Dalits were still strictly prohibited from entering the places of worship, but in 2001 they were defying the ban in Baitadi district in Nepal’s western mountains. They tried to forcibly enter a temple, and were beaten back by people who considered themselves of a superior caste. One of those agitating was 20-year-old Saraswati Nepali, and ever since it has been a lifelong struggle till her receiving the US Department of State’s Global Anti-Racism Champions Award in Washington DC last month from Antony Blinken (pictured). “It was a surprise and an honour,” says Nepali, now 42. “It also made me realise that discrimination is present all over the world, be it ethnic, racial, or caste-based. It is our duty to keep on fighting for justice and equality.” The irony is that not many people have heard of Saraswati Nepali within Nepal and her relentless activism.&nbsp; In 2017, Nepali was a UML deputy mayor candidate from Dashrathchand Municipality. Despite getting 3,100 votes, she lost to Meena Chand of the Nepali Congress. “I lost because of my last name,” recalls Nepali. “Baitadi people &nbsp;were not ready to see a Dalit woman as deputy mayor. People were concerned that temples would be inaugurated by a Dalit if I won. Not one to give up, Nepali stood again for mayor in 2022. She lost again but got more votes than the previous time. “The locals accepted me as a leader but not my leadership,” she admits.&nbsp; Nepali was born the youngest child to a Dalit family in Baitadi in the isolated far-western mountains of Nepal, one of Nepal’s most under-served districts and one where caste-based discrimination is still deeply entrenched.  <figure> <img src="https://publisher-publish.s3.eu-central-1.amazonaws.com/pb-nepalitimes/swp/asv65r/media/20230906140936_e889b05f022ddbf848a2858954dac9fba009318d46aef4a5f3cd9f4478b835b7.jpg" data-media-id="editor_0" data-image-id="20230906140936_e889b05f022ddbf848a2858954dac9fba009318d46aef4a5f3cd9f4478b835b7" data-rendition-name="original" width="3264" height="2279" loading="lazy" alt="Saraswati Nepali"> </figure>  Growing up with discrimination at every step, rebellion was not a choice for Saraswati Nepali but the only way to survive. The social ostracisation she faced from a young age left a lasting impression and ignited a passion for activism that would later define her life. Her father Nanda died when she was only six months old, but her three older brothers became her guardians and encouraged her to pursue education. She was eight when she started her formal education. At night, she used to tag along with her youngest brother Prakash who used to paint slogans against caste-based discrimination on walls and other surfaces in the village. At 15, she met Dalit activists like Puran Singh Dayal who had initiated a movement to enter eateries that prohibited Dalits. Back then, Dalits had to drink tea outdoors and wash the glass themselves.&nbsp; By 22, Nepali was already affiliated with the National Dalit Network and Dalit Development Society. Having witnessed and sometimes experienced first-hand the worst of caste-based discrimination including bonded labour, landlessness, and Dalits being forced to scavenge on carcasses of animals, Nepali took her activism to the streets. Under Nepali’s initiation, Baitadi outlawed bonded labour in 2007, a year before Kathmandu did so nationally. &nbsp; “She is a rebel with a cause that her own country has not recognised yet,” says fellow activist Puran Singh Dayal, remembering Nepali joining him at the temple agitation more than two decades ago.&nbsp; Nepali had previously also won the Darnal Award for Social Justice in 2018. The US State Department said in its citation: ‘Saraswati has played a crucial role in Dalit social justice movements to acquire land rights, gain access to education, and obtain equal justice from the courts.’ But there is only so much activism can do, matters of discrimination and inequality like many other problems in Nepal are political in nature and need political solutions. Which is why Nepali has chosen electoral politics.&nbsp; “All my life, I have been on streets shouting, now I want to be in a decision-making position,” says Nepali. “If given the chance I can bring about social reform.” Nepali hasn’t given up on Baitadi which she calls her ‘janmabhumi’, (birthplace), her ‘gyanbhumi’ (the land where she was educated) and her ‘karmabhumi’ (her place of work).&nbsp; “One day, I will surely win the hearts and minds of voters,” says the ever-positive activist. “I will then use political power to eradicate our country of social ills.”&nbsp; Translated by Pinki Sris Rana from the Nepali original published on himalkhabar.com

Saraswati casts net wide for justice

They discussed and agreed on the terms and conditions of a rental agreement. House-owner Pradhan apprised Sunar of the rules: that she should not make noise, should to be out late, and cooperate with her.At the end of the meeting, Pradhan asked Sunar about her caste. Upon learning of her <a href="https://www.nepalitimes.com/here-now/black-lives-matter-but-dalit-lives-dont/" target="_blank" rel="noopener noreferrer">‘lower’ caste status</a>, she said that she would convey her decision after family consultation. Pradhan called Sunar’s friend an hour later, and told that she could not rent the room to a ‘lower’ caste person.Sunar phoned Pradhan to confirm. She recorded the conversation: “I cannot rent you the room. Our elderly mother lives with us. She cannot share the house with a lower caste. But please let me know if other friends need a room.’According to the 2011 Census, <a href="https://www.nepalitimes.com/banner/caste-aside/" target="_blank" rel="noopener noreferrer">Dalits</a> make up of 14% of Nepal's population. Many ‘higher’ caste people still do not consume food and beverages touched by a Dalit persons. To maintain ritual purity, the ‘higher’ caste families do not let Dalits enter their houses. In 2001, one study identified over 205 forms of such discriminatory practices.The 1990 Constitution outlawed caste-based discrimination anduntouchability. But historically, most laws remain on paper only. Violations mostly go unpunished.In 2011, the Constituent Assembly enacted the Caste-Based Discrimination and Untouchability (Offense and Punishment) Act. The Act prohibits <a href="https://www.nepalitimes.com/here-now/caste-aside-dalits-battle-sitgma/" target="_blank" rel="noopener noreferrer">caste-based discrimination</a> ‘in any public or private place.’For example, the act forbids preventing someone from entering a house or evicting them on the ground of caste or race. The act made caste-based discrimination a crime against the state. Hence, in the caste-based discrimination cases, the state becomes a party, which requires it to file the cases in court, investigate and defend them.In January 2021, <a href="https://www.nepalitimes.com/latest/nepal-elected-to-2nd-term-at-unhrc/" target="_blank" rel="noopener noreferrer">Nepal was re-elected for a second term</a> on the United Nations Human Rights Council (UNHRC), an international body responsible for the promotion and protection of human rights around the world.But in Nepal last week, a sitting minister interfered with and obstructed a police investigation of a caste-based discrimination case. International human rights laws define caste-based discrimination as human rights violations.On 17 June, two days after being refused the flat, Sunar lodged a complaint against Pradhan at the Metropolitan Police Office, Singha Darbar, accusing her of <a href="http://archive.nepalitimes.com/news.php?id=6427#.YNqh0S2B2b8" target="_blank" rel="noopener noreferrer">caste-based discrimination</a>.The police initially denied registering the complaint. Despite laws criminalising it, the Police, government attorneys, and judges often do not recognise caste-based discrimination cases as an offence, and in fact dissuade people from filing such complaints.Only after the case attracted public attention did the police finally register Sunar’s complaint, and initiate an investigation. On 20 June, the Police arrested Pradhan, and put her in custody.The case soon took on an ethnic colour, with some making it out to be a Dalit vs Newa issue. Some Newa organisations released statements asking the police to punish Sunar for disrupting social harmony. Former senior government officer Bhim Upadhyaya accused Sunar of fomenting societal tension. Instead of standing up against caste discrimination, the Mayor of Madhyapur Thimi on Monday called for Sunar to be prosecuted.Sudha Tripathi, the former Tribhuvan University registrar, described Sunar as a Dalit ‘gangster’. Thousands of their social media followers shared these statements.All Sunar wanted was a room to live in, just like anyone else in Nepal. Why was that such a problem?As we know, the story did not end there. On 23 June, the Minister of Education, Science, and Technology Krishna Gopal Shrestha drove to the station in his official car, pressured the Police to release Pradhan and even posed for a photoshoot with her in front of media.Nepal’s national flag fluttered from his ministerial vehicle as he drove Pradhan home. Not only did Minister Shrestha have no authority to handle this case, he misused state authority and state resources.As the minister belonged to the same ethnic group as Pradhan, he abandoned his state responsibility and took a communal stance. Minister Shrestha’s triumphant pose with Pradhan ignited a firestorm of hatred against Dalits on social media, prompting users to vow never to rent rooms to Dalits.There have also been threats of violence. Dalit activists have received death threats for speaking out. Dalit leaders and rights activists have called on the government to act against Minister Shrestha, and create a conducive environment for fair trial. Dalits and non-Dalits have even demonstrated in the streets to protest the state inaction and minister’s unlawful action.However, Prime Minister K P Oli has been silent on the issue. On 24 June, he even assigned Minister Shrestha four additional portfolios. But his government has not done anything to assure the victims and the Dalit community a fair trial and protection of their lives and human rights.The <a href="https://www.nepalitimes.com/here-now/nepal-caste-attack-turns-deadly/" target="_blank" rel="noopener noreferrer">failure of state to assure the Dalit community of justice</a> has made them feel unprotected and vulnerable. They fear that in the future no law enforcement agency will register and try cases of caste-based discrimination. They also fear the possibility of retaliation by members of ‘higher’ castes.Nepal is a party to Universal Declaration on Human Rights, theInternational Convention on the Elimination of Racial Discrimination (ICERD), and International Covenant on Civil and Political Rights. The ICERD specifically prohibits any form of state engagement in practicing, sponsoring, defending, or supporting any forms of racial or descent-based discrimination.The National Human Rights Commission (NHRC) is supposed to protect Nepali citizens from violations. However, after the government appointed the new NHRC members bypassing parliamentary hearing on 3 February, UN human rights experts have expressed concern about its independence. This is proven by its complacency about Minister Shrestha’s involvement in the Rupa Sunar case.The <a href="http://archive.nepalitimes.com/news.php?id=16791#.YNqh2S2B2b8" target="_blank" rel="noopener noreferrer">Dalit community in Nepal</a> is looking to international human rights groups, including the United Nations, to question the government’s accountability. Maintaining silence and inaction when human rights are violated will only escalate tension. Nepal’s caste struggle

She had faced caste discrimination in Nepal’s culturally conservative far-west, and had thought educated and prosperous Kathmandu could be different.How wrong she was.In college picnics, at the student dormitory, in the classroom, Sob faced the same ostracisation and taunts of fellow students from the so-called ‘upper’ castes that she used to get in Doti.She got a job at Action Aid even while at college, and in 1988 she met American rights activist Robin Morgan. They talked a lot about how Nepal’s gender activism was not inclusive, and it left out women perceived to be of a ‘lower’ caste.Morgan helped Sob set up her own group. Forty years later Sob is still running her Dalit Women’s Organisation which by now has grown to become nationwide. Sob rented a flat in Kathmandu and kept two rooms as her office and two rooms to live in.Soon, the landlady found out that Sob was a Biswakarma, from the Dalit community. The usually friendly woman became hostile, and gave Sob notice to move out immediately.<img src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221109171144/636bd90f9c7e80680e0801f1jpeg.jpg" alt="" width="640" height="449">Sob went flat-hunting throughout Kathmandu without hiding her caste, since she did not want to face the same problem again. But that made it even more difficult for her to find an office and residence space to rent.“I asked many people for help, no one came forward,” Durga Sob recalls. “In the end, I lied about my caste and soon got a flat. But even then, they would find out and harass me by cutting off my water supply or electricity to drive me out. I have had to move so many times in Kathmandu because of my caste.”In 1995, Sob was invited to attend the Beijing International Women’s Conference with other Nepali women activists. She had to share her hotel room in Beijing with a Nepali, but because she was a Dalit, none of the other conference participants from Nepal agreed to share a room with her.“That was the worst day of my life, I wept,” Sob remembers. “This was an international conference on women’s rights, the Nepalis were gender activists, and yet this was happening.”In 2001, Durga Sob was nominated member secretary of the newly established National Dalit Commission. But the discrimination did not stop. She says: “Dalit women have to face double discrimination: first because they are women and second because they are Dalit.”Sob was convinced that the only way to resolve caste racism is through politics. So, she started becoming politically active, but even in politics she found prejudice against Dalits. First, she joined Baburam Bhattarai’s Naya Shakti Party as a coordinator, hoping that its progressive agenda would help in her struggle.“I got that position because of my ability, but I started feeling pressure, there was a feeling that a Dalit women should not have a leadership role. I should have been a deputy chair or general secretary, but I was demoted to being a secretary,” she says.Durga Sob is now a central committee member of the People’s Socialist Party, but she has no illusions about ever rising to a position higher than secretary. She concludes: “When racism is direct and open, we can resist it. But when it is hidden, it is difficult to endure and fight against.”Yash Kumar, singerYash Kumar’s father was a Brahmin and his mother a Dalit. When he was 10 years old his parents brought him to Kathmandu from Sarlahi. He did not have to face racism while in the Tarai because he was quite young, and he was not discriminated against in Kathmandu because he had a Brahmin surname. However, when he was making his citizenship papers, he added ‘Pariyar’ to his formal name.It was after he became a well-known singer and famous for a hit song about untouchability that Yash Kumar started really feeling societal discrimination. A sister of his best friend with the Brahmin surname ‘Acharya’ was getting married, and he came over to give Yash Kumar an invitation card to the wedding. But he said the invitation was just for formality, and that he should not come to the reception.“He told me he did not believe in untouchability but his parents did not want his Dalit friend to attend the wedding,” he recalls. “It was like something pierced my heart.”Yash Kumar relates many other incidents where he faced ostracisation because of his caste. He would even hear friends cast derogatory remarks about Dalits either because they did not know he was one, or because they thought he was out of earshot.<img src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221109171144/636bd9129c7e80680e0801f2jpeg.jpg" alt="" width="640" height="806">One well-known film actress once confided to him: “You are different from other Dalits in the way your think and speak. You must be mixed.”Yash Kumar says he reacts immediately when someone mistreats him because he is a Dalit, but it is more difficult when the discrimination is subtle. “I feel really sad that there is such behaviour in a city where there are supposed to be educated and conscious people,” he adds.Rekha Pariyar, student leaderUnlike other Dalits who face direct and indirect prejudice, Rekha Pariyar has been physically assaulted because of her caste. After her family moved to Kathmandu from Chitwan, and started being treated differently by the neighbours. They could not draw water from the community tap, and were not allowed into the corner tea shop.Rekha’s father and brother had a tailor shop. In 2012, they brought a sewing machine and other equipment in a rented pickup, but the driver asked for money more than was agreed upon. An altercation ensued, and the neighbours beat up members of her family, hurling racist slurs against them.<img src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221109171144/636bd9159c7e80680e0801f3jpeg.jpg" alt="" width="640" height="456">It took a long time for the police to arrive at the scene, and they took Rekha and her injured family members to hospital where her father and mother had to spend three weeks. Police in Maharajganj refused to accept her complaint. Only after appealing to Prime Minister Sushil Koirala did the police register the case, but even though this became a high profile media story, the perpetrators were never caught.Rekha Pariyar rose up the ranks of the student union, and used to deliver fiery speeches against caste discrimination. But her political colleagues would not eat with her, even though they travelled and did everything together.She says: “It is even more difficult to fight discrimination when it is so entrenched in supposedly better educated people in the cities.”B B Anuragi, singerBorn in Baglung, BB Anuragi was at the receiving end of racial discrimination. But when he came to college in Pokhara, the ostracisation got much worse. He got into an argument and a fist-fight when fellow students wanted to keep him out of the student dormitory. But after that he could not rent a room anywhere. He finally found a room with two other friends, but he had to move out when their parents were visiting.He started singing at a local gazal restaurant, but had to move multiple times when landlords cut off his water supply or harassed him when they found out that he was a Dalit. There was a Newa landlady who had a room, and he told her he was a Dalit. But her reply surprised him: “It does not matter to me what caste you are as long as you are a decent person.” She was an exception.In 2003, Anuragi moved to Kathmandu, but here the discrimination was of a different nature than Pokhara. “In Kathmandu people did not bring up caste directly, but would insinuate things which was difficult to counter,” he says.<img src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221109171144/636bd9189c7e80680e0801f4jpeg.jpg" alt="" width="640" height="448">Even to this day, he notices that people’s demeanour changes completely when they find out he is a Dalit. Neighbours do everything together, but do not call him for their parties or festivals.“I am a singer, and I pour out my anger in my songs, but this is Kathmandu, the message is restricted to the songs, it does not change too many people,” Anuragi says.Sona Khatik, Radio Station ManagerThroughout her life, Sona Khatik grew up suffering from caste discrimination. Her life story indicates that caste stigma is more entrenched in the Tarai than in the mountains.<img src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221109171144/636bd91b9c7e80680e0801f5jpeg.jpg" alt="" width="640" height="881">“I like to report from the field instead of dealing with people in the office,” says Khatik who worked her way up from being an intern to the Station Manager of Community Radio Kapilvastu.“Even so, I often notice people’s attitude change after they find out I am a Dalit. They talk down at me,” she says. “They ask me my caste and profession of my parents, and when they find out I am a Dalit they actually tell me I must be a non-Dalit because of my senior position.”In 2012, she had gone to interview a senior official at a government office. He did not even tell her to sit down in the sofa, she had to take the interview standing up. Because caste discrimination is now punishable by law, the prejudice is also more subtle.One of Khatik’s close friends eats with her, but when she is invited to her friend’s house she has to eat outside the kitchen. “It really affects me when close friends do that,” she says. “I just stopped going to her house.”Khatik says it is difficult to counter discrimination when it is so indirect. “We are invited to functions, but the organisers often treat non-Dalits differently than Dalits. Often, they just ignore me. So, I have just stopped going to such functions. I counter indirect stigma with an indirect boycott.”Holi Nepali, tourism entrepreneurNepali Dalits face discrimination even when they are abroad. And Holi Nepali, who runs Top of the World trekking agency in The Netherlands, has a direct experience of this. Nepali was born near Pokhara and through the kindness of trekking agency operator Rajiv Shrestha she got a good education. She stayed with his family, so others did not treat her badly then.When some people in Nepal used to ask her what her caste was, she would say she was from the leather worker ‘Sarki’ caste. They would reply: “You are so good looking even though you are a Sarki?”She started working in Shrestha’s trekking agency where she met a Dutch national and got married to him, and started living in The Netherlands in 2012. But even there, caste discrimination has followed her.<img src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221109171144/636bd91e9c7e80680e0801f6jpeg.jpg" alt="" width="640" height="434">Nepali has a Nepali Chhetri friend whose relatives admonish her for hobnobbing with a Sarki. During Nepali gatherings, she has heard many Nepalis advise others not to marry outside their caste groups.“It seems that no matter how educated you are, no matter if Nepalis are in Europe, they cannot rise over bigotry,” she says.Shanti Paswan, activistShe was born and raised in a town in the Madhes and never had to face discrimination in her home town of Siraha. That may have been because she grew up in a Tamang majority neigbourhood. However, after she became older and got involved in social service activities, she faced discrimination at every step.<img src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221109171144/636bd9219c7e80680e0801f7jpeg.jpg" alt="" width="640" height="437">In 2012, when she wanted to stand for election to a school management committee she was forced to step down because of her caste. Her rivals thought she might win, so they threatened and intimidated her. “After it got nasty, I thought is just was not worth it,” she says.Because it is illegal to openly discriminate against a Dalit, the educated ones pass snide remarks to put them down. “They will not say it directly, but if there is someone who not good-looking or if there is an undesirable person around, they describe them as ‘being like a Dalit’. If there is a crime anywhere, it is a Dalit who is the first suspect,” Paswan says.She has developed her unique way of dealing with such racism. “If it is someone who is just not aware or are illiterate, I let their slight go, but if it is someone who should know better, I come down hard on them.”Bhuwan Singh Biswakarma, ex-soldierHe is one of the few Nepalis who has even been to Antarctica. Bhuwan Singh Biswakarma was born in Baglung but moved to India when he was 10, and later joined the Indian Army. He joined an expedition to Antarctica, and says he was never treated different because he is a Dalit.However, after retirement and return to Nepal he has been facing discrimination in his own homeland. “Earlier, even the educated people used to discriminate on the basis of caste, but now because it is illegal to do so, there is a different more roundabout kind of discrimination,” he says.Biswakarma says such indirect treatment manifests itself in friends who do everything together, but stay apart while eating. Once, he was drinking tea with a friend when he inadvertently touched his glass. The friend got up and left saying he did not feel like having tea that day.<img src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221109171144/636bd9249c7e80680e0801f8jpeg.jpg" alt="" width="362" height="417">“I always know they are doing it because of me, but how do I fight that?” asks Biswakarma who now lives in Butwal. “Close friends do not invite you for weddings and other parties at their home. It hurts.”Purna Lal Biswakarma, engineerEven if a Dalit is an engineer, he has to face discrimination. In fact, no matter what senior position they hold, even if they are rich, or hold high office, Dalits still face caste discrimination from a society that should know better. Engineer Purna Lal Biswakarma is living proof of that.<img src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221109171144/636bd9269c7e80680e0801f9jpeg.jpg" alt="" width="640" height="350">Born in Kusma of Parbat district, Biswakarma grew up with other Dalits, and did not face stigma for being from a ‘lower’ caste. Even when he enrolled in an engineering college in Kathmandu, he did not really face much discrimination.It was after he gave his Public Service Exam that he started facing the brunt of the injustice. After joining the Irrigation Department, he had to travel across Nepal. It was in Baitadi in far-western Nepal where he had to face the worst treatment even from co-workers.He still remembers the discrimination from a close friend and long-time colleague who was getting married. Everyone got an invitation but him. He was invited for a reception later, but did not go because the ill-treatment affected him deeply.“They talk to you with respect, but as soon as they find out you are a Dalit, the tone changes completely,” Biswakarma says.Purna Nepali, professorHe was born in India and was raised in Kapilvastu where he faced ill treatment, abusive language and discrimination every step of the way while growing up. But it was after he moved to Kathmandu that he had to face other kinds of poor behaviour. He joined the United Nations Gender Mainstreaming Project and was assigned to Myagdi where he faced caste violence from his own colleagues. They did not drink water from a bottle that he had touched. “They never said anything bad, but their behaviour was appalling,” Nepali remembers. It affected me deeply at a psychological level.”<img src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221109171144/636bd9299c7e80680e0801fajpeg.jpg" alt="" width="640" height="521">In 2008, he had gone to Bajhang and Doti for research into his PhD and it was difficult to get a room for the night. “Dalits did not have room, and non-Dalits would not give you a room,” he remembers. “There have to be stricter laws against caste discrimination, and they need to be enforced. He imprisons her in a palace so that she can see no other man.The folktale of Rapunzel springs to mind. Even the Buddha was confined to his palace so that he could not see the sufferings of the world. A woman named Jaljala (so named perhaps to remind us of the mountain in Rukum that became a symbol of the Maoist revolution) speaks out boldly against tyranny, and the plot thickens as Jalini is brought to confront a world she had never seen.The king's attempts to force the people to do his bidding as he ignores their hardships is reminiscent of despotic regimes today. He takes pride in how he has decorated the walls of his palace with pictures of his long-suffering subjects, and thinks that passes for doing something to uplift them. Once upon a time

With Saturday's deadline on Malaysia’s announcement of new criteria for selecting private recruiting agencies for migrant workers having lapsed, Nepal and Bangladesh have rejected the conditions.
The Malaysian move three weeks ago came in the aftermath of deadly GenZ riots in September, when Nepal’s interim government does not have designated heads in the Foreign Ministry and the Labour Ministry.
Interim Prime Minister Sushila Karki instructed the Labour Ministry to examine the implications of the standards and recommend appropriate steps to address them, but it has said it cannot send Nepali workers to Malaysia based on those criteria.
“In line with Nepal’s foreign employment policy and regulations, we are currently unable to accept or implement the proposed criteria,” says Pitambar Ghimire, spokesperson at the Ministry of Labor, Employment and Social Security in Kathmandu.
In response to the government’s request for their opinion on the Malaysian stipulation, the Nepal Association of Foreign Employment Agencies (NAFEA) has also flatly rejected the criteria, saying it could create a harmful syndicate and restrict fair competition, violate Nepal’s Constitution and laws, and increase recruitment fees that workers must pay.
On 25 October, the Malaysian Ministry of Foreign Affairs sent letters to the governments of Nepal, Bangladesh, Burma, Pakistan and India with 10 criteria meant to ‘rationalise the number of licensed private recruitment agencies permitted to facilitate recruitment and placement of workers to Malaysia’.
The proposed criteria include: at least five years of operating experience, deployment of 3,000 workers in the past three years of operation, experience sending workers to at least three countries, valid licenses and good conduct certificates, five employer testimonials, operating their own training and accommodation centres, and even a requirement for the staffing agency to have a 10,000 sq m office maintained for three years.
“We have communicated our views to the Ministry of Foreign Affairs, and have proposed discussing various labour related matters with our Malaysian counterparts diplomatically through bilateral dialogue and negotiations including renewal of the Nepal-Malaysia labour agreement,” Pitamber Ghimire said.
NAFEA has urged the government to prevent this measure from moving forward using diplomatic channels, and has held &nbsp;several gatherings and press conferences opposing the proposal since the Malaysian letter was received three weeks ago.
“We have taken commitment letters from members that they will not be engaged in activities related to the syndicate,” said Sujit Shrestha of NAFEA. “And if they break the commitment, they will face consequences including the revocation of their NAFEA membership. These letters also send a strong message to the government that this is irrevocably and collectively rejected by the industry.”
Bangladesh has also not accepted the proposal despite the 15 November deadline to send a list of recruiters that meet the criteria. That in itself would have been an impossible task to complete to begin with even if the government had accepted the proposal.&nbsp;
According to media reports, Bangladesh has sent a letter to the Malaysian government requesting that three of the proposed criteria be relaxed. This includes flexibility regarding the requirements for a 10,000 sq ft office, a dedicated training center, and the condition of having deployed 3,000 workers in the last five years. Despite the official request to Malaysian authorities, the Bangladeshi Government has also been collecting applications from recruiters who meet Malaysia’s proposed criteria, raising confusions about the contradictory stance.&nbsp;
Just like NAFEA, the recruitment association in Bangladesh, the Bangladesh Association of International Recruiting Agencies (BAIRA) has also outright rejected the proposal including in a letter to the Bangladeshi government, calling the criteria ‘unprecedented and exclusionary, unreasonable, discriminatory and syndicate-driven &nbsp;that would effectively disqualify 99% of legitimate agencies from participation’.&nbsp;
Now that the ball is back in Malaysia’s court and the proposal has not gained much support from two of the major origin countries, it will be interesting to see how they respond.

Nepal, Bangladesh reject Malaysian conditions

The very first frame in The Lama’s Son starts with a vision of Shangrila and the quest of a mythical utopia in the Himalaya when the rest of the world is crumbling away. It is also the personal search of filmmaker Kesang Tseten, but what he finds there are adherents of the Bon Po faith clinging to the last remnants of a culture as it erodes away like the sandstone cliffs of Mustang. “It was while editing the documentary that the story became distilled: how does what we see in the high Himalaya relate to the notion of the Shangrila idyll that especially the West ascribed to them,” asked Tseten during a recent trip to Kathmandu from Berne where he now lives. He continued: “Often and perhaps rightly criticised as an orientalist construct, I wondered if there was any basis at all to the Shangrila notion, and I hung the film on that idea.”&nbsp; Tseten takes us to the vast vistas of Mustang and Dolpo, a landscape of his Tibetan ancestors. This is as much an intimate documentation of families on Nepal’s Himalayan rimland torn between remoteness and globalness as it is about Tseten’s own quest for rootedness.&nbsp; We start from Lubra, a 3,000m village in Mustang the 15 households of which follow the Bon faith. Lama Tsultrim is from a 900-year-old lineage of the animist faith and an exponent of the tradition that is slowly being subsumed first by Buddhism and now modernism. For Tseten, the material is familiar, and not at all exotic as it is for non-Nepalis and indeed for many urban Nepalis. Nature and spirits are predominant in Bon, and rituals are what keep them benign and alight,’ says Tseten, who rarely narrates in his documentaries. “This is not really a personal film as such, but it has a point of view,” Tseten said. “I decided to have a voice-over on this one and cast my presence in the film.”&nbsp; Lubra's Lama Tsultrim is called upon to perform rituals from Kagbeni and other villages, but there is no one to continue the tradition after him, which is passed from father to son. Lama Tsultrim’s son (hence the title of the film) is a sushi chef in New York and has been gone for 20 years. “The Lama is like a setting sun, his son should come back and take over his father’s responsibilities,” says a local youngster chatting with friends. “If he dies tomorrow, where do we go? We can’t just light butter lamps ourselves to the gods.” It is not only the Lama’s son who has left. The village is nearly empty, and more are planning to leave. One of them is Chimi, a teacher who will be joining her fiancé who is an Uber driver in New York. Her brother is already in Hong Kong. In Lo Manthang a local is back home for a three-month vacation after being in New York for 12 years. A shopkeeper was in Japan for several years, and has returned. “Everything has changed, our language, our tsampa, our religion. We used to work and live together, now the children live separately,” says a middle-aged woman. “There are roads now, and vehicles stop right outside our house, but what’s the point? In Dri village we come across local women filling their buckets with water. Tseten asks them why the village is so empty: “Where is everyone?” The women reply that they are “here, there and everywhere”. Then it is their turn to ask Tseten about where he lives and what he is doing in their village. Migration is a recurring theme in Tseten’s documentaries from We Corner People, In Search of the Riyal, or Saving Dolma. His previous film Diversity Plaza documented the lives of Nepali and Tibetan emigrants in Jackson Heights in the borough of Queens in New York.&nbsp; Diversity Plaza was shown at DOC NYC in 2023, and The Lama’s Son will be one of only two Asian films shown next week at one of the biggest documentary film festivals in the world.&nbsp; “The Lama’s Son is not loud, not attention grabbing but intimate, so I was surprised they chose a quiet film for a big, flashy event,” Tseten told us. In Lama’s Son, we also see how climate breakdown is impacting Nepal’s trans-Himalayan regions. Lama Tsultrim shows us the aftermath of a recent glacial flood that swept away houses and fields. Farmers get one crop in a year, but the springs have gone dry and there is no snow in winter. So they are relocating to New Dhey, closer to the road. We follow Kesang Tseten to Samling in Dolpo, which at 4,200m is another Bon village. Locals are preparing for the Walchu festival in which Lama Sherrab carries out elaborate rituals to appease spirits that can turn malevolent. But unlike Lama Tsultrim in Lubra, Lama Sherrab has a community of lamas to help him, including two sons, one of whom will eventually take on his role. We move on to the adjacent village of Bicher and listen in as locals talk about how despite being dirt poor, they thrive in scarcity and are resilient. “We wear sheepskin, eat stew and yak meat, and drink wine. But we are very poor, we have nothing. Look at how dirty our clothes are. We may be dirty, but we have few illnesses,” says one. But even here in Upper Dolpo, a week’s walk from the nearest road, things are changing. He narrates: “Bon is sustained by a way of life that fosters a fine but fragile balance between nature and people, where humans come before gods. This is what lies at the heart of Shangrila if there is such a thing.” The film then takes us half-way around the world to a Bon centre in New York, but (spoiler alert) the eponymous Lama’s son never appears. He did not want to be filmed, but it makes for a more powerful portrayal of the life of emigrants forever trapped between two worlds. “Bon villages may be in danger, but the Bon has spread widely across the world,” narrates Tseten, a director who likes to call his storytelling ethnographic, and avoids coming to an apt conclusion. Lama Sherrab’s words after the Walchu ritual is a perfect segue:&nbsp; “Whether you say om mani padme hum (in Buddhism) or matri mi yu (in Bon) they are the same. When you go up, it’s the same heavenly realm. If you go down, it’s still the lord of death who awaits. The periphery cannot hold

Nepal’s September protests and regime change created two major unexpected costs that Prime Minister Sushila Karki’s interim government is scrambling to deal with: reconstruction of destroyed government buildings, and holding elections on 5 March.
The buck stops at the desk of economist and former bureaucrat Minister of Finance Rameshore Khanal about where and how to spend limited resources.
“Rameshore-ji is a fresh face and the right person for the role. He is capable and interested, and he knows the system,” says Kalpana Khanal of the Policy Research Institute (PRI).
But Minister Khanal has to grapple not just with the immediate budgeting needs for elections and reconstruction, but also initiate longer term measures to restore investor confidence badly dented by arson and vandalism of 9 September, and mend the economy.
Immediately after taking office, he had set up a three-member task force to cut programs and free up budget to meet immediate expenses.
“We have to hold elections and we have to reconstruct. Both need money, and they are equal priorities for us,” said Ministry of Finance spokesperson Tanka Prasad Pandey. “It is important to find these funds internally, and not look to aid from abroad.”
But Minister Khanal flew into heavy flak last week for his decision to restore investor confidence by giving a strategic capital gains tax break to Nepal’s only foreign private equity fund.
The Mauritius-based Dolma Impact Fund has invested venture capital into Nepal’s hydropower, construction and biotech sectors as well as solar farms and hospitals. It said in a statement that its capital gains are only taxable in Mauritius as per its double-taxation avoidance agreement with Nepal, which predates and overrides the Income Tax Act of 2002 subsequent to the Treaty Act 1990.
“When you have investors from all over the world, you have to choose a domicile and Mauritius is probably the most popular for development finance institutions due to strong governance, AML, and treaties with developing countries like Nepal,” Tim Dolma Investment told Nepali Times on the phone from London.
He added: “Last June we applied for the government to uphold its treaty with Mauritius which under all country laws including Nepal treaty act supersedes any disagreement with domestic laws. But there were delays. It was when the new government decided to uphold the treaty that the whole hoo-hah started.”
Leaks to the media possibly by bureaucrats fearful of being hauled over the coals by the CIAA has set financial circles abuzz for the past week. The Internal Revenue Office refused to grant the exemption, citing the 2002 Act.
Prime Minister Sushila Karki asked Chief Secretary Eaknarayan Aryal for clarification, and learnt that the Cabinet’s decision was not official since it was not recorded in the minutes.
“We were raising a fund that could have brought $1 billion in for energy and we had to stop it due to the reputational damage to Nepal by not upholding an international treaty,” said Gocher.
Gocher added: “Under Nepal’s Treaty Act, if there is ever disagreement between an international treaty and domestic law, then international treaty takes precedence so it is crystal clear and the way international treaties are dealt with all over the world.”
Some experts worry that gifting the fund such perks can set a dangerous precedent and a loss in tax revenue. Professor and economist Pushkar Bajracharya says: “The most important thing is to have a consistent policy about tax cuts and not do it piece-by-piece. Besides, the evidence just isn’t strong that tax cuts lead to higher investment, or more jobs.”
Others hark back to the capital gains dispute of the sale of Ncell ownership, which went to the Supreme Court and all the way to the international tribunal in The Hague.
Khanal has said privately that he is responding to the damage to Nepal’s investment climate from the dramatic visuals beamed worldwide of an international hotel chain and government buildings set ablaze in September. Western embassies are also said to be lobbying to allow Dolma tax exemption and smooth profit repatriation.
There are tradeoffs. Private equity funds like Dolma could funnel foreign funds more efficiently towards successful Nepali companies than the government, which is slowed down by many layers of bureaucracy. The downstream multiplier effect of such investments would outweigh taxes to the government since much of it is misused and wasted.
For example, the government is not taxing income in FY 25/26 generated by the US-funded $697 million Millennium Challenge Corporation (MCC) projects to build transmission lines and upgrade highways.
Strategic tax exemptions do provide incentives to investors, to make sure these projects are carried out effectively, which in turn helps Nepal’s development which has been affected by corruption and mismanagement.
The main demand of the GenZ protests that led to the downfall of the government coalition two months ago was to control corruption and make government more efficient so there is investment and job creation. The interim government seems to be responding to that sentiment.
The Dolma issue has distracted from the larger and longer-term need to reform the country’s financial systems and streamline public expenditure. How to reduce corruption and spur development is going to be the main agenda for elections, and the criteria by which voters will select candidates and parties.
TASKED FORCE
Shortly after Rameshore Khanal was appointed he set up a three member task force made up of the heads of Budget and Program, Foreign Aid, and Revenue Management Divisions. The team sent through the budget culling items DOGE-style — projects deemed ‘inadequately prepared,’ ‘fragmented,’ or ‘included through political pressure.’
Khanal hoped to save up to Rs100 billion by cutting all projects less than Rs30 million. However, such a slash and burn method would hurt rural and remote area projects for health and education more, and much bigger corruption-ridden infrastructure projects would be unscathed.&nbsp;
Says Bajracharya, “There are thousands, maybe hundreds of thousands of low-return programs in the budget that are there because of political or personal influence. But the criteria for cutting them needs to be properly defined. Doing it arbitrarily is unacceptable.”&nbsp;
Kalpana Khanal of the Policy Research Institute was involved in the taskforce, and explains: “The decision to mobilise internal funds is a pragmatic move to fund elections and reconstruction.”
However, she also singles out the massively-funded Ministry of Physical Infrastructure and Transport as being particularly problematic: “Time and cost overruns are historically the norm, and many are ‘vote bank’ projects that are politically motivated rather than done for return on investment.”
For example, politicians use their influence to build roads to their home districts to secure popularity even if the funds would have been better spent elsewhere.
“Another problem is the amount of funds that are transferred randomly for things that outside the budget,” continues Khanal.
Bajracharya adds, “While reconstruction and elections are big financial commitments, Nepal could easily find the funds. Cancelling low impact programs is a good move by the ministry of finance, and another option could have been to raise customs or taxes by a few percent. The main problem is that a huge amount of funds are lost to corruption.”
Kalpana Khanal and Dilli Raj Khanal co-authored a technical report last year titled Improving Public Expenditure System in Nepal: Critical Areas of Reform which did a forensic examination of such wasteful projects.
The conclusion: recommendation to have stricter accountability measures in place to check the actual use of funds and merit-based appointments in the National Planning Commission, Ministry of Finance, and the CIAA.
The technocrats in Prime Minister Karki’s cabinet resonate with the latter point. Nepal is so entrenched in the ‘afno manche’ culture of nepotism and connections that it has become the norm.
The report also refers to the well-known off-budget ‘re-allocations’ of big outlays during the seventh and first months of the fiscal year that undermine in-built check and balance. Almost a quarter of the budget is spent in the last month, which results in low quality and low impact work.
The authors call for reward and punishment systems to prevent these practices. The CIAA could also be supercharged to build transparency into the digital Line Ministry Budget Information System, instead of being an agency for political vendetta.

Nepal needs to use its money better

At the opening plenary of COP30, which stands for the convolutedly named 30th Conference of the Parties to the United Nations Framework Convention on Climate Change (UNFCCC), in Belém on Tuesday, Nepal brought up the threats to the Himalayan watershed. Nepal’s delegate Rajendra Prasad Mishra, Secretary at the Ministry of Foreign Affairs, also spoke on behalf of Bhutan and Bangladesh after the three countries formally called for tripling grant-based adaptation financing from 2015 levels to at least $120 billion per year by 2030, and to ensure a more simplified, scaled-up access to finance their National Determined Contributions (NDCs) to reduce emissions and adapt to climate impacts. “Bhutan has already graduated from Least Developed Country (LDC) status, while Bangladesh and Nepal are in the process of graduation,” said Mishra. “Graduation reflects development progress, but does not reduce our climate vulnerability nor the scale of support required to safeguard development gains.” The Loss &amp; Damage Fund is also finally coming into effect, so countries can now apply for $5-20 million to make up for damage from climate impact. But claiming damage and linking disasters to climate breakdown has not been an easy process. “When a 200MW hydropower plant is destroyed by a glacial flood, it is a big loss for Nepal’s GDP. Every megawatt costs us $20 million to build,” says energy entrepreneur Kushal Gurung. “Our lobbying should be top-notch, and hydropower can make a good case for us.” Belém marks the tenth anniversary of the Paris Agreement that brought the world together to pledge to keep global average temperature to ‘well below’ 2°C above pre-industrial levels and limit it to 1.5°C.&nbsp; COP has also returned to Brazil after 30 years of the Rio Conference in 1995. Since then there have been numerous summits, which have been criticised for being just hot air and being hosted by fossil-fuel exporting countries like UAE and Uzbekistan. Belém was selected because it is a gateway to the Amazon, but Brazil has now also become a major oil producer after new offshore finds. A recent report shows that compared to 2019, the world is set to reduce its emissions by 12% in 2035 if countries are to implement their Nationally Determined Contributions even though the figure needs to go up to 40% to meet temperature targets. There has been progress. Before the Paris Agreement the world was on a path for 4°C increase during this century, and this has now come down to 2.5°C because of the clean energy transition. But a lot more needs to be done to meet the Paris 1.5°C target. “This progress is proof that multilateralism is working, it is delivering,” Manjeet Dhakal of the Climate Analytics South Asia told us from Belém. “Having said that, it is simply not enough. Emissions need to go down much further, and a lot of it is tied to developed countries providing climate finance to do so.” Many developing countries have adopted ‘conditional NDCs’ which means their emission reduction targets cannot be met without international climate finance. In its third NDC, Nepal set a target of a 17.1% reduction in net greenhouse gas emissions and 26.8% by 2035. But achieving that has a price tag of &nbsp;$73.74 billion, with much of it from international climate finance. UNDERFINANCED However, the climate for climate finance is getting worse. The United States has exited from the Paris Agreement for the second time under President Trump, and there are cutbacks in foreign aid by European funders. Even so, the EU has committed to reducing its emissions by 90% in the next 15 years, 85% of which will be domestic emission cuts. The silver lining in all this is that the leadership in climate action is increasingly being taken by Nepal’s neighbours China and India with both investing heavily in renewable energy. China is the world leader in solar panels, wind turbines and electric vehicles, and Nepal has already taken strategic advantage of this.&nbsp; With expensive hydropower plants increasingly at risk from glacial lake outburst floods, experts say Nepal must diversify its energy mix and invest in solar power which has 10 times more potential than hydropower at 432 gigawatts with over 300 days of sunshine a year. Solar farms can also power pump storage, which are cheaper and quicker to build.&nbsp; China has drastically reduced the cost of photovoltaic cells, making such schemes more feasible. Nepal just needs to ease up its restrictive domestic energy policies, boost investment and resist geopolitical pressure on electricity generation. “First, we need to increase the cap on solar energy from 10% to 30%, and next, the bidding process should be made easier, or just have the first past the post system like that for hydropower,” says Kushal Gurung. The disadvantage of solar power is that it generates only daytime energy, but this can be solved with grid-scale battery storage or pump storage. But first, the government needs to fix the rate for solar purchase so that entrepreneurs are incentivised. “This is not happening because our government officials and engineers are comfortable dealing with hydropower, and are not just updated about the latest advances,” says Gurung. “As a result, we have no clear policies when it comes to solar.” Hydropower has become one of the biggest industries in Nepal with an installed capacity of over 3,400MW and the government’s target is to produce 28,500MW in the next ten years. But the recent climate disasters have made it clear that relying only on hydropower alone is too risky. The Nepal-Tibet glacial flood in July destroyed and damaged four hydropower plants and substations along the Bhote Kosi, and last September’s floods slashed the country’s total generation by half. Nepal now needs to build on the widespread adoption of battery-powered vehicles by extending it to electric public transport and for household appliances like stoves, rice cookers and refrigerators. Not only would this reduce Nepal’s per capita carbon footprint, but it would also reduce the country’s annual Rs300 billion petroleum import bill. At global platforms like UNFCCC, it is easy even for individual developed countries to get lost without an alliance. Now that Nepal is graduating from LDC status, it needs to have strong partners with a common goal to move forward in international negotiations. Says Kushal Gurung: “We won’t have privilege that came with LDC status anymore, which means climate finance will be even more limited.
