slander and libel, even in Jang Bahadur's Muluki Ain of 1853.</li><li>The Criminal Code does not specifically mention any profession like writers, journalists or photojournalists.</li><li>The conduct of journalists is covered by other laws related to the media, which remain unchanged. The Criminal Code mentions that it will not supersede laws relating to specific professions.</li><li>With social media, it is not just journalists and photographers who take photos, collect and disseminate information, but everyone. The Code is only prescribing limits for them.</li><li>The law, however, does apply to journalists if they are not transmitting through the mass media.</li><li>The Criminal Code is not the guarantor of freedom of expression, the Constitution is. That freedom is not without its limits, and the limits are also mentioned in the Constitution. However, nothing can take away that freedom. Gagging the press in installments

<img src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221107141112/636904739c7e80680e037d23jpeg.jpg" alt="" width="1500" height="1000"/>On 5 August, <a href="http://archive.nepalitimes.com/article/Nepali-Times-Buzz/best-years-of-their-lives-migrant-workers,3722" target="_blank" rel="noopener">Bangladeshi artist, writer and organiser Shahidul Alam</a> was interviewed on Al Jazeera about <a href="https://www.theguardian.com/world/2018/aug/05/bangladesh-pm-urges-teen-protesters-to-go-home-amid-violence" target="_blank" rel="noopener">student protests triggered by the deaths of schoolchildren run over by a public bus</a>.Alam said that the anger of the protesting youth were not just with the transportation sector but the dire situation of the country as a whole. He outlined a litany of everything that was wrong in Bangladesh: “The looting of banks, the gagging of the media, the extra-judicial killings, the disappearances, the need to give protection money at all levels, bribery at all levels, corruption in education.”That very day, security personnel in plainclothes arrived at Alam’s Dhaka home in the middle of the night and <a href="https://www.washingtonpost.com/world/2018/08/06/bangladeshi-photographer-shahidul-alam-arrested-over-provocative-comments/?noredirect=on&amp;utm_term=.9b6c0afa5357" target="_blank" rel="noopener">took him away without any explanation or warrant</a>. When he was presented before court a few days later, <a href="https://www.youtube.com/watch?v=iEeyhQNU8fg" target="_blank" rel="noopener">he was limping and had to be held up as he walked</a>.Read also: <a href="https://www.nepalitimes.com/latest/freeshahidulalam/" target="_blank" rel="noopener">#FreeShahidulAlam</a>He had obviously <a href="https://www.nytimes.com/2018/08/08/world/asia/bangladesh-photographer-shahidul-alam.html" target="_blank" rel="noopener">been tortured in custody</a>. Soon after, he was charged with Section 57 of Bangladesh’s Information and Communications Technology Act (ICT) for ‘spreading propaganda and false information against the government’. Alam was denied bail. If convicted, he could face a seven-year sentence.The blatantly unjust and politically motivated arrest of Shahidul Alam <a href="https://www.theguardian.com/commentisfree/2018/aug/08/the-guardian-view-on-shahidul-alam-bangladesh-should-let-him-go" target="_blank" rel="noopener">has been widely condemned</a> and there have been petitions <a href="https://www.aljazeera.com/news/2018/08/calls-grow-release-bangladeshi-photographer-shahidul-alam-180811145247788.html" target="_blank" rel="noopener">for his release from all parts of the world</a>. The attention this case has received partially has to do with Alam’s extraordinary achievements and his international fame.As a photojournalist, he has received widespread acclaim for revealing that the marginalised are active agents rather than victims and his visceral depictions of state brutality. But Alam is equally known as an institution builder and a mentor for younger photojournalists. He founded the Drik Picture Library photo agency, the ChobiMela, one of South Asia’s most prestigious photo festivals, and the Pathshala South Asian Media Institute which has trained hundreds of photographers, including from Nepal.But the case has far-reaching implications that go beyond Shahidul Alam as an individual, and even beyond Bangladesh. The arrest has to be seen in light of worrisome trends that have begun to afflict large sections of the world, including many countries in the South Asian region.Broadly speaking, this has to do with the attack by the state upon what is often called ‘freedom of expression’.In recent months, governments in South Asia have tried to criminalise all criticism of the government, both by publicly prominent personalities and by private citizens expressing themselves on social media.Read also: <a href="https://www.nepalitimes.com/banner/suppressed/" target="_blank" rel="noopener">Suppressed</a>, Om Astha RaiIn Bangladesh, several people have been arrested for posting or sharing comments critical of the government on Facebook. The government there is planning to replace the notorious ICT act with even more draconian legislation. In Myanmar, journalists reporting on the <a href="https://www.nepalitimes.com/here-now/living-on-the-margins/" target="_blank" rel="noopener">Rohingya crisis</a> have been arrested and charged with violating the Official Secrets Act.In the past week, several high profile activists and intellectuals have been arrested in India in what is clearly a vendetta on the part of the government. And in Nepal too, the government has <a href="https://www.nepalitimes.com/banner/suppressed/" target="_blank" rel="noopener">passed legislation that would prevent journalists from reporting on state activity</a>.Read also: <a href="https://www.nepalitimes.com/banner/strongman-rule/" target="_blank" rel="noopener">Strongman rule</a>, Om Astha RaiGovernments have claimed that such measures are necessary to preserve national security. In order to maintain their power, rulers in the region have tried to instigate nationalist sentiments among the population. Organisations campaigning for greater justice have been vilified as tools of foreign countries.The intention behind these efforts is clear. Governments want to establish their own interpretation of history and current events as the only legitimate one. They want to be left free to bulldoze decisions without having to confront independent civil society groups. And in the process, they are trying to create populations that are fearful, inward looking and xenophobic.The campaign for the release of Shahidul Alam is not just about an individual who has been unjustly persecuted. More broadly, it is a campaign to resist the steady encroachment upon democratic space across the region. It is a campaign against a narrow-minded nationalism and the arbitrary use of power. A campaign that stands for tolerance, the rule of law and the rights of the most marginalised people.During her visit to Kathmandu for the BIMSTEC conference, Prime Minister Sheikh Hasina <a href="https://www.nepalitimes.com/latest/freeshahidulalam/" target="_blank" rel="noopener">would do well to realise that her government has only lost international legitimacy by arresting Shahidul Alam</a>. His immediate release will be an important first step towards restoring the Bangladesh government’s credibility.Other heads of government visiting Nepal should similarly recognise that attacks on journalists and members of civil society only serve to increase hostility and anger towards the ruling authorities. The aim is to draw the attention of Bangladesh Prime Minister Sheikh Hasina who arrives on Wednesday to attend the Summit.Alam is a <a href="http://archive.nepalitimes.com/article/Nepali-Times-Buzz/best-years-of-their-lives-migrant-workers,3722" target="_blank" rel="noopener">world-renowned Bangladeshi photographer, writer and activist</a> who was <a href="https://www.washingtonpost.com/world/2018/08/06/bangladeshi-photographer-shahidul-alam-arrested-over-provocative-comments/?noredirect=on&amp;utm_term=.c2f07f839123" target="_blank" rel="noopener">arrested from his home in Dhaka on 5 August following an interview on Aljazeera</a> in which he was critical of the Bangladeshi government's crackdown on student protests. Alam has been charged under Section 57 of draconian Information and Communication Technology (ICT) Act for 'spreading propaganda and false information against the government'.Read also: <a href="https://www.nepalitimes.com/opinion/the-death-of-democracy/" target="_blank" rel="noopener">The death of democracy</a>, Aditya AdhikariShahidul Alam was produced before the magistrate on 5 August, <a href="https://www.youtube.com/watch?v=iEeyhQNU8fg" target="_blank" rel="noopener">he could not walk unaided, and was barefoot</a>. He stated before the magistrate that <a href="https://www.nytimes.com/2018/08/08/world/asia/bangladesh-photographer-shahidul-alam.html" target="_blank" rel="noopener">he had been tortured in police custody</a>, that he had been blindfolded, his hands had been handcuffed behind his back, verbally abused; at the place where he had been interrogated, a heavy weight had been placed over his head and he had been asked whether he could feel its weight, he had been punched on the face, his clothes had become bloodied, it had been washed and dried and ironed before he had been produced in court, he had been accused of being a Mossad agent, had been threatened that Rahnuma Ahmed would be abducted, and that "pins" would be used the next time. Witnesses say he showed clear signs of physical abuse. However, the magistrate did not record his statement and did not arrange for his medical examination, although this is required under Bangladesh law.There have been <a href="https://www.theguardian.com/commentisfree/2018/aug/08/the-guardian-view-on-shahidul-alam-bangladesh-should-let-him-go" target="_blank" rel="noopener">appeals for his release from around the world by journalists</a>, academics, human rights actors and organisations such as Amnesty International, Committee to Project Journalists (CPJ) and the Pulitzer Center among hundreds of others. Most recently, Nobel Laureate Amartya Sen issued a statement, saying: 'Freedom of expression, including through photojournalism, is extremely important for democracy.  We have good reason to admire the work that Shahidul Alam has been doing with great skill and courage for many years. His work should receive praise and appreciation, rather than being ground for harsh treatment.' Alam's has been assaulted in custody, denied proper medical treatment, and denied proper access to his lawyer and family. As dusk fell over Kathmandu, the thunderstorm continued unabated. It had been raining continuously for 18 hours, and the forecast said it would keep raining at least till 8am on Sunday. The Bagmati roared through Chobhar Gorge in awesome rapids – the only drainage outlet for the entire Kathmandu Valley. Many had feared a repeat of the deadly flashfloods on 28 September 2024 in which 200 people were killed and half of Nepal's hydropower generation capacity siped out. The government has declared 5 and 6 October as a public holiday to prevent people from travelling during the Dasain festival, and to reduce risk. All highways in and out of Kathmandu closed till Monday. Flood-prone river corridor roads in Kathmandu have been closed after 6PM on Saturday. Meanwhile, all domestic flights were suspended from Kathmandu and other airports from 2PM Saturday, and most inbound international flights were diverted from 3PM onwards. Similarly, Gaur received 243.6mm, Kalaiya in Bara 200.6mm and Birganj 221.4mm. The Department of Meteorology did not blame climate change, but said the unusually heavy precipitation at a time when the monsoon is supposed to have ended was caused by the head-on collision between moisture-laden westerlies with the retreating monsoon.

More dark clouds over Nepal

Kathmandu: A Reader, the latest publication from Martin Chautari, is an anthology of anthropological essays exploring Kathmandu through various lenses across the 21st century. This compilation is edited by Benjamin Linder and attempts to bring modern discourses on Kathmandu and its urbanity together, in a single volume. The book is divided into three sections: the physical form of the city, the imprints it bears from past political upheavals, and the complexity in the lives of its people. The book examines these diverse aspects, leaving readers who have just witnessed the momentous events of September with anxiety, and perhaps a greater understanding of Kathmandu’s context. Urban planning expert Biresh Shah’s discourse on the Valley’s urban sprawl and its landmarks is insightful, but also prophetic when he warns about seismic risk.&nbsp; Jan Brunson’s chapter on female mobility in Kathmandu via scooters is more optimistic, suggesting small-scale, daily-life movements in Kathmandu transform the city for its various demographics — in this case young women.&nbsp; Linder himself contributes with a discourse on the toponymy of Thamel, close-reading Kathmandu’s tourist hub through the usage and understanding of its name over the ages. MYTHBUSTERS The book is a collage of pieces held together by a thread that runs through the chapters of a vibrant, bustling image of the Valley. One common theme is Linder’s attempt to expand on common understandings and urban myths about Kathmandu. Readers who have spent time in the city will relate to the many anecdotes. for example, Niels Gutschow bringing up the lack of open spaces, or Mark Liechty mentioning restaurants in Kathmandu being melting pots of cultures and castes.&nbsp; The essays here further extend these urban legends by giving historical and anthropological contexts. In-migration and the rise in land prices have led to shrinking open spaces, the creation of cosmopolitan food outlets, and even hubs for sex workers. The Bagmati cleanliness campaign extends to a past understanding of the Bagmati Civilisation. Urban myths become puzzles to be solved by connecting the various threads of discussion across the book. The sections in Kathmandu: A Reader are all by experts in their various fields and present a holistic, well-rounded picture. Yet, it is obvious there is still more ground to cover, more themes to explore — perhaps by more Nepali scholars.&nbsp; In his introduction, Linder admits that due to practical reasons, ‘many wonderful works were left on the cutting room floor’. That is a pity. Indeed, there could have been more discourse on the changing ethnic composition of Kathmandu. A close-read into the lives of people termed as ‘outsiders’ but forming a growing slice of the population would be important to also chart future trends. &nbsp; The religious importance of Kathmandu as a unique civilisational alloy forged by melding the Hindu and Buddhist faiths can be explored more too. One can imagine a future edition including an examination of the post-Covid era Kathmandu valley.&nbsp; This need to broaden the ethnographic literature on Kathmandu becomes more apparent because 11 out of the 15 essays here are written by non-Nepali scholars, including the entire section focusing on urban cultural politics. Linder explains in his introduction that this was largely due to the community of academics in Nepali urban studies being fairly small. Kathmandu: A Reader then becomes even more integral as a gateway for new authors looking to work in the space of urban research on the Valley — undergraduates in the humanities for future theses and research ideas.&nbsp; In a time when Kathmandu is littered with new exam coaching centres for medical and engineering students, an anthology like this helps remind young scholars that there is plenty of scope for qualitative research in the social sciences. Sabin Ninglekhu’s discourse on the sukumbasi and aesthetics in Kathmandu are reminders that stories and academic journeys can be inspired from one’s surroundings. Kathmandu: A Reader has a good balance between academic and lighter readings, and is almost encyclopaedic in nature. A reader for Kathmandu

Following the <a href="https://nepalitimes.com/news/nepal-s-8-september-massacre">uprising of 8-9 September</a>, the Nepal Army commenced a series of consultations concerning the transition process, during which the potential reinstatement of the monarchy was reportedly under consideration.&nbsp; However, former King Gyanendra Shah declined to pursue this option without a consensus among the political parties. This information was conveyed by Madhav Kumar Nepal, a former Prime Minister and a notable critic of the monarchy, in a newspaper article. The former king, for his part, delivered his annual Dasain message to the nation on 28 September. He emphasised, among other points, that the younger generation constitutes the foundation of the nation’s future.&nbsp; ‘Only the patriotic spirit, energy, and innovative thinking inherent in them can guide the nation toward strength, prosperity, and self-reliance. Let us reflect upon ourselves in the mirror of our country,’ he said. ‘Our political endeavours have often focused on destruction. Now, our initiatives should aim not at ruin but at improvement.’ Seventeen years <a href="https://nepalitimes.com/news/the-ghost-of-monarchy-returns-to-haunt-nepal">after Nepal abolished its monarchy</a> and became a federal secular democratic republic, the monarchy still influences the country’s political scene, mainly because of the persistent weaknesses of democratic institutions. Throughout much of its modern history, Nepal’s political landscape was controlled by the monarchy. During the partyless Panchayat system (1960-1990), the palace was consistently criticised for its authoritarian rule. However, it presented itself as the defender of national unity and sovereignty, especially against Indian influence. The 1990 People’s Movement transitioned Nepal into a constitutional monarchy. However, this period was marred by persistent instability, including the outbreak of a Maoist insurgency in 1996 and a royal palace massacre five years later.&nbsp; By 2005, when <a href="https://nepalitimes.com/here-now/tell-me-what-the-common-man-is-thinking">the new king, Gyanendra</a>, assumed full control, detaining politicians and restricting press freedoms, the monarchy’s legitimacy was already under scrutiny. The mass movement of 2006 resulted in the end of royal rule, leading to the official abolition of the 240-year-old Shah dynasty in 2008. Supporters of a republic saw this as the outcome of years of activism. In contrast, royalists viewed it as the sudden dismantling of an institution they believed had united Nepal. The new political framework aimed to promote stability, prosperity, and inclusion. However, Nepal has seen over 14 different governments in 17 years. Divided by factionalism, political parties have often focused on overthrowing rivals instead of effective governance. Widespread corruption persists. Infrastructure projects frequently face delays. Millions of young Nepalis leave the country to find jobs, resulting in the loss of many of the nation’s most talented individuals. The common belief that politicians amass wealth while ordinary citizens struggle has caused deep disillusionment. This serious situation led <a href="https://nepalitimes.com/news/international-spotlight-on-nepal">Nepal’s Generation Z to protest</a> in the streets. Within this broader context, for many, the monarchy has reemerged as a symbol of stability. To some, the king signifies unity that goes beyond partisan divisions. To others, the last Hindu monarch represents cultural continuity amid secular and federalist upheavals. <a href="https://nepalitimes.com/news/nepal-s-deja-vu-on-black-friday">Royalist demonstrations in Kathmandu</a> have mobilised tens of thousands. However, electoral support remains limited. The leading pro-monarchy party, the Rastriya Prajatantra Party (RPP), secured merely about 6 percent of the vote in the 2022 elections.&nbsp; Major political parties remain steadfast in their commitment to republicanism, and Nepal’s younger, globally connected population broadly <a href="https://nepalitimes.com/opinion/a-new-dawn-for-democracy-in-nepal">identifies with democracy</a>, despite frustrations with its shortcomings. Remembrances of King Gyanendra’s authoritarian rule serve as strong reminders of why the monarchy was abolished. As a result, calls for the reinstatement of the king are not just about Mr Gyanendra Shah, but also reflect a broader desire for government that is stable, accountable, and respectful. The influence of the monarchy extends into regional affairs. <a href="https://nepalitimes.com/here-now/america-nepal-and-the-royal-coup-qedzifz9">During the Cold War</a>, the palace adeptly balanced relations between India and China, positioning itself as the guardian of Nepal’s sovereignty.&nbsp; It also carefully navigated pressures from the United States and the Soviet Union. Today, as Nepal faces pressures from New Delhi, Beijing and Washington, some royalists perceive the monarchy as a safeguard against external interference. The <a href="https://archive.nepalitimes.com/article/editorial/autopsy-of-a-blockade%20,2863">2015 blockade imposed by India</a> impacted Nepal’s economy and led the country to seek closer comprehensive relations with China. As a result, India has adopted a more cautious approach toward Nepal’s republican leadership.&nbsp; China is viewed as supportive of centralised authority, in contrast to Nepal’s democratic institutions. There are perceptions that the United States, previously supportive of the monarchy, may once again consider it a stable partner. Officially, India, China, the broader international community, and major donors continue to support <a href="https://nepalitimes.com/here-now/the-story-so-far">Nepal’s post-2006 political order</a>. At the same time, they observe ongoing discussions among Nepalis about the possibility of a constitutional monarchy within a democratic framework. Following the recent unrest, some Nepalis believe that restoring the monarchy could create uncertainty for India and China, given Nepal’s complex political landscape. Others suggest that worries about perceived Western influence on the interim government through international NGOs might trigger serious soul-searching in New Delhi and Beijing. Despite its limited mandate to hold elections on March 5, 2026, t<a href="https://nepalitimes.com/news/nepal-pm-set-to-expand-her-cabinet">he interim government</a>, led by former Chief Justice <a href="https://nepalitimes.com/news/madam-prime-minister-of-nepal">Sushila Karki</a>, has an opportunity to start rebuilding public trust. Although the new government continues to enjoy popularity, there is evident public impatience regarding its delays in investigating corruption and misconduct by the previous leadership, as well as the incidents of killings, looting, and arson during the protests.&nbsp; The nation has been further unsettled by whispers of an impending and potentially more significant political upheaval prior to the upcoming elections. Republicans believe that demonstrating the effectiveness of democracy is the best way to mitigate calls for a monarchy. However, if the leadership fails to address key issues such as corruption, unemployment, and institutional strengthening, it could further boost the monarchy’s influence – and potentially lead to its comeback. Why the monarchy still sways Nepal’s republic

One is an archipelago, the other is landlocked. But the Philippines and Nepal have a lot in common: both are disaster-prone, their economies dependent on overseas migrant workers, both went though Maoist insurrections that failed to replace a feudal order dominated by political dynasties. And both countries suffer from rampant corruption. Twelve days after <a href="https://nepalitimes.com/news/nepal-s-new-normal" target="_blank">deadly protests toppled Nepal’s government</a> tens of thousands of Filipinos, many of them youth, also poured out into the streets demanding transparency and better government. Cars were set on fire, and more than 200 people were arrested, nearly half of them minors. There is a realisation that our future is at stake,” Lemana added. Online groups started highlighting bribery and kickbacks in July after President Ferdinand (Bongbong) Marcos Jr himself brought up corruption in the infrastructure budget in his annual address to the nation, and launched a probe.&nbsp; The protests gained traction after powerful visuals of <a href="https://nepalitimes.com/news/international-spotlight-on-nepal" target="_blank">rallies in Indonesia and Nepal</a> circulated on digital platforms. Filipino journalists also exposed the <a href="https://www.youtube.com/watch?v=-f0MFz3vmfE" target="_blank">high-flying lifestyle of contractors</a> involved in siphoning off the infrastructure budget.&nbsp; As in Nepal, the youth protests were joined in by various radical groups. In Manila they reportedly included supporters of ex-president Rodrigo Duterte who is currently on trial at the <a href="https://www.icc-cpi.int/philippines/duterte" target="_blank">International Criminal Court (ICC)</a> in the Hague for extrajudicial killings during his ‘war on drugs’ 2011-2019. Duterte still has a lot of support, especially in the Filipino diaspora, for being tough on crime. Duterte was allied with Marcos in the 2022 elections, and his daughter Sara Duterte is currently vice-president. But the two families had a massive falling out, and the Supreme Court annulled the Lower House’s attempt to impeach the vice-president. This week in Manila, a remarkably well-informed Grab driver replayed TikTok videos of Kathmandu’s burning Parliament building to a passenger from Nepal. After his garment factory was driven out of business by cheap Chinese imports, he started driving a ride-hailing cab and was livid with successive governments not providing opportunities to ordinary people like him. Traffic was gridlocked because of flooded streets, and the driver vented out his anger: “Look at this. The streets are always flooded because of corruption. We should have done here what you did in Nepal.” Even before the protests, Senate President Francis Escudero and House Speaker Martin Romualdez had both resigned over the 'Floodgate Scandal'. Romualdez is Marcos’ cousin and is now said to be in Madrid, where his every movement is being tracked by Filipino diaspora in social media posts. The Independent Commission for Infrastructure has issued subpoenas to probe corruption in flood control projects. As in Nepal and Indonesia, much of the anger was over the offspring of politicians extravagantly flaunting their ill-gotten wealth on Instagram and TikTok. In the Philippines, the outrage is also over political clans passing on electoral seats to offspring. The 21 September protests were centred around Rizal Park and the EDSA Intersection in Manila — both symbolic for previous people’s movements against the Spanish colonialists and the 1986 uprising against the dictatorship of Ferdinand Marcos (father of the present president). “People here had seen what happened in Nepal, and were asking why we weren’t as angry as people there? Why not show our anger, too?” said one reporter who covered the protests. But, he added: “Let’s not be naive. It may have started with youth anger, but there were also people who were paid to infiltrate and instigate. In a clear parallel to what happened in Kathmandu two weeks earlier, radical groups, political rivals, and the general public furious with the system all joined in the protests. Catholic priests, people from all generations and professions had participated in the EDSA Uprising against Marcos in 1986. This time, it was the youth who took the lead. Joseph Francisco Ortega of the <a href="https://www.facebook.com/nationalyouthcommission/" target="_blank">Philippine National Youth Commission</a> said he understands the frustration among the youth that fuelled the unrest. The discontent is also because despite there being young legislators, they are either party-affiliated or scions of political dynasties. “If we can convince young politicians to do the right thing, then we have won half the battle,” Ortega said. “If we want to rebuild quickly and for the long term, we have to change the system from within. We are older, but still angry, and demanding good governance, transparency and accountability.” Just like in Nepal, young Filipinos rallying against corruption were also wary of infiltration, and it was clear from the anti-Marcos graffiti who the instigators of violence were. The GenZ were mainly wearing white while the pro-Duterte crowd <a href="https://www.youtube.com/watch?v=6w8monPKdrc" target="_blank">are seen in videos</a> in black.&nbsp; The minors seem to have just joined in the melee from their street-side settlements. Rights groups have called for their release, accusing police of rough interrogation and ‘red-tagging’ as Communist provocateurs.
